PROVIDING FOR THE SALE OF THE STREET UGHTING SYSTEM OF THE VILLAGE OF DUBLIN, FRANKLIN COUNTY, OHIO, ON CONDITION THAT THE PURCHASER MAINTAIN AND OPERATE A STREET LIGHTniG SYSTEM. WHEREAS, the Village of Dublin owns the street lighting system in said Village, and WHEREAS, said system is in need of repair, additional street lighting is needed and the Village does not have adequate funds with 'Which to properly repair and extend the street lighting system, and . WHEREAS, the Council of said Village deems it to be to the best interests of the Village to sell said system, NOW, THEREFORE,. BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF DUBLIN, OHIO: .. SECTION l. That certain fixtures and personal property belonging to the Village of Dublin is not needed by said Village for any municipal purposes, " said property being more particularly described as follovs: the street lighting system in said Village, including lights, poles, overhead wiring, controls and equipment pertaining to the operation of the present street lighting system, and any street lighting equipment or supplies now in stock. SECTION 2. That the Mayor and Clerk of said Village be" and they are here- by authorized, empowered and directed to sell said property to the highest bidder, after advertising according to lav, upon the following terms ~nd conditions: l. The purchaser agrees to operate a street lighting system for a period of ten years (10) from the date of the bill of sale, and in consideration thereof the purchaser shall have the right to charge and receive from the Village payment for said service in accordance with the following schedule of rates: Based on all night burning, 365 days per year, or approximately 4000 hours per year; lights energized by overhead distribution facilities. Overhead Lighting System 2500 Lumen, open fixture, on wood poles $30.00 per light per year 2500 Lumen, glass enclosed, on wood poles $35.00 per light per year 6000 Lumen, glass enclosed, on wood poles $46.00 per light per year. ., .... . . . . ,,' 2. Payment for the service furnished hereunder shall be made monthly by the Village in accordance with the bills rendered therefor by the pur- chaser at the end of each period, each payment to be due within fifteen days (15) of the submission of the bill therefor. Overdue payments to bear interest at the rate of 6% per annum until paid. Should the Village default in four successive payments, the purchaser may at any time dis- continue service hereunder without notice so long as any default exists; provided, however, that no charge shall be made by the purchaser for service hereunder during any period in which service is so discontinued. 3. The street lights to be operated and maintained hereunder shall initially consist of the following: . Overhead System 50 - 2500 Lumen Lamps, open fixtures 6 - 2500 Lumen Lamps, glass enclosed 10 - 6000 Lumen Lamps, glass enclosed. 4. The purchaser shall be obligated to the Village to make such addi- tions'and reasonable changes in and to said overhead lighting system as may be requested by the Village Council by resolution certified and forwarded to the purchaser; provided that no additional individual lights will be re- quired which will be located more than 300 feet from existing facilities. In no event shall the purchaser be required to install more than 20 addi- tional lights during the last five (5) years of the purchaser's agreement. " 5. The purchaser shall proceed promptly to make the new installations contemplated in order to provide the foregoing service, and to make such other changes; replacements and improvements as may be required to provide a system in good working order and condition. 6. This contract may be extended at its expiration date for another period of ten (10) years at current street lighting charges then being made available to other villages served by Columbus and Southern Ohio Electric Company . S~TION 3. That the Clerk be and he is hereby directed and authorized to advertise sale of said property in a newspaper of general circulation in the Village l of Dublin, Ohio. SECTION 4.
