39-73 Ordinance - ... ~j. ,. f ,- ~ ORDINANCE NO. 31-73 , VILLAGE OF DUBLIN, OHIO AN ORDINANCE RELATING TO THE CONTROL OF DOGS AND OTHER ANIMALS WITHIN THE VILLAGE OF DUBLIN, OHIO BE IT BRDAINED by the Council of the Village of Dublin, State of t' ~, Ohio, (p of the members elected thereto concurring: t SECTION 1. ANIMALS OR FOWL RUNNING AT LARGE I (a) No person, being the owner or having charge of any animal I or fowl excepting homing pigeons bearing official bands, shall fail to prevent I such animal or fowl from running at large on any property not his own. I i I (b) No person, being the owner, keeper, harborer, or having Chargr of any dog shall permit such dog to enter upon any public or private i property other than that of said person unless such dog is securely leashed by a leash not to exceed six (6) feet in length, with the following exceptions: (1) On private property other than that of the owner, harborer, or keeper or person having charge of said ,I""" dog - with permission of the property owner. t (2 ) On public property. '~ In the case of both of the aforementioned exceptions, (1 and 2) the owner, keeper, harborer, or person having charge of such dog shall have such dog under "direct control. " When any dog is found on property not that of its owner, keepef'f harborer, or person having charge, or securely leashed, or under "direct control", such dog shall be subject to impoundment. (c) "Direct Control" shall mean that the dog is within sight and hear ing and will respond instantly to the minimum obedience commands of "come" and "sit" or "stay". It shall be prima facie evidence that a dog is ~ not under the required control if such dog chases, injures or kills any person . or domestic animal or damages or commits any nuisance upon property v ... other than its owner, keeper, or harborer. "Come If, the eommand, shall mean that the dog shall leave the position at which he is located and return to the handler when such command is given by said handler. "Sit" the , , I command, shall mean that the dog shall cease movement in any forward, backward, or sideways direction and shall assume a sitting position when such command is given by the handler. "Stay", the command, shall mean . " ~ - that the dog shall cease movement in any forward. backward. or sideways t direction and shall remain in the spot in which such command was heeded until he is released by the handler. SECTION 2. REGISTRATION OF DOGS; TAGS TO BE WORN. (a) No person shall be the owner. keeper or harborer or person - in charge of any dog over three months of age after January 20th of any ., I,~ ;1 year. or brought from outside the state at anytime during the year without ')., ........ first registering such dog as required by Chapter 955. Ohio Revised Code. (b) Failure to display the tag issued in connection with the registration required by Chapter 955. Ohio Revised Code. on a dog's collar. harness. leash or similar device shall be prima facie evidence of lack of registration and shall subject any dog not wearing such tag to impoundment. SECTION 3. RABIES IMMUNIZATION. No person shall own. keep. harbor or have charge of any dog over four (4) months of age unless such dog shall have been immunized against rabies as required by the regulations of the Franklin County Board of Health. -- Failure to have such dog immunized for rabies shall subject such dog to ""' impoundment and failure to display a current rabies immunization tag on a dog's collar. harness. leash or similar device shall be prima facie evidence of lack of rabies immunization. SECTION 4. PENALTIES. Whoever violates Sections 1. 2 or 3 of this ordinance shall be deemed guilty of a misdemeanor and fined not more than Fifty Dollars ($50.00) except no prosecution for a violation of Sections 2 or 3 hereof shall take place until at least three (3) days after the owner. keeper. harborer or person having charge of any dog has been notified in writing of an alleged violation and has failed to demonstrate compliance with said sections to the ~ t satisfaction of the Franklin County Animal Control Board. * , \- SECTION 5. That all ordinances or parts of ordinances inconsistent herewith be. and the same hereby are. repealed. SECTION 6.
