BE IT ORDAINED by the COUNCIL of the VILLAGE OF DUBLIN, OHIO, to of the elected members concurring, that: SECTION 1. The Contract, attached hereto, marked Exhibit "A" and made a part hereof, between the Village of Dublin and the Washington- Perry Township Fireboard for the care, cleaning and maintenance of the Village's Fire Hydrant Water System be, and it is hereby approved and ac- cepted, and, the Mayor and Clerk-Treasurer are, hereby, authorized for, and on behalf of the Village, to execute said Contract; and SECTION 2. This Ordinance be, and it is hereby, declared to be an emergency measure necessary for the immediate preservation of the C public, peace, health and safety for the reason that a portion of the Village's said Fire Hydrant Water System is, in the near future, going to be accepted and approved by the Village Engineer; and that, therefore, this Ordinance be in force and take effect immediately upon its passage. AGREEMENT rJf(j) if t.<~7S' p"J~cp I 0 ~ ~ 0 .- 7 S- This contract made and entered into by and between the Washington- Perry Township Fireboard, referred to throughout this contract as the Fire- board; and The Village of Dublin, referred to throughout this contract as the ('. Village; . , \.J Whereas the Village desires to enter into a contract with the Fire- Board for care, cleaning, and maintenance of the Village's fire hydrant water system. It is, lHEREFORE, AGREED by and between the parties hereto, as follows: 1. The Fireboard, through its fire department, shall care for the said fire hydrants in accordance with the following schedule: A. Spring-flushing of each and every hydrant; B. Snmner-clearing of debris and plant growth; C. Fall-pump each and every hydrant; I D. Winter-inspection to ascertain working condition; 2. At all times the Fireboard, by and through its Fire Department, n shall keep said fire hydrants, free and clear to easy access and usage, and shall immediately bring to the attention of the Village any defective, leak- L ing or inoperative hydrants, valves, mains, and equipment ancillary to the operation of the water supply fire fighting eqUipment. 3. The Village agrees that either it, and/or any developer or contract- or installing new fire hydrants must first submit plans and specifications showing the location of all hydrants and watch valves and size of the mains to the Fire Department for approval prior to installation. In the event such aforementioned equipment has previously been installed, such plans and specifications must still be submitted to the Fire Department prior to acceptance and approval of said equipment. 4. For the above enumerated services, the Fireboard shall receive from the Village, five dollars ($5.00) per hydrant per year. No provision of this contract shall take effect until properly executed by both a quorum of Trustees of the Washington-Perry Township Fire- board, and properly adopted by the Village of Dublin, in ordinance fonn, and . . . , . ~ 4 .~ 4 in keeping with the laws of Ohio controlling such governmental tmi ts . 6. This contract is of one year duration beginning at the date of this contract and its final acceptance by both the Fireboard and the Village and end- ing September 15, 1976. The contract shall automatically renew continually for \, additional one year terms without modification, tmless either of the parties gives written notice by September first (1st) that they wish to rescind or ~ modify this contract. 7. All portions of this contract are severable; should one portion be fotmd tmenforceable, void, voidable, or tmlawful, it shall not void the en- tire contract.
