AN ORDINANCE DETERMINING TO PROCEED WITH THE
CONSTRUCTION OF A MUNICIPAL SEWAGE COLLECTION
SYSTEM IN THE VILLAGE OF DUBLIN, OHIO,
AND DECLARING AN EMERGENCY.
('. Be It Ordained by the council of the Village of Dublin, Franklin
. County, State of Ohio:

I Section l. That it is hereby determined to proceed with the con-
'-' struction in the Village of Dublin, of a Municipal Sewage Collection System:
including trunk sewers, sub-trunk sewers, local sewers and appurtenances
in the public streets and right of ways and easements as fully described
in Resolution No. 16-74 passed on July 15, 1974, declaring the necessity
of constructing said system.
Section 2. That said improvement shall be made in accordance withl
the provisions of said Resolution No. 16-74, and with the plans, specifica-I
tions,estimates and profiles heretofore approved and now on file in the
office of the Village Clerk.
Section 3. That all claims for damages resulting therefrom that
have been legally filed shall be inquired after completion of the proposed
improvement, and the Solicitor is hereby authorized and directed to insti- I
tute legal proceedings in a court of competent jurisdiction to inquire into
claims that have been so filed.

Section 4. That portion of the cost provided in the above-mentioned
resolution of necessity to be assessed shall be assessed in the manner and I
the number of installments provided in said resolution and on the lots and
lands described therein. I

Section 5. That the estimated assessments heretofore prepared andl \,

filed in the office of the Village Clerk and as equalized by the board herer ....
~' tofore appointed for such purpose by Resolution No. 25-75 adopted on
June 2 ,19 75, the report of which board was approved by Resolu-
tion No. '~--1~ adopted July 21, 1975, be and the same are hereby adopted.

Section 6. The Village Clerk is hereby directed to deliver a certi-
~ied copy of this ordinance to the county auditor within fifteen days afterl
lts passage.

Section 7. Subject to the provisions of RC ~727.24, the Village I
Administrator is hereby authorized and directed as soon as the funds therefor
are available to make and execute a contract for said improvement with the [
lowest and best bidder after advertising according to law and the improvement
shall be financed as provided in the resolution of necessity. !
Section 8. This ordinance is hereby declared to be an emergency
measure necessary for the immediate preservation of .the public peace, health
and safety of said village and for the further reason that the immediate I
construction of said improvement is necessary to afford proper and efficient
sanitary sewerage and protect the health of the abutting owners and the in-I
habitants of the village; wherefore this ordinance shall be in full force
and effect from and immediately after its passage.
