AN ORDINANCE ACCEPTING THE LO\>/EST AND
BEST BID FOR AVERY PARK IMPROVEMENTS -
> ~ PHASE II: AND MONTEREY PARK DEVELOP-
I , MENT: AND DECLARING AN EMERGENCY.

\~HEREAS , pursuant to Ordinance 09-78 bids have been received for
sa i d Park improvements; and
WHEREAS, the Ohio Department of Natural Resources has recommended
and approved the bid of The Righter Co. for the Avery Park Devel-
opment Phase II and has also recommended and approved the bid of
The Righter Co. for the Monterey Park Development: and
WHEREAS, Counc i I has determined that the bid of The Righter Co.
in the amount of $55,813.00 is the lowest and best bid for Avery
Park Development-Phase II and has determined that the bid ~f~t
Ri~hter Co. in the amount of $90;250.00 is the lowest and best
bid for Monterey Park De~elopment;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of
Dubl in, State of Ohio, ~ of the members elected thereto:.concur

SECTION I . That the bid of The Righter Co. for Avery Park Im-
...."1 I provements-Phase II and the bid of The Righter Co. for Monterey

Park Development both in accordance with the plans and specifica-
tions presently on file in the office of the Clerk-Treasurer be,
and they hereby are accepted.
SECTION 2. That the Village Admi~istrator and the Clerk-Treasure
be, and they hereby are, directed to execute contracts in the
name ~f~the Village with the said Righter Co. for Avery Park Im-
provements Phase II, and with the, said Righter Co. for Monterey
Park Developments, both in accordance with the plans and specifi-
cations presently on file in the office of the Clerk-Treasurer
and in accordance with the said bids of The Righter Co.
, , SECTION 3. That this Ordinance be, and the same hereby is, de-
clared to be an emergency measure necessary for the immediate
preservation of the public peace, health and safety and for the
further reason that these Park developments are needed to meet
the recreational needs of Village residents and to utilize Federal
funds being used in connection with these improvements and there-
. fore this Ordinance shall take effect and be in force immediately
upon its passage.
