AI I signs hereafter constructed shal I be constructed only in accordance with the provisions of this ........ section or as modified by the Architectural Board in areas over which they have jurisdiction. 541.011 Purpose. The purpose of this section is to authorize the use of signs which are compatible with their sur- roundings, appropriate to the type of activity to which they pertain, expressive of the identity of individual proprietors or of the community as a whole, and legible in the circumstances in which they are seen. 541 .01 2 Territorial Limits. The provisions of this section shall apply to all land within or hereafter annexed to the Village of Dubl in, Ohio. 54 1 . 0 I 3 Modification by Architectural Soard. Within the (CCC) Central Community Commercial District and the (CS) Cen- tral Business District, the Architectural Board shal I have authority to modify al I regulations to insure that signs are consistent with and appropriate to the intent and purpose of Sections 561.02 and 561.03 of this Ordinance. 541 .02 EXEMPTIONS AND LIMITATIONS. The provisions of these regula- ".- tions shal I not apply to: (I) the flag, pennant, or insignia of any nation, state, city or other pol itical unit; (2) signs of a duly constituted governmental body including traffic or ~. similar regulatory devices, legal notices, or warnings at ra i I road cross i ngs; (3) signs denoting architect, engineer, or contractor when placed on construction sites and not exceeding 32 square feet in area; (4) signs required to be maintained by law or governmental order, rule, or regulation, with a total surface area not exceeding 10 square feet in a rea; (5) signs not exceeding one square foot in area and bearing only property numbers, post box numbers, or names of occupants of premises; (6) temporary signs not exceeding 8 square feet in area advertising the sale or lease of real estate when located on property to which the sign refers, provided, however, that these signs shal I be removed within 14 calendar days fol lowing sale or lease of the property, or (7) signs pertaining to duly constituted elections. 541 . 021 No sign shal I be placed in street rights-of-way or publ ic parks or on util ity poles, trees, or publ ic property and area allowances for signs may be uti- I ized only on the side of the building from which they are calculated. In approving this type of sign, consideration shal I be given to traffic safety, intensity of building develop- meni- , scale of the sign with regard to bui (dings and pedestrians and the intensity of illumination expressed in foot candles or lumens. 541 .027 The level of illumination emitted or reflected from a sign sha II not be of an intensity sufficient to con- stitute a demonstrable safety hazard to vehicular move- ment on any street from which the sign may be viewed. Except where specitical Iy defined herein, al I words used in this section of the Zoning Code shat I carry their customary meanings. Words used in the present tense include the future tense; the singular number includes the plural; the word structure includes the word building; the word lot includes the word plot or parcel; the term shal I is always mandatory; the words "used" or "occupied" as ap- pI led to any land or structure shal I be construed to in- clude the words "intended, arranged or designed to be used or occup i ed" . SIGN. Any structure or part thereof or device attached thereto or represented thereon, which shal I display or in- clude any letter, words, model, banner, flag, pennant, insignia or representation used as, or which is in the i nature of an announcement, direction or advertisement. f~ GROUND SIGN. A sign supported by a pole, uprights, or braces on the ground. - WAll SIGN. A sign erected paral leI to the face, on the face, or painted on the outside wal I of any building. No , wal I sign may project more than 12 inches from the wal I to which it is attached, nor project above the roof line of the building to which it is attached. ROOF SIGN. A detached sign supported upon the roof of a bu i I ding. PROJECTING SIGN. A sign attached to a wal I and extending from it in a perpendicular direction. STREET FRONTAGE. The total width of that side ot the bui Iding which faces the street, excluding any extension of a building wal I beyond the building itself. Where the site abuts more than one publ ic street, the appl icant shall specify \'!hich is the primary frontage, and signs may be per- mitted on the basis of the area authorized for each lineal foot of priwary street frontage and. one-half thereof for each I inea I foot of other street frontage. The highest point on a rooT, or the highest point on another architectural element that may block the rear view of a sign. .'i~I;>U,., SIGN AREA. The allowable sign area of any sign is the maximum projected surface area which can be viewed from - anyone vantage point. ITEM OF INFOR~~TION. One syl rabIe, symbol, abbreviation, broken plane, or discontinuous odd shape. No premises shal I display to one right-of-way more than 10 items of i nformat ion. The fol lowing are not considered items of information: ( I ) lettering less than 3 inches in height. (2) Arch i tectura I letters, i . e., letters less than 19 inches high carved into the fabric of a building or attached securely to it, provided that (a) they are not specifically illuminated or constructed of a shiny ma- terial, (b) the color does not contrast sharply with that of the building fabric, and (c) they do not exceed one inch in thickness. 54 I . 04 TABLE OF DESIGN ELEMENTS. A table of basic design ele- ,;~--< ments is hereby attached to and made a part of this code. No sign may be erected, displayed, or substantially altered or reconstructed except in conformance with this section of ~. the Zoning Code. (See Table on fol lowing page.) 54 I .05 GROUND SIGNS. Where permitted and of the character al lowed in SECTION 541.04, ground signs may be displayed provided: (I) The use is accessible by automobile and has off-street parkingj ( 2) The edge of the bui Iding or structure in which the use is conducted is set back at least 30 feet from the edge of the adjacent street or highway right-of-~ay. Ground, wall or roof signs may be used in any combination where permitted. In the event the above maximum allowable sign area is less than the allowable area of a ground sign permitted in a district, the maximum sign area permitted shall be governed by the ground sign regulation. (5) Se2 Section 541.06 (6). (6) Only individual cut-out letters and/or symbols may be attached to, painted, stenciled, or otherwise placed on these devices. If lettering exceeds three inches in height, it is debited against total number of items of information allotted to that establishment. (7) Ground-supported displays of this type shall be allowed only where sidewalk is f' at least 15 feet wide. If showcase projects from building front, projection may not exceed 24 inches. (9) In gasoline service stations, temporary signs may be posted flat on pumps only, one facing each way on each pump, provided such signs do not exceed four square feet in size. (10) See Section 541.07 (4). (ll) Within any PUD District, signs shall be regulated in accordance with the regulations of that zoning district which is most appropriate to the development, such determina- tion to be made by the Commission following approval of the Preliminary Development Plan. (12) X-Way - Freeways, expressways and other controlled access highways whose speed limits exceed 60 mph. r L., ... (4) A use may have both ground and projecting signs if only one of these signs is 6 square feet or more in size. ( 5) In addition to the regulations contained in Section 541.04, in the PSC, PHS, PIP ~., and OLR districts where the area developed consists of more than one lot, is in single ownership or managership, and exceeds 150 acres in gross area, a single sign exhibit- ing only a name, trademark, symbol or graphic such as a logo, may be erected to a height not to exceed 100 feet and con- tain a total display surface area not to exceed 800 square feet. The location of such sign shal I have the specific approval of the Commission and must be located on the site to which the sign refers. (6) In addition to the regulations contained in Section 541.04, in any district located within 3,000 feet of the intersection of the center I ines of highways 1-270 and U.S. 33 and within 1,800 feet of the intersection of the centerl ines of al I other interchanges in the vii lage, a sign may be erected to a height not to exceed 60 feet and contain a ",ff~ total area not to exceed 400 square feet provided that: (I) the sign is located on the property to which the sign refers; (2) the sign refers only to service stations or - motels; (3) the sign shal I contain no more than six co I ors; (4) the location of the sign shall be approved by the Commission; and (5) the sign shal I not be located in any required yard space. (7) The provisions of paragraphs (5) and (6) may not be appl ied cumulatively. 54 I . 06 WALL AND ROOF SIGNS. Where permitted and of the character al lowed in SECTION 541.04, wal I and roof signs may be dis- played in accordance with the fol lowing regulations: (I) Where aJ lowed, any use may display either a wall or roof sign or a combination of both. (2) If the sign is enclosed by a box or outl ine, the total area of the sign, including the background, is counted as part of the sign- able area. If the sign consists of individual letters, only the area of the letters is ~ counted as part of the signable area. "- -6- . . . .. (3) If wall signs, either boxed or separate letters, are placed in the space between - windows, the height of such signs may not exceed two-thirds of the distance between the top of a window and the sil I of the - window above, or major architectural de- tails related thereto. (4) If individual letters or a box graphic is placed between window spandrels, the height of the letters or box way not exceed two- thirds of the height of the spandrel. (5) AI I or a portion of the signable area may be contained in a roof sign. I f no wa I I sign is displayed, an industrial use may display roof signs no larger than the signable wal I area. ( 6) A wal I sign may not extend above the window sill of the second story unless the estab- I ishment to which it pertains is located above the first floor, in which case the display may extend as high as the sil I of the third story, but no higher. ~" (7) A wa II sign may be d i sp I ayed on the side or rear of a building adjacent to an off- street parking area if the off-street park- ing area is 40 feet or more in width. Where permitted and of the character al- lowed in SECTION 541.04, projecting signs may be displayed in accordance with the fol lowing regulations: ( I ) Any commercial or institutional use may dis- play one projecting sign on each street frontage. (2) Projecting signs shall be pinned away from the wal I at least 6 inches. (3) Projecting signs are not permitted at the intersection of corners, except at right ,.... angles to the bui Iding front. '- (5) No projecting sign may be displayed unless the bui Iding to which it is attached is 20 feet or more in width and no projecting sign may be closer than 50 feet to any other projecting signl unless one of the project- ing signs consist solely of a symbol. 54 I . 08 PERMITS. Prior to the erection of any sign other than tem- porary window signs and other signs as regulated in SECTIONS 541.02 (6) and 541.0241 a permit shal I be secured from the Administrative Officer. In applying for said permitl a scale drawing or drawings of the proposed sign and a plot plan show- ing its proposed location and the location of adjacent build- ings and signs previously erected under the provisions of these regulations shal I be submitted to the Administrative Officer. (2) Whenever the official making a reinspect ion ..~ finds a sign in need of repair, support re- placement: cleaning, repainting, or any maintenance service necessary to reasonable and proper appearance and/or public safety, .~ he sha I I issue an order to the owner of said sign al lowing thirty (30) days to effect needed repairs or maintenance. (3) Fai lure of an owner to comply with the pro- visionsof(2) above shall be cause for the inspecting official to order the permit is- sued for the sign void and issue an order for the sign to be removed with fifteen (15) days. SECTION 2. That Section 561.03 of Article V of Ordinance No. 21-70 be, and it hereby is, amended to add the fol lowing: (6) The Architectural Board may modify the location, height and area of all proposed signs within its area of juris- diction based on appl icabil ity of each sign to its loca- tion, type, style, color and such other factors as the Board deems appropriate, al J consistent with and appro- priate to the intent and purpose of the Board. - SECTION 3. Section Numbers 5802 and 5803 of Chapter 58 of the Frankl in '..... County Sui Iding Code adopted by and incorporated into Ordinance Number 01-54 of the Vi I lage of Dubl in, Ohio, be and they hereby are repealed. SECTION 4. That this Ordinance shal I take effect and be in force from and after the earliest period al lowed by law.
