04-61 Ordinance ----- - t r#-- ~ -'~"~ ORDINANCE NO. 04-61, VILLAGE OF DUBLIN, OHIO. An Ordinance to provide for the collection of garbage, trash and rubbish. Be It Ordained by the Council of the Village of 'Dublin, Ohio, all six of the members elected herein concurring: r SECTION 1- That the Mayor of the Village of Dublin, Ohio, is hereb ( directed to enter into a contract with Ed Butterfield doing business as Subur ....... ban Hauling, for a period of three months beginning March 1, 1961, and that said contract provide that garbage and refuse and trash and rubbish and cinde s be colleqted by Suburban Hau!ing from the residences in the Village of Dublin, Ohio, on Tuesday of each week, said Suburban Hauling to be compensated at the rate of Two Hundred Dollars ($209.00) per month, payable monthly. Said gar- bage, refuse and trash to be removed by Suburban Hauling from any accessible location upon residential property on Tuesday of each week. If a legal holi- day falls on Tuesday of any week, then the trash and garbage collection may be made on Wednesday of that week. That the contract to be entered into shall be specific that the relationship between Ed Butterfield d/b/a Suburban Haulin Company and the Village of Dublin, Ohio, is that of a contracting relationship Ed Butterfield being an independent contractor for all of the services to be performed hereunder. It is specifically agreed and it is to be a part of the contract that the relationship of employer and employee shall not arise be- tween the Village of Dublin, Ohio, and Ed Butterfield. Said contract shall further provide that neither the Village nor its agents, officers or employees are to be held responsible for any negligence of Ed Butterfield or any of his agents or employees for any damage resulting from performance under this con- I tract. Said contract shall further provide that said Ed Butterfield shall I carry industrial compensation insurance of the state of Ohio, and shall ~arry social security taxes and unemployment compensation taxes and any other lawful taxes levied against him and shall have any trucking equipment or automobiles 0 used in said garbage and trash hauling collection business adequately protect- ed by public liability and property damage insurance in the amount of at least ~ , $50,000.00. SECTION 2. That this Ordinance be and the same is hereby declared to be an emergency measure necessary for public safety and health and general welfare of the Village of Dublin, Ohio, for the reason that the foregoing will I enable the Village to have its garbage and trash hauled away promptly and this I Ordinance shall take effect and be in force immediately upon passage. r I I President of Council Passed this 6th day of February, 1961.
