I .. .2- , ORDINANCE NO. 3-54 FOR THE ZONING OF . f THE VILLAGE OF DUBLIN, 00 I An Ordinance providing for the zoning or districting of the ,_ _0 _ __ .'_ Village of Dublin, Ohio, and '. the regulation of the location, bulk, height I I and uses of premises and build~ngs and other.........stiJuctures and to repeal I Ordinance No. ,Zoning of the Village of Dublin, Ohio 0 d ~, WHEREAS, the Planning Commission of the Village of Dublin, Ohio, . r .......~ he re tofore ere a ted by Ord inance , duly passed by Council, has framed and . adopted a plan for dividing the Village into zones or districts, which plan represents the reco~~endations ,of said Commission in the in te re s t of the promotion of the pub lie health, safe ty, convenience, comfort, prosper- I I ity, and general welfare; for the limitation and regulation of the height, bulk location, perce nt age of lot occupancy, set back building lines, area and dimensions of yards, courts and other open spaces and the use of build- ings and other structures and of the premiseso.,in such zones or districts; . and WHEREAS, such Planning Commission has certified to the Council such plan for the districting or zoning of said Village according to use, height, bulk, location of b~ildings, pe rcentage of lot occupancy, set f""-r back building lines, area and dimensions of yards, U courts and other open space sand the use of buildings and other structure and of the premises within such zones or districts; NOW THEREFORE, be it ordained by the Council of the Village of Dublin,' Ohio, that: ARTICLE I. In the interest of the promotion of the public health, safe ty, I location of convenience, comfort, pro~perity and general welfare, the buildings and other structures and of premises to be used for trade, in- dustry, residence or other uses in the said Village shall be and hereby is regulated and restricted; the height of buildings and other structures hereafter erected or altered within the said Village, the percentage of let occupancy, set back building lines, and the area and dimensions of ;n yard s, c our t s , and other open spaces shall be and hereby are regulated , ~ and restricted; for carrying out the purpose of this Ordinance, said Village is hereby divided into districts; .for each of said districts, reg- ulations are hereby imposed designating the kinds or classes of trade, indus tr ie s, residences or other purposes or other uses for which buildings - ~ - 00 I I or other structures may be permitted io be erected or altered and for which premises may be used, subje ct to the rules and regulations here in- . after provided. I Section l. The Village of DUblin, Ohio, shall be and it hereby is - I divided i~to three districts, Re sidential, Commercial and Industrial. I I The Re s ident ia l;Pi strict (If Section 2. RESIDE~~IAL DISTRICT. shall be a dwelling house district and shall include all parts of said VillB ge I WI' I and all lots and lands lying the re in, not hereinafter specifically I I I described and de.signated as included within either the commercial ~ / I district or the industrial district. I Se c t ion 2. ( a ) In the Residential District one and two family dwell- ing houses only, with necessary outbuildings and fence s, shall be - '.-.- permitted to be erected; provided',--howe:ver," th'a:to:oany building here- . - tofore erected and now in use in such'district. for churches, schools, -, libraries or fraternal societies may continue in such use and further, that churches, mortuaries, public buildings, schools, pub lic librarie s, community center buildings, private clubs, public parks and ,play- ground s may be created and used within such residential district upon ~ the granting of special permission and approval by the Planning tW Commission. Section 2. (b) In the Residential District ~o building or other ~ structure shall be erected t6 a height of more than two and one-half , stories above the basement. Section 2. ( c ) After the date of this Ordinance the minimum size - lot shall contain not less than 20,000 square feet, exce pt th ose lots now on record in the Off i ce of the Recorder of Franklin County, Ohio. All future subdivisions or parcels of lots shall contain a minimum of 20,000 square fee t, and shall have a minimum width of ninety (90) fe e t , and be recorded in the Off ice of the Recorder of Franklin County, Ohio. No more than one building used for residential pur- ~ poses shall be erected on a lot. Section 20 (d) In the Residential District no building or other structure shall be erected or placed nearer than 25 feet to the fr on t lot line; provided, however, that if on any street, dwellings have , .. - 2 - - - - - . I been erected on at least 25% of the lots situated between two I adjacent streets, then the average distance between the front lot I line and the fronts of the dwellings already constructed within such I '. I area shall be the set-back line for such area. Section 2. (e ) In the Residential District, every building or - - I C structure erected or placed shall be erected or placed in such a manner that a side 'yard of not less than one-eighth of the total I I width of the lot shall be provided for and maintained on each side I I of such building or structure, provided that such side yard: be not I less than six feet in width on each side "of said building or struc- t ure . No additions in the nature of a porch, portico or other like construction shall be built into said side yard for more than one- half the required side yard space and in no case shall any such con- struction be placed in the side yard without the consent and approval of the Planning Commission having first been obtained for such con- struction and further provided that nothing herein contained shall prevent the construction of a driveway in the required s ide yard space. The provisions of this section may be modified by the Plann- C ing Commission in cases where the location of existing buildings on - adjacent lots render such modification~advisable for the carrying out of the purposes of this plan. Section 2. ( ft' In the Residential District no building shall be erected, or placed on a corner lot nearer than 10 feet to the side street line and no detached garage or othe r outbuilding shall be erected nearer than 20 feet from such side stre e t 1 i ne . Section 2. ( g) In the Residential District detached garages con- taining space for not to exceed two automobiles and other proper out~ buildings may be erected behind the dwelling house in such places as ma y be approved by the Planning Commissiono Garages for more than , two automobiles may be erected by special permit, provided that the . ~-.i O. yard space available is, in the judgme'ht::3"of the Planning Commission, suitable and sufficient for such purpose. Section 3. COMMERCIAL DISTRICT. I I I I Section 3. (c) In the Commercial District, retail store-rooms will . - I be permitted with residential quarters provided on the second floor I I I or upper floors. I Section 4. INDUSTRIAL DISTRICT. The Industrial District shall be . I a factory, warehouse and storage district and shall contain and in- I I c I ude that paet of the Village of Dublin bounded on the east by the ~ East Corporation Line of said Village, on the north by the southern boundary of Bridge Street; on the west by the West Bank of the Sciota I I I I River and on the south by the South Corporation Line of said Village. I I Section 4. (a) In the Industrial District, buildings and other I I I structures may be erected and the premises may be used for factories . and warehouses of a character that will not cause noxious odors or undue fire hazards and will not cause such noise, dust, smoke, or other thing to such an extent as to be a public nuisance, to endanger the public health, safety or general welfare or to cause unreason- able inconvenience or interference with the reasonable, quiet and peaceable possession, enjoyment and use of surrounding property. Pub lie garage s, laundries, milk-bottling plants, blacksmith shops, 0 ele ctric sub-stations, cold-storage plants and storage of coal, lumber and building materials shall be permitted. Any st,ructure or business of a character similar to those enumerated in th i s sec- tion may be permitted by special action and approval of the Planning Commission. Section 5. No buildings or other structures shall be erected, altered or maintained nor shall premises be used in any district for a kind or class of trade, indus try, residence or other purpose than as specifically herein permitted in such district by this Ordinance, and the height, bulk and location of buildings and other structures hereafter erected or altered, and the percentage of lot occupancy, the set-back building lines and the area and dimensions of yards, courts and other open spaces shall conform to the regulations herein fl contained. \~ Section 6. I provided by ordinance; refuse dumps, veterinary hospitals, scrap I iron or junk yards, or the storage of scrap iron or junk; I I reduction plants; manufacture of fert ilizer, acids, glue or C scrap; st ockyards; sand, s tone or gravel pits or quarries;, or any other purpose which may cause noxious odors, und ue fire hazards, or such noi se, dust, smoke or other thing as to be a public nuisance, to endanger the public health, safety or general we lfare, or to cause unreasonable inconve nience or in~ terference with the reasonable, quiet and peaceable possession, enjoyment and use of surrounding propertyo Section 70 Nothing herein contained shall preclude the use of property abutting on Bridge Street for school or cemetery pur- poses provided such property is now used for such purposes and such use remains continuouso ARTICLE 20 The details of the application of the provisions herein n set forth and the rules and regulations adopted by the Planning Com- mission as hereinafter provided shall be administed by the Planning Commission heretofore created and established by ordinance 0 ARTICLE 30 All meetings of said Planning Commission in such admin- - - - ~ istrative capacity shall be publico The Commission shall keep minutes of its administrative proceedings showing the vote on every questiono The Commission shall adopt from time tot ime 'such rules and regulati ons as may be necessary to carry into effect the provisions of this Ordin~ ance 0 The members of the Commission shall serve in such administrative capacity without compensation, but shall be entitled to any necessary expense incurred in the discharge of the ir du tie s 0 The Commission may employ a secretary who may, but need not be, a member of the Commission,p at such rate of compensation as may be fixed by Councilo C ARTICLE 40 This Ordinance shall be enforced by Inspector of Buildings under the direction of the Planning Commissiono ARTICLE 50 In the event any violation of this Ordinance sha 11 be c onnui t ted, the owner or owners of the building or premises, upon which = 7 = - ---- - - - - - - - ... ~ 1/ , ~ the violation has been committed~ any architect, builder or contractor I I who assists in the commission of such violation and any person, firm I or corporation ,who shall violate or assist in the violation of any of the I I provisions of this Ordinance or who fails to comply therewith or with I any requirement thereof, or who shall build in violation of any state- I I I ment or plan submitted and approved thereunder sha 11 , for each and n every vimlation or non~compliance be quilty of a misdemeanor and upon I -. conviction thereof shall be fined not less than $10000 nor more than $100000, and each day during which the violation or non-compliance .I I occurs shall constitute a separate offense 0 I I ARTICLE 60 The districts, building line s, parts, divisions, regulations, I I I provisions, conditions, limitations and restrictions established by or I I forming a part of this Ordinance are hereby declared to be inde pe nde n t I I of each other and the declaring or holding of any such district, build- I I ing line, part, division, regulation, provision, condition, limitation I I or restriction to be unconstitutional, void or ine ffe ct i ve in any I manner or for any reason, shall neither affect or render invalid any I I other district, building line, part, division, regulation, provision, I I C ond i t ion, limitation or restriction contained hereino I C I ARTICLE 70 Ordinance Noo of the Village of Dublin, Ohio, shall I be and the same hereby i~ repealedo ARTICLE 80 This Ordinance shall be in force and effect on and-after .
