MEMORANDUM TO Jane Braatigam, City Manager Dublin City Council FROM Stephen J. Smith, Law Director Stephen J. Smith, Assistant Law Director DATE: September 27, 2007 RE: Ordinance 74-07 Franklin County Board of Health— Health Services Contract Each year the City of Dublin ( "Dublin ") enters into a contract with the Franklin County Board of Health (`Board of Health ") to provide health services in Dublin. In reviewing the most recent version of the contract, Dublin City Council raised questions regarding the provision in the contract that required the Law Director for Dublin to litigate health regulations in Dublin. Upon review, tins provision was modified to the current language in 2002. Generally, any investigation would be handled intemally by the Board of Health. Following the investigation, a report would be compiled and tamed over to the Law Director's Office for action. This action would most likely be in the form of a criminal complaint. To date, the Law Director's Office has not been asked to litigate and/or prosecute any cases under this contract. Please do not hesitate to contact this office if you have any questions regarding this matter.
