A RESOLUTION ACCEPTING THE LOWEST AND
BEST BID FOR THE 2010 SIDEWALK
MAINTENANCE PROGRAM
WHEREAS, formal advertising and competitive bidding procedures have been
conducted, pursuant to Section 8.04 of the Dublin Charter and Chapter 37 of the
Dublin Code, for the 2010 Sidewalk Maintenance Program; and
WHEREAS, Council has determined that the bid submitted by Newcomer Concrete
Services, Inc. in the total amount of $99,421.19 constitutes the lowest and best bid;
and
WHEREAS, Council has determined that there may be a legitimate need to declare
the relocation of the utilities in connection with the above - referenced project as a
"single source" procurement, for reason that the company owning the utilities in
question has the exclusive rights to relocate such utilities.
NOyV, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin,
of its elected members concurring, that:
Section 1. The bid submitted by Newcomer Concrete Services, Inc. in the total
amount of $99,421.19 is hereby accepted.
Section 2 . That the City Manager is hereby authorized to enter into contracts with
Newcomer Concrete Services, Inc. for performance and completion of the 2010
Sidewalk Maintenance Program pursuant to the Advertisement, Proposal and
Contract Documents for said project on file in the office of the City Engineer.
Section 3. That this Resolution shall take effect and be in force on the earliest date
permitted by law.

Re: Resolution No. 21-10— Bid Acceptance for 2010 Sidewalk Maintenance Program
Summary
On February 25, 2010 nine (9) bids were received and publicly opened and read for the 2010
Sidewalk Maintenance Program. Staff has reviewed all bids. The Engineer's estimate was
$115,000. Newcomer Concrete Services, Inc. submitted the lowest and best bid of $99,421.19.
A summary of the bids is listed below.
For Council reference and review, the contract documents have been placed in the Council
Planning Room.
Newcomer Concrete Services, Inc. submitted the lowest and also best bid of $99,421.19. In
consultation with our legal staff, the bid submitted by Fussner Builder, LLC of Ashland, Ohio
has been rejected. Fussner Builders' experience statement does not contain experience on
municipal concrete sidewalk repair, curb and gutter, driveway and especially none of similar
scope or complexity of concrete work required.
Staff has thoroughly reviewed the Newcomer Concrete Services, Inc. Previous experience with
Newcomer Concrete Services, Inc. has been favorable, including these recent projects where
they were sub - contractors: 2009 Street Maintenance Program; Avery Road Widening (Irelan
Place to Shier -Rings Road); and Post Road/Commerce Parkway Intersection Improvements.
The 2010 Sidewalk Maintenance Program will include sidewalk repairs in the following
subdivisions: Wellington Place, Sheffield Place, Brandon, Lowell Trace, Wexford Estates, and
Llewellyn Farms.

The majority of the sidewalk repair locations are caused by tree roots heaving the sidewalks. As
a part of the repair process, these roots will be pruned and removed. A few trees that have larger
roots removed in the sidewalk repair process will also have their canopies thinned and trimmed
by forestry staff from the Parks Division. Engineering works closely with the forestry staff on
the sidewalk repair process to ensure impact to trees will be minimized where feasible.
Recommendation
Staff recommends approval of Resolution 21 -10 accepting the bid of Newcomer Concrete
Services, Inc. and authorizing the City Manager to enter into a contract with Newcomer Concrete
Services, Inc for this project.
