AN ORDINANCE AUTHORIZING AND DIRECTING
THE VILLAGE AD~INISTRATOR TO ADVERTISE

\VHEREAS, the present contract for garbage and rubbish collecting
and hauling for the Village expires on September 30, 1979; and
WHEREAS, there is a need and it is,therefor~desirous to con-
tinue to provide said service to Vii lage residents suSsequent
to the said contract expiration date:

Dubl in, State of Ohio, ~ of the elected members concurring:
SECTION, I. That the Vii lage Administrator be, and hereby IS,
authorized and directed to advertise for bids for garbage and
rubbish collection a~d haul ing service for the Vii lage of Dubl in,
Ohio for the period com~encing October I, 1979 and ending Septem-
ber 30, 1981,according to the follo\~ing contract specifications:

Garbage and rubbish to be collected from al 17residences in the
corporate I imits of the Vi I lage of Dubl in, Ohio on the same
spec i f i ed day of each \~eek. I f a I ega I ho I i day fa II s on a spee-
D; ified pick-up day, then the garbage and rubbish collection may
. I be made on the nex~ day of that week. The term rubbish shal I

as bottles, tin cans, food, food containers, ashes, cinders,
tree and hedge c I i pp i ngs, grass t,... i mm i n 98, I eave sand ot her \~aste
material accumulating about residential property. The term rubbis1
does not i nc I ude \vaste mater i a I accumu I ated in the co.u:tr'uct ion,
remodel ing or repair of bui Idings. The Contractor shal I bid both
to remove said garbage and rubbish from where the Contractor can
back a truck to within five (5) feet of the garL-age/rubbish
containers, and an alte,...nate bid for collection by the Contractor
assuming said garbage and rubbish is'placed within ten (10) feet
. of a pu~1 ic street by a householder.
The householders' trash and Qarbace containers shal I be twenty
(20) or thirty (30) gal Ions ;n sl;e, and shal I not exceed one'
hundred twenty (120) gallons per residence per week. Cans must
have tight fitting I ids and handles. Plastic bags must be tied.
Contractor is to replace I ids on containers. Business trash IS
not to be included in normal household trash. Any tree or hedge
cl ippings shal I be tied in bundles not over four (4) feet long
or placed in plastic bags by the property owner. Contractor IS
not required to pick up more than two(2) thirty (30) gal Ion
(J plastic bags of trimmings or two (2) bundles of such trimmings
",. per home per week. Contractor shal I remove weekly al I refuse and
trash in Vi Ilage owned trash cans, not to exceed twelve (12) In
number. Contractor must have closed packer type truck to pick
up rubbish and garbage.
The relationship between the Vi I lage of Dubl in and the contractinc
party shal I be solely contractual and the contractor shal I fur-
nish al I equipment and labor for all services to be performed.
Contractor shal I carry industrial compensation insurance of the
Stete of Ohio and pay al I lawful payrol I deductions and unemploy-
ment compensation payments due any governmental agency.

e Contractor sha II be responsible for any negl igence of the Con-
tractor or any of the contractor's agents, officers or employees.
A II equipment, including trucks and automobiles, but not limited
thereto, used In said garbage and trash collection shal I be pro-
tected by pub I i c I iabi lity and property damage Insurance in the
amount of at least $250,000.00 to protect the Vi I lage of Dubl in
and its inhabitants, and to save and hold harmless from and
against any and al I negl igent acts of the Contractor, his agents,
or employees.
Pi ds sha II specify a lump su~ price for each month during the con
tinuance of the contract for 9arbag7,'a~d rubbish collection and
hauling service for al I existin9/7:~~~e~ces in the Vi Ilage of
Dubl in at this time, and bid,s shall also specify an additional
price for each additionalf~~s~Bence bui It and occupied or annexed
to the Vi I lage after the awarding of this contract and said bid
sha II be on a monthly basis for each such additional residence.
The contract price may be mo~ified accord i ng to law during the
term of this contract to compensate for increased cost of disposa .
The Contractor shal I be paid on or before the 10th day of each
month. Said contract is to cancellable by the Vii lage of D~~I in,
without I iabi I ity, upon thirty (30) days written notice of can-
CJ ce II at i on to the contractor.
All bids shal I be sealed and shal I be fi led with the Vii lage Ad-
ministrator of the Village of Dubl in, Ohio before 12:00 Noon
on 5EI T- 7 . I ?1? , at \vhich time said bids
shal I be c~ened. ~I I bids shal I be accompanied by a bond or cert-
ified check in the amount of $100.00. The COLlnc i I of t he V i II age
of Dubl in reserves the right to reject any and al I bids.
SECTION 2. This Ordinance shal I take effect and be In force
from and after the earl iest period al lowed by law.
