11-61 Ordinance i ORDINANCE NO. 011-61 OF THE VILLAGE OF DUBLIN, OHIO. Ordinance accepting the bid of Suburban Hauling to furnish garbage and rubbish hauling to the inhabitants of the Village of Dublin, and declaring an emergency. r-r Be It Ordained by the Council of the Village of Dublin, Ohio, -.::> members present therein concurring: r --) SECTION 1. That the bid submitted by Suburban Hauling for furnishing rubbish and garbage collection in accordance with specifications contained in U the duly advertised legal notice be, and is hereby accepted as the lowest and best bid received therefor. SECTION 2. That the Clerk of the Village and the Mayor of the Village be, and are hereby authorized and directed to enter into a contract with Subur- ban Hauling in accordance with the terms of said bid, said contract to be from the period of the passing of this Ordinance to and including March 5, 1962, at a contractural price of $200.00 per month for garbage and refuse and trash hauling for all of the existing residences in the Village of Dublin at this tim and for an additional $1.25 per month for each dwelling built and occupied afte the time of the awarding of this contract. Said contract shall specify that the Village shall have the right to cancel said contract without liability on sixty (60) days written notice to the contractor of the cancellation of said contract. SECTION 3. That this Ordinance be and the same is declared to be an emer- gency measure necessary for the immediate preservation of the health, safety and general welfare of the inhabitants of the Village for the reason that said garbage'and collection hauling service is needed to provide trash and sanitary collection service for the Village, and that this Ordinance shall take effect and be in force immediately upon its passage. THE DUBLIN PLANNING COMMISSION, DUBLIN, I OHIO, JUNE 9, 1961 I . Sec. 1. WBLIN ENGINEERING DEPAR'IMENT: The Dublin Engineering Department is responsible for the de- sign, inspection, and enforcement of all street, storm drainage and other improvements as set forth in the following specifications . and regulations. .. . A. General: 1. The subdivider or developer of any road or street shall sub- - mit to the Dublin Planning Commission for their approval, a set of construction plans for the improvement of the road or street prepar- ed b.Y a registered professional engineer. A reasonable amount of 0 time must be allowed for approval of the plan prior to the beginning of construction. Construction shall not start until plans are fully approved. The construction plans shall include title of the plan, typical sections, plan and profile view, miscellaneous engineering details and estimate of quantities. Cross sections will be submitt- . ed upon request by the Dublin Engineer. All typical sections and .. major engineering details to be used on any particular road or street shall be approved in advance b.Y the Dublin Engineer or his representa- tive befor~ completion of the construction plans. . The engineering fees incurred in checking and approving the plans b.Y the Dublin Engineer shall be borne b.Y the subdivider or developer. When the subdivider or developer submits, for approval, a con- struction plan for street improvements for a part of a proposed sub- r;~ -.J - 1 - * Subdivision Regulation for Dublin, Ohio I 0 division area, preliminary street grades and proposed drainage facilities for the entire subdivision area shall also be presented. Where deemed desirable the Dublin Engineer or his representa- tive may require the construction or vacation of part or all of any intersecting roads or streets in order to assure that no hardships or . added expense be incurred by the abutting property owners, the town- ships or Village at some future date. - All materials and construction procedure shall be in accordance with the "General Provisions of Franklin County" (Ohio Revised Code) and current "Construction and Material Specifications" of the State of Ohio, Department of Highways, unless otherwise approved in ad- vance b.Y the Dublin Engineer or his representative. G a. Subdivider's Agreement, Performance Bond and Inspection Fee. Before any subdivision plat or construction plan is given final approval.. the subdivider or developer shall have executed a Subdi- vider's Agreement with the Village Council of Dublin acting through the Planning Commission as its agent. A Performance Bond for the . amount of the estimated construction cost and an inspection fee for . the amount of the estimated inspection cost shall be deposited with the Village Council before authorization of any construction. In , lieu of the Performance Bond a certified check in the amount of one- half of the estimated construction cost will be accepted. Upon final approval of the construction plan, three sets of prints will be re- quired for the use of the Dublin Planning Commission. a 2. Drawings: The construction drawings shall be made with India ink on linen - 2 - n or some other equally substantial and distinct mterial from which . clear and legible prints may be obtained. Freehand linear drawing must not be attempted, nor should other principles of good. survey- ing, engineering or draftnanship be offended. The sheets upon which . the construction drawings are mde shall measure 24" X 36". A poor- ly drawn or illegible plan is sufficient cause for rejection. . The original tracings of the plans shall become the property I of the Village of Dublin upon approval by the appropriate Village I officials, and shall remin in the custody of the Dublin Engineer. I 3. Title of the Plan: I I The title of the plan must contain the name of the subdivi- I 0 sion, road or street names, township, county, and location plat. I I I Space shall be provided on the title sheet or the first sheet of I the plan for approval by the proper authorities. I I 4. TYpical Sections: I . The typical sections shall meet the current requirements as set forth by the Dublin Engineer. The Dublin Engineer may require . that any typical section within the Village, which may be contigu- ous to a proposed section or existing section, within the corporate - limits of the Village, be of the same type and design as that of the Village. Curb and, gutter are required as part of any road or street con- struction. However the Village Council my, by appropriate action r', waive said requirements for curb and gutter or both, if said Village ~ Council deems it advisable so to do. - 3 - 5. Plan and Profile: fl The plan view shall be drawn to a scale of 111 = 50'; or I r I l . 1" :: 100'. The scale of 111 = 100' will be used only with the approv- al of the Dublin Engineer or his representative in advance of the plan preparation. The plan view shall show the proposed read, or street alignment, right-of-way and pavement widths, abutting lots, . centerlines, bearings, stationing, curve or radius data, existing and proposed drainage. Any other significant feature or factor, . shall also be shown on the plans. The centerline of read or street construction shall coincide with the centerline of the right- . of -way. Any changes from same shall be at the discretion of the Dublin Engineer or his representative. I The profile view shall have a horizontal scale of 1" = 50' or I I 0 1" · 100'; a vertical scale of 1" = 5' or 111 = 10'. The horizontal I scale of 1" I: 100' and vertical 1" :: 10' will be used only with the approval of the Dublin Engineer or his representative in advance of the plan preparation. The existing building line profile and exist- I ing and proposed centerline profiles, elevations, gradient, exist- . ing and proposed drainage lines and vertical curves shall be shown. I The ltBximum street gradient shall be 1'/0; the minimum street gradi- I , ent shall be O. 3~. Any change from same shall be with the approval of the Dublin Engineer or his representative. When establishing I road or street gradients, fullest consideration shall be given to the I abutting property. I I Vertical curves shall be used at all points on the gradient where the algrebra1c difference is l~ or greater. The minimum length ('\ of any vertical curve shall be 100 feet. ~ The minimum non-passing sight distance shall be 200 feet on I vertical curves. - 4 - B. Miscellaneous Engineering Details: f) 1. Drainage: . , I . The subdivider or developer shall provide the necessary means to assure complete drainage in and. adjacent to his property. ~n necessary, outlet ditches or closed sewers of an approved type and. size shall be required as part of the construction. If . same is across private property, rights-of-wy or easements must be obtained by the subdivider or developer for the construction and . future maintenance. These right-of-wy or easements shall be shown on the construction plans. The original of the above easement; after recording in the Franklin County Court House, shall be furnish- ed to the Dublin Engineer and two copies shall be furnished to the Village Clerk. G Any roadway ditch having a grade in excess of 2.0aj, shall have an approved type gutter using concrete" stone" sod or underground drainage with sufficient inlets spaced at intervals so as to keep the volume of wa ter at a low level. Where curb or curb and gutter type pavement is used, provisions - shall be made for adequate storm drainage lines and. inlets to insure . proper drainage of the pavement. All circular culverts or sewers shall be reinforced concrete pipe" or approved equal" with sealed joints having a diameter of not less than 12 inches. Where special drainage designs are necessary such as masonry or concrete structures, etc." such designs in detail must be submitted to the Dublin Planning Commission for approval in ad- vance of the completion of the construction plans. 0~ All trenches for water lines" sewers, utilities" etc." within ~ I - 5 - I the pavement or driveway areas, shall be backfilled with grits to a n point within a minimum of 6 inches of the Bubgrade and to a point .., 3 feet outside the pavement edge or 3 feet back of curb" if curb is used. Upon request by the Dublin Planning Commission, the subdivider or developer will submit a topographical plan of' any drainage im- . provement with all areas shown that are tributary to the improvement. , A mster storm sewer design plan showing proposed storm sewers . and intermediate tributary areas, together with design calculations listing tributary acreage, pipe size and grade, invert and surface elevations at structures, flow velocity and capacity, shall be sub- mitted to the Dublin Engineer for approval prior to completing the plans. r: 2. Intersections: W The minimum curve radius shall be 20 feet to face of curb. Without curb the minimum pavement radius shall be 30 feet to edge of pavement. An area of clear vision at street intersections shall - be provided. . 3. Dr i veYays: The maximum grade on driveways shall not exceed. 12%. Drive- Yay pipe shall be reinforced concrete pipe or approved equal with . a minimum diameter of 12" and a minimum length of 20 feet. 4. Sidewalks: Sidewalks are required and shall be composed of Portland It Cement Concrete with a minimum width of 4 feet, a minimum thickness of 4 inches, and shall conform to Item I - 13 of current "Construc- . tion and Material Specifications", State of Ohio, Department of - 6 - Highways. Inside edge of sidewalks will normlly be placed 7 feet (1 from the face of curb. Sidewalks will not be perm tted on any open I I t . ditch section. However, Village Council my, by appropriate action.. waive said requirements for sidewalks, if said Village Council deems it advisable so to do. 5. Guard Rail and Seeding, etc.: . The necessity of guard rail, seeding, type of backfill or other . ~ special conditions, shall be determined with the assistance of the Dublin Engineer or his representative before completion of the con- , struction plan. 6. Cul-de-sac: The paved area within the circular space at the termination n of the cul-de-sac shall have a minimum outside radius of 35 feet, to edge of pavement, or 38 feet to face of curb if curb is used. . 7. T-Turn-Arounds: The construction of T-Turn-Arounds shall be determined with the assistance of the Dublin Engineer or his representative. The - T-Turn-Around shall extend the entire width of the right-of-way . and shall have a minimum width of 20 feet along the property line with the flared portions rounded by minimum radii of 15 feet. C. Estimate of Quantities: An estimate of the quantities of all work specified or indi- cated on the construction plans shall be shown. r1 D. Mater1als and Construction Procedure: 1. Materials: ., Unless otherwise indicated on the plans, with advance - 7 - . I approval of the Dublin Engineer or his representative, mterials fl shall meet the requirement and shall be in accordance with the I I , I . "Material Details" of the current volume of the "Construction and I Material Specifications," State of Ohio, Department of Highways. I The I1Bterials will be referred to by mterial grade or section I I number of the same current volume. I . 2. Field Construction and Engineering: . . All items of work covered and stipulated in the construction . I plans, altered or extra work, shall be performed in accordance with I . the lines, grades, t.ypical cross sections and dimensions shown on I the construction plans. All streets shall be graded the full width of the right-of-way. The setting and mrking of all line, profile I and grade stakes necessary for the proper prosecution of work in I ('\~ ~ accordance with the construction plans will be performed, on~, by I an authorized Engineer or Surveyor. Should any misunderstanding I arise, as to the intent or meaning of the construction plans, or any discrepancy appear in same, or in the proper method of setting . and marking of the construction stakes, the decision of the Dublin I I < Engineer in such cases shall be final. r . . 3. Inspection: I I Inspection of the work shall be made by the Dublin Engineer I . I or his representative. Forty-eight (48) hours notice will be re- I I quired before any work or inspection takes place. Failure to com- I ply with the above may result in the rejection of the work and the I Failure to reject any defective work or material shall not I project. I I in any way prevent later rejection when such defects be discovered, I r or obligate the Vlllage of Dublin to final acceptance. I I - 8 - I ("\ II 4. Acceptance of the Work: " When the work has been completed" the Dublin Engineer or his representative shall be notified. The improvement will then be in- spected by the Dublin Engineer or his representative. If the work is found to be satisfactory, the Dublin Engineer · will make such recommendation to the Dublin Planning Commission, I · who in turn will recommend to council for final acceptance for .
