01-54 Ordinances _. - . - 1 ORDINAI~TCE NO o 1-54 Building Regulations Of the Village of Dublins Ohio' An ORDINANCE providing for the regulation of building construction in order to promote the healthe safetys convenience and welfare of the citizens of the Village of Dublin Ohio ;~-;~ ;;- e: ~, ~,- ;; This Ordinance amends Ordinance No<. 2=•50, as followso BE IT ORDAINE- BY THE COUNCIL OF THE VILLAGE, OF DUBLINy STATE OF OHIO ARTICLE I~ Conformity required., No building or structure shall hereafter be constructeds altered9 re~•modeleds razed or removed ®.~~-- cept in conformity with the provisions of this code and any lawful rule of the building inspector made hereunder. ARTICLE TIo Occupancy Regulated, No buildings structure or• part thereof that has been erected or altered in violation of the pro visions of this code after its effective data may be maintained occupied or use d ARTICLE III, Building Inspector The building inspector hE~re,in~• after provided for shall be responsible for the administration of this ordinance o ARTICLE IV~ Building Inspection With the a,dvic;e^ approval and consent of Councils the D~ayor shall appoint as building inspector;, a suitably qualified person to make the inspections and issue the cc~r~ tifieates of compliance required by this code To be eligible $'or appointment such inspector shall be generally informed on the quality and strength of building materials,, on the prevailing methods of building canstruction9 on good practice in fire preventions and on the proper installation of plumbings electric wiring and other install~• ations for the safety„ comfort9 and convenience of occupants He shall not have any interest whatever directly or indirectly„ in the maizufac•= tuts or sale of any materials process or device entering into or used in connection with building construction, Assistants and deputy build~• ing inspectors may be employed from time to time and shall be paid such compensation as is authorized by Council ARTICLE V~ Duties of the Building Inspector The building in~• specter shall receive the application required by this code, issue per=• ~- 2 - , mite anal issue the prescribed certificates He shall enfar•ce all laws rolating to the constructions alteratian9 removals demolition,, use and occupancyy location and maintenance of buildings and structures„ sewer installations, with right of appeal to Village Council by any aggrieved person within 30 daysp except as otherwise provided by law<, He shall have authority to issue notices requiring compliance with the pro-~ visions of this code; and he sha11 notify the Mayer and Village Solid= for of any failure to comply with sucYi vatices so that appropriate legal action may be taken to secure compliance, The building inspectar shall examine all premises for which permits have been issued, make inspec~• tions to see that the provisions of law are complied with and that con- struction or razing is carried on safely;, and make a full report of his activities to the Village Council each month at its regular monthly meetingo The building inspector shall also assign to each residence a street number which shall conform to existing stye®#', number^s~, and Hate said number upon the building permit and certificate of occupancy issued for such bui.lding~ AR'T'ICLE VIo Right of Entry The building inspector in the die-~ charge of his duties shall have the autharity to enter any building structure or premises at any reasonable hour„ It shall b® a misde~• meanor to obstruct or hinder him in the rischarge of his duties ARTICLE VIIo Personal Nan-Liability<> No officer charged with the enforcement of this Ordinance acting in tho discharge of his duties shall be liable personally and he is hereby relieved from all personal liability for any damage that may accrue to persons or property as the result of any a.ct permitted in the discharge of his duties, Any suit brought against any officer or employee because of any act performed by him in the enforcement of any provision of this Ordinance shall be defended by the Village Solicitor,.. AR`T'ICLE VIIIo A~lication for Permit, E3efore any building or structure or any piping or wiring, therein or. sewer connection is con- structed9 rnade9 alteredv removed,, or demolished an application. shall be made in writing to the building inspector by the owner;, or a duly authorized agentp and a permit secured, Such application shall be in such form as the building inspector may prescribe and shall be acc~om- ~- 3 parried by such scale planes specifications plate and drawings as may be required by him ARTTCLE IX~ Insurance of Permito Tf after examination of the applications the 'auilding inspector shall determine that the proposed work is prima facie in compliance with the provisions of this code and other ordinances of the Villages he shall cause a permit to be issued Applications not in accordance herewith shall be rejected and returned to the applicant ARTICLE ~~, Amendment of Permit Ifp during the prosecution of work under a permits it shall be necessary to make any changes in the plans;; or contracts the permit holder shall notify the 'ouildin~; inspec® for irz writing of the proposed changes If approveds the changes shall. be added to the original permit filep and if the cost of the work is thereby increased so much as to require a higher permit fee, such additional sum shall be collected in accordance with the schedule here inafter set forth.., ARTICLE XIS Permit for Removal„ No permit to remove or raze a building or structure shall be granted until notice of the application therefor shall have been given to the owners of lots adjoining the .lot upon which said building or structure is located and to which the bu.ild~- ing or structure is to be moved ~ and the owners of wire s or other im~~ pediments tho removal of which will be necessar~r; and an opportunity has "seen given such owners to be beards before the building inspector; nor until a bond in the penal sum of not less than fifty X50) dollars nor more than five hundred (500) dollar s as fixed by the Mayors shall have been filed with the Village Treasurer to indemnify the municipality for damage AR`T'ICLE XII„ Condition. of Permito A11 work done under a buiT.d~.ng permit shall conform to the approved application and plans and specif~ ications and approved amendments thereto and to all provisions of this code and other ordinances of the Village applicable thereto A copy of the permit shall be kept on the premises open to public inspection during, the prosecution of the work The building inspector shall be given at least twelve X12) hours p notice of the starting of vaork under a permito A permit under which not work i_s commenced with six Mfr ~., ~ months after its issuance shall be voido ARTICLE XIIIo Revocation of Fermito The building inspector may revoke a permit issued under the provisions of this code in case there has been any false statement or misrepresentation as to a material fact in the application or plans and specifications on which this permit was basedb or any wilful disregard of the conditions of the permit,> AR'T'ICLE XTVQ Certificate of Occupancy and Compliance „ No person. shall occupy or permit the use of any building or structure or part thereof hereafter erected altered or changed in use or construction until a certificate of occupancy and compliance has been secured from the building inspector stating that the building or premises comply with all the provisions of this code and the other ordinances of the Villag®9 provided that nothing in this section shall prevent the con tinuance of any occupancy or use existing at the time of adoption of this code~> ARTICLE XV., Book of ~~egulationsu "Code Book of Building I~egu~=~ lations of the County of Franklin'" will be used to govern construction in the Village of Dublin,. References to the tYCounty of ~'ranklin'~, "County Commissioners"}, etc<~ i.s hereby amended to read "Village of Dublin"~ Village Council~P„ etc o ARTICLE XVI~ Fees Fifty (50) percent of all fees collected for building permits will be retained by the building inspector as pay merit for his services, ARTICLE XVIT~ Violations A person9 firm or corporation who shall violate a provision of this ordinance or fail to comply th®ra~ with or who shall violate or fail to comply with any order or regulation made thereunder, or who shall build in violation of a building permit or certificate issued by the building inspector, shall severally fcr each and every such violation and noncompliance ~be ga.i:.ty of a misu demeanor and upon conviction thereof be fined not less than ten (1.0~ dollars and not mor® than one hundred (100) dollars and each day;, after the first convictionb during which such. violation or non~compli~- ance shall continue shall constitute a separate offense:, The compo~~ sition of a penalty for the violation of this ordinance shall not exJ cuss the violation or permit it to continue<, The application of the ~, 5 ~_~ above penalty shall not be held to prevent the enforced removal of prohibited conditions AR'T'ICLE XVIII~ Validity, If any section or part of section or paragraph of this ordinance shall be declared invalid or unconstitum tionala it shall not be held to invalidate the validity force or effect of any other sections or part of a section or paragraph of this ordinance ARTICLE XIXa Date of Effect This ordinance shall take eff®et and be in force on and after the earliest p©riod allowed by law, . 1 R2ayo ,. ~r; 1~ttest ~ ~- C le rk Passed Tviay 3, 1954
