MANAGER TO
EXECUTE NECESSARY CONVEYANCE DOCUMENTATION
TO ACCEPT THE DEDICATION OF A 0.006 ACRES, MORE
OR LESS, PERMANENT BIKEPATH EASEMENT AND A 0.054
ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION
EASEMENT FROM PIZZUTI LAND LLC.
WHEREAS, the City of Dublin desires to construct a bike path that will encircle the
right of way of Metro Place (North and South); and
WHEREAS, said construction shall require the City of Dublin to obtain a 0.006 acres,
more or less, permanent bikepath easement and a 0.054 acres, more or less, temporary
construction easement in and to the premises described in the attached Exhibit "A" and
Exhibit "B" from Pizzuti Land LLC; and
WHEREAS, the City desires to execute any necessary conveyance documentation to
obtain these property interests.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, -q_ of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute all necessary
conveyance documentation to accept the dedication of a 0.006 acres, more or less,
permanent bikepath easement and a 0.054 acres, more or less, temporary construction
easement in and to the premises described in the attached Exhibit "A" and Exhibit 'B"
from Pizzuti Land LLC.
Section 2 . This Ordinance shall take effect and be in force on the earliest date
permitted by law.

across the lands of
PIZZUTI LAND LLC
Situate in the State of Ohio, County of Franklin, and City of Dublin, being a part
of Virginia Military Survey Number 2419, being a part of the 6.344 acres described as
part of Lot 4 of METROCENTER as the same is delineated in Plat Book 55, Pages 8 and
9, this reference being to the records of the Recorder's Office, Franklin County, Ohio,
and conveyed to Pi=uti Land Company LLC (Grantor), of record in Instrument Number
200008030154486, now known as PIZZUTI LAND LLC, as amended by the Ohio
Secretary of State in document 200018002899, said 0.006 acres permanent easement
parcel for bike path purposes being more particularly described as follows:
Beginning at an iron pin called and found at the Point of Curvature in the easterly
right of way line of Metro Place South at a point 30.00 feet right of Centerline Station
28 +41.44;
thence, North 59 16' 06" West, crossing Metro Place South at a right angle, a
distance of 60.00 feet to an iron pin called and not found at the Point of Curvature in the
westerly right of way line of said Metro Place South;
thence, South 03 50' 13" West, a chord distance of 434.25 feet to the northeast
comer of the said 6.344 acres parcel of the said PIZZUTI LAND LLC, and the true point
of beginning of the 0.006 acres bike path permanent easement parcel being described;
thence, 100.00 feet southeasterly with the said Metro Place South southwesterly
right of way line on a curve to the left, whose radius is 479.99 feet, whose central angle is
11 56' 13" and whose chord bears South 29 01' 34" East a chord distance of 99.82 feet
to point at the northwesterly comer of 565 Metro LLC, 5.750 acres parcel, of record in
Instrument Number 200707090119753 and the Grantor's southeasterly comer;
thence, South 55 00' 17" West, with the said PIZZUTI LAND LLC,
southeasterly line and the said 565 Metro LLC northwesterly line, a distance of 2.80 feet
to a point;
thence, 100.02 feet northwesterly leaving said 565 Metro LLC northwesterly line
and crossing the Grantor's lands on a curve to the right, whose radius is 482.88 feet,
whose central angle is 11 52' 03" and whose chord bears North 29 03' 35" West a
chord distance of 99.84 feet to a point in the southeasterly line of Metrocenter Office
Investment, LLC, etal., of record in Instrument Number 200709170163689 and the
Grantor's northwesterly line;
thence, North 55 32' 08" East, with the said Metrocenter Office Investment, LLC
etal., southeasterly line and the Grantor's northwesterly line, a distance of 2.86 feet to the
true point of beginning of the bike path permanent casement parcel being described.
The parcel, as described above, contains 0.006 acres, more or less.
The basis of bearing is NAD83 (1986) using Franklin County Engineer
Monuments and in Ohio State Plane Coordinates, South Zone (3402). This description
is prepared from a field survey conducted by URS, Inc. in October, 2007, under my direct
supervision.
A plat of this description is attached to this document as Exhibit A and made a

a distance of 60.00 feet to an iron pin called and not found at the Point of Curvature in the
westerly right of way line of said Metro Place South; thence, a chord bearing South
03'50'13" West a chord distance of 43425 feet to the northeast comer of the said 6.344
acres parcel of the said PIZZUTI LAND LLC and the southeast comer of Metrocenter
Office Investment, LLC, etal., of record in Instrument Number 200709170163689;
thence, South 55 00' 17" West a distance of 2.80 feet along a common line to the true
point of beginning of the 0.054 acres bike path temporary easement parcel being
described;
thence, southwesterly with the said common line South 55 00' 17" West a
distance of 7.20 feet to a point;
thence, southwesterly with the said common line South 71° 37' 36" West a
distance of 9.89 feet to a point;
thence, leaving said common line and through said Grantor's property the
following four (4) courses:
I) North 72 12' 26" West a distance of 19.74 feet to a point;
2) North 27 4 P 34" West a distance of 52.41 feet to a point;
3) North 02 34' 53" East a distance of 31.17 feet to a point;
4) North 19 14' 14" West a distance of 4.33 feet to a point on the south line of

and said Grantor's north line;
thence, northeasterly with the said Metrocenter Associates south line and said
Grantor's north line North 55 32' 08" East a distance of 12.09 feet to a point;
thence, southeasterly leaving said common line 100.02 feet on the arc of a curve
to the left, whose radius is 482.89 feet, whose central angle is 11 52' 02" and whose
chord bears South 29° 03' 35" East a chord distance of 99.84 feet to the true point of
beginning of the temporary easement parcel being described. The parcel, as described
