03-66 Ordinance ---- -- - - -- --- - --... -- f. ..!iI'.. k ORDINANCE NO 03-~~ VILLAGE OF DUBLIN, OHIO Ordinance requesting bids on a contract furnishing to the Village of Dublin, Ohio, garbage and rubbish hauling service. r ~ BE IT ORDAINED by the Council of the Village of Dublin, Ohio, b members present herein concurring: SECTION I. That the Council finds that the present contract for garbage and rubbish collecting expires March 5, 1966, and finds that the Village of Dublin is in need of a contract for said service subsequent to that date. SECTION 2. That this contract shall be for a period commencing March 6 1966 and to continue until March 5, 1968 and shall provide that the refuse, gar- bage, trash, rubbish and cinders be collected from the residences of the Villa e of Dublin, Ohio, on the same specified day of each week. The said garbage, rubbish and trash to be removed from any accessible location upon any residen (' tial property. If a legal holiday falls on said specified day, then the trash and tr garbage collection may be made on the next day of that week. The relationship between the Village of Dublin and that of the contracting party is to be solely that of a contractual relationship and the contractor is to furnish all equipment and labor for all services to be performed hereunder. Contractor shall be re- s ponsible for any negligence of contractor or any of the contractor's agents, officers or employees. Contractor shall carry industrial compensation insur- ance of the State of Ohio and shall carry and pay all lawful payroll and unem- ployment compensation due any governmental agency. All equipment including ~ .. trucks and automobiles, but not limited thereto, used in said garbage and tras collection shall be pro~cted by public liability and property damage insurance (" IC>CJ oco. 00 . in the amount of at least .$&" I eo~. @e---to protect the Village of Dublin, Ohio, I ,.... and its inhabitants. All containers furnished by the householders shall not be over 30 gallon in size. Any brush, newspapers or magazines shall be tied in bundles or in containers and the brush to be tied in bundles not over 4 feet Ion and any brush or ashes to be placed at the curb line. The term rubbish shall include all household waste matter such as bottles, tin cans, food containers, ashes, trees and hedge clippings, grass trimmings, leaves and other waste - --- - - -- -- - -- - -- - - i --. k material accumulating about residential property. The term rubbish does not include waste material accumulated in the construction, remodeling or repair of buildings. Contractor shall remove all refuse and trash in Village owned trash cans r weekly, not to exceed eight (8) in number. \ ' ~ Bids shall specify a contractual lump s urn price for each month during the continuance of this contract for garbage and refuse and trash hauling service fo all of the existing residences in the Village of Dublin at this time and bids shal specify an additional price for each additional residence built and occupied afte the awarding of this contract and said'bid shall be on a monthly basis for each additional house. Contract to be entered into shall specify that the Village of Dublin shall ha e the right to cancel this contract without any liability whatsoever to the Village Dublin on sixty days written notice to the contractor of the cancellation of this contract. ~ All bids to be accompanied by bond or certified check in the amount of ~ $100.00. The Council reserves the right to reject any and all bids. SECTION 3. That the Village Clerk shall advertise by legal notice the above specifications for the contract and of acceptance of bids for the said con- tract for two (2) consecutive weeks in the Plain City Advocate. That all bids shall be opened by the Clerk of the Village of Dublin on March 5, 1966 at 12 :00 Noon. SECTION 4. That this Ordinance be, and the same hereby is, declared to be an emergency measure necessary for the immediate preservation of the pub lic peace, safety and general welfare for the reason that the garbage and rubbi h (' collection is needed to protect the peace, health, safety and general we lfare of l I ~ the Village of Dublin, Ohio, and this Ordinance shall take effect and be in forc immediately upon its passage.
