AN ORDINANCE AMENDING ORDINANCE NO: 27-74,
THE SUBDIVISION REGULATIONS OF THE V I LLAGE
OF DUBLIN, OHIO: AND SETTING A PUB L I C HEAR-
f""" ING THEREON.

WHEREAS, Counc i I IS of the opinion that the fol lowing proposed a-
mendments of the Village of Dublin, Ohio Subdivision Regulations
are needed, and appropriate.
NOW, THEREFORE, BE IT ORDAINED, by the Counc i I of the V i II age of
Dublin, State of Ohio, ____ of the elected members concurring:
SECTION I . Delete the last paragraph of Article No: 204 In its
entirety, wh ich reads, "The subdivider sha II pay such additional
costs necessary to provide for plat or plan reView, incltidin~,
but not I imited to, , , plannin~, le~al and architect-
englneerln~,
ural costs and expenses "

SECTION 2. In Article No: 302, delete only the following:
"The cost of the services of the En~ineer In review and approval
of detai led plans and specifications, and the cost of inspection,
sha II be reimbursed to the Vi I lage by the developer. "
SECTION 3. Delete Article No: 304.03 and replace entire Article
".... 304.03 as an amendment, as fo II ows: "The owner has furnished a
I subdivision bond and a maintenance bond payable to the V i II a~e
~ with sureties acceptable to Counci I conditioned upon performance
bv the owner of the a9reement, or In lieu of such bonds, some

ot her security satisfactory to Counci I. The amount of the sub-
division bond sha II be equal to the estimated costs of construct-
i n9 the improvements. The maintenance bond shal I be In an amount
of 10 percent of the subdivision bond for the purpose of maintain
i n9 them for a period of one year. The subdivision bond sha II
provide that it cannot be terminated or canceled without approval
of the Village, and shall remaIn In force unt i I such improvements
have been accepted by the En9ineer. The maintenance bond shal I
become effective on the date the improvements are accepted by the
En~ineer, and sha II remain In effect for a period of not I ess that
one year and unt i I any and all corrective measures have been ac-
compl ished and agE approved by the En9ineer.
SECTION 4. Delete Articles 305.01, 305.02, 305.03 and 305.04 and
replace said sections of Article No: 305, as an amendment, as
fo II ows : "For a subdivision wit h i n t he Vi "aoe the subdivider
sha II pay to the Vi I laqe an amount equal to five oercent (1)%) of
the estimated costs of the improvements. Said fee is for plan
,.... reviews. construction inspections. leqal services and administra-
tive expenses incidental to such improvement. Th is fee sha II be
........ paid by the subdivider prior to the start of any construction and
before obtainin9 the required si9natures on the final p I at.
SECTION 5. In Article No: 313.04 delete the last eight words of
said Section which reads, " and lot acreages to centerline of ad-
jacent streets. "
SECTION 6. Delete, except for title heading, the entire Article
No: 315 and replace entire Article, as an amendment, as fol lows:

"For a period of one year from the date the constructed Improve-
r'" ments were accepted by the Vi I la~e. the subdivider shal I make
such repairs or replacements as determined by the En~ineer to

regulations. The subdivider shal I furnish the Vi IlaQe a bond or
other surety acceptable to Counci I in the amount of ten (10) oer-
cent of the subdivision bond for said purpose. Sa i d bond sha II
be effective from the date of acceptance of the improvements un-
t i I a II maintenance items have been performed and accepted by the
Engineer.
SECTION 7. The date and time for the Publ ic Hearing on these
amendments IS, hereby, set for /YJIH 7 1117 , 1979 at
7:30 P. r/. in the Dubl in .\1un i c i pa I Bui Iding, 6665 Coffman Road,
Dublin, Ohio.
SECTION 8. This Ord i nance sha II take effect and be in force from
and after the earl iest period al lowed by law.
