ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE VILLAGE ADMINISTRATOR
AND THE CLERK-TREASURER TO ENTER INTO A CONTRACT
FOR ENGINEERING SERVICES WITH HOCKADEN-LIPES-ROUSCULP.
INC., CONSULTING ENGINEERS OF CO LUMBU S. OHIO

WHEREAS. certain situations may arise wherein a conflict of interest

- would exist if the regular engineering firm of Burgess & Niple Ltd.. consulti
engineers. the engineer for the Village of Dublin. were to review and
approve detailed plans and plats in accordance with subdivision regulations
and zoning regulations of the Village of Dublin where such plans have been
prepared by Burgess & Niple Ltd. ; and
WHEREAS. Burgess & Niple Ltd. has requested that in such
instances the Village employ an independent engineering firm to make such
reviews and approvals; and
WHEREAS. the Planning Commission for the Village of Dublin has
recommended that the Village employ the firm of Hockaden-Lipes-Rousculp.
l Inc.. consulting engineers. for such purpose; and
~u:.V WHEREAS. the Village Council is of the opinion that the said firm of
Hockaden-Lipes-Rouscl1lp. Inc.. consulting engineers. is a suitable firm for
employment by the Village for such purpose:
NOW. THEREFORE. BE IT ORDAINED by the Council of the Village
of Dublin. State of Ohio. 6' of the elected members concurring:
SECTION 1. That the Village Administrator and the Clerk-
Treasurer be. and they hereby are. authorized to enter into a contract for
engineering services with Hockaden-Lipes-Rousculp. Inc.. consulting
engineers. Columbus. Ohio. on the terms set forth in the attached draft.
which attached draft is hereby incorporated into and made a part of this

SECTION 2. That this ordinance be. and it hereby is. declared
to be an emergency measure necessary for the immediate preservation of the
public peace. health and safety for the reason that such a conflict of intere st

. presently exists with respect to certain plans which have been submitted to
the Village for approval, which pmns have been drawn by the regular Village
Engineers of Burgess & Niple Ltd. and there is an immediate need for the
review of said plans; and that this ordinance shall take effect and be in force
immediately upon its passage.

CONTRACT BETWEEN THE VILLAGE OF DUBLIN, OHIO,
AND HOCKADEN-LIPES-ROUSCULP, INC., CONSULTING
ENGINEERS, FOR ENGINEERING SERVICES TO THE
VILLAGE OF DUBLIN, OHIO
This Agreement, made and entered into this "0 day of fJ.JJG, , 1973,
I!"'" by and between the Village of Dublin, Ohio, hereinafter referred to as the "Village"
-... and the firm of Hockaden-Lipes-Rousculp, Inc., Consulting Engineers of Columbus,
Ohio, hereinafter referred to as the "Assistant Engineer ", WITNESSE TH:
SECTION 1. That the said Village hereby employs the said engineers as the
Assistant Engineer for the Village until such time as this agreement is terminated
upon thirty (30) days notice in writing by either party hereto, and the said engineer
hereby accepts said employment upon the following terms and conditions, to-wit:
SECTION 2. The said Assistant Engineer shall review and approve or
disapprove detailed plans and plats submitted to the Village in accordance with the
subdivision regulations and zoning regulations of the Village where such plans and
plats submitted have been prepared by the firm of Burgess & Niple, Ltd., Consulting
Engineers.
SECTION 3. For the purpose of reviewing said plans and plats, Mr. George

W. Hockaden shall be designated as Assistant Village Engineer and shall sign said
plans and plats as provided for in said regulations.
SECTION 4. The Village agrees to pay the Assistant Engineer, monthly, as
compensation for the professional engineering services described above, for the time
expended by the Assistant Engineer in performing the required services hereunder
according to the following hourly rates:
Principal Engineer $15.00 per hour
Design Supervisor $12.50 per hour
Engineer or key personnel $10.50 per hour
Surveyor or key assistant $ 8.50 per hour
Draftsmen and assistants $ 8.00 per hour .;{

"i SECTION 5. This Agreement may be terminated upon thirty (30) days notice

in writing by either party hereto.
SECTION 6. The Village and the Assistant Engineer have bound themselves,
their members, successors and assigns to the other party of this agreement and to
the members, successors and assigns of the other party in respect to all covenants
in this agreement. Neither the Village nor the Assistant Engineer shall assign,

sublet or transfer their interest in this agreement without the written consent of
the other party thereto.
