015-79 Ordinance -. - FER 5 1979 =Fier: HVf)R6iJ".J/ ORDINANCE NO, ~7' AN ORDINANCE AMENDING THE CODE OF ORDINANCES, SECTION 132.16 fu~D ENACTING NEW SECTION 132,16 (B) AND DECLARING AN EMERGENCY ,;~'lb. I WHEREAS, the present Code of Ordinances does not provide ''- a penalty for unauthorized use of a Village fire hydrant, and WHEREAS, the public health, safety, and welfare of the inhabitants of the Village of Dublin necessitates that such unauthorized use of fire hydrants be prohibited so that there is adequate water pressure and availability of fire hydrants in times of emergency, NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, Ohio, , members concurring that: Section 1. The Code of Ordinances of the Village and Section 132.16 be and hereby is retitled to read: Section 132.16 UNAUTHORIZED USE OF OR TAMPERING WITH MUNICIPAL PROPERTY, ~ Section 2. That the present prohibitions of Section 132,16 remain identical except that said text be preceded by the I designation (A) to read as follows: It shall be unlawful to maliciously tamper with, injure, destroy, steal or remove any lamp, lantern, lamp post, pole, cable, electric line, tool, hose, pipe, conduit, road material, earth, stone, ordinance or other posted notice, street sign, or any other property or material owned or under the supervision or control of this municipality or any department thereof. Any person violating this section shall be fined not more than $200.00 or imprisoned not more -- than 30 days or both. Section 3. That new Section 132.16(B) be and hereby is enacted to read as follows: I I I I -- ~ - (B) No person shall recklessly. without privilege or authorization to do so. use. tamper with, injure, destroy, steal, remove, or otherwise impair the effectiveness of any +\~,' Village fire hydrant. All authorizatioI'B for use of fire hydrants '.,...... within the Village shall be first obtained from the Village Administrator. Whoever violates this section shall be fined not more than $500.00 or imprisoned not more than six (6) months or both. Section 4. That this Ordinance be and the same hereby is, declared to be an emergency measure necessary for the immediate preservation of the public health, safety, and welfare; there- fore. this Ordinance shall take effect and be in force immediately upon its passage.
