AN ORDINANCE DETERMINING TO PROCEED WITH I
THE CONSTRUCTION OF PHASE I I MUN I C I PA L I
SEWAGE COLLECTION SYSTEM AND DECLARING
~ AN EMERGENCY.
BE IT OROAINED by the Council of the Vi Ilage of Dubl in, Frankl in
and Delaware Counties, State of Ohio.
SECTION I . That it is hereby determined to proceed with the con-
struction of the Phase I I Municipal Sewage Collection System in
the public streets and right-of-ways and easements as fully des-
cribed in Resolution No:49-77, pa ssed on January 16, 1978 de-
claring the necessity of constructing said system.
SECTION 2. That said improvement shall be made in accordance wit.
the provisions of said Resolution #49-77 and with the plans, spe-
c i f i cat i on s, estimates and profiles heretofore approved and now
on f i I e in the office of the Village Clerk.
SECT! ON 3. That all claims for damages resulting therefrom that I
have been legally filed, sha II be inquired after the completion
of the proposed improvement, and the Solicitor is hereby author- I
ized and directed to inst itute I ega I proceedings in a court of
competent jurisdiction to inquire into claims that have been so I

SECTION 4..:- That portion of the cost provided in the above-men-
tioned resolution of necessity to be assessed shall be assessed
in the manner and the number of installments provided i n sa i d
Resolution and on the lots and land described therein.
SECTION 5. That the estimated assessments heretofore prepared
and fi led in the office of the Vi Ilage Clerk and as equalized by
the board heretofore appointed for such purpose by Resolution
No.II-78 adopted on April 17, 1978, the report of which board
was approved by Resolution /3-78 adopted May 15, 1978, be and I
the same hereby are adopted. 1
~ECTION 6. The Village Clerk is hereby directed to deliver a I

certified copy of this Ordinance to the County Auditor within I
fifteen days after its passage.
SECTION 7. Subject to the provisions of RC 727.24, the Village I
I
Adm i n i strator is hereby authorized and directed as soon as the I
funds therefore are available to make and execute a contract for I
~ said improvement with the lowest and best bidder after advertis-
ing according to law and the improvement shall be financed as
provided in the resolution of necessity.
SECTION 8. This Ordinance is hereby declared to be an emergency
measure necessary for the immediate preservation of the public
peace, health and safety of said Village and for the further rea-
son that the i mmed i ate construct i on of sa ild improvement is nec-
essary to provide a ~ewage collection system and protect the health
of these inhabitants of the Village, wherefore this Ordinance I
sha II be i n fu I I force and effect from and immediately after its I
passage.
