41-09 ResolutionRECORD OF RESOLUTIONS Dayton Legal Blank, Inc., Form No. 30045 41-09 ResnlartionNo. Passed , 20 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO ANY REQUIRED APPLICATIONS AND AGREEMENTS WITH THE OHIO ENVIRONMENTAL PROTECTION AGENCY (OEPA) IN ORDER TO ACCEPT FUNDS FROM THE AMERICAN RECOVERY AND REINVESTMENT ACT (ARRA) FUNDS DESIGNATED FOR 2010 SANITARY SEWER RELINING PROJECT WHEREAS, the City of Dublin wishes to rehabilitate and maintain its sanitary sewer collection system; and WHEREAS, the 36-inch trunk sewer along Dublin Road is a vital component of the collection system; and WHEREAS, the Dublin Community Plan promotes seeking alternative sources of funding for capital improvements; and WHEREAS, the Ohio Environmental Protection Agency (OEPA) has elected to use a portion of its allocation from the American Recovery and Reinvestment Act (ARRA) to partially fiord the 2010 Sanitary Sewer Relining Project; and WHEREAS, it is necessary to execute applications and agreements with OEPA to accept certain conditions in order to receive $425,000 in ARRA fiords. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring: Section 1. The City Manager is hereby authorized to enter into any required applications and agreements with the Ohio Environmental Protection Agency (OEPA) in order to accept funds from the American Recovery and Reinvestment Act (ARRA) funds designated for 2010 Sanitary Sewer Relining Project. Cox, P.E., Engineering Manager -Development Memo Date: September 3, 2009 Re: Resolution 41-09 -Authorizing the City Manager to Accept Funds from the American Recovery and Reinvestment Act (ARRA) Funds for the 2010 Sanitary Sewer Relining Project. Summary The Ohio Environmental Protection Agency (OEPA) has received an allocation of American Recovery and Reinvestment Act (ARRA) funds to provide assistance for wastewater improvement projects. The OEPA is using its Water Pollution Control Loan Fund (WPCLF) program to administer its ARRA wastewater allocations. Earlier this year, the OEPA issued a request for applications for these funds. In April of 2009, staff submitted three applications for possible funding through this source. The projects were: a 2010 Sanitary Sewer Lining Project (cost $850,000), COIC Sanitary Sewer Phase 1 (cost $690,000) and COIC Sanitary Sewer Phase 2 (cost $332,000). The OEPA awarded ARRA funds for the 2010 Sanitary Sewer Lining project. Also, the OEPA has chosen to use the ARRA money to supplement the WPCLF loan funding it typically administers. Dublin has been selected by the OEPA to receive $425,000 in ARRA funds and is eligible to receive the other $425,000 through the WPCLF program. Staff recommends that the City enter into any required applications and agreements with the OEPA to receive the ARRA funds for this project. Based on the interest rate of the loan available through the WPCLF, staff has determined that the City can obtain a lower rate through its own financing. The remaining funds needed for this project will be obtained from issuing debt to be repaid by the sewer fund revenues. The 2010 Sanitary Sewer Lining Project will install acured-in-place liner in approximately 8,340 linear feet of 36-inch sanitary sewer. This section of sewer work will begin in Historic Dublin and go north into the Donegal Cliffs subdivision. The concrete trunk sewer condition has deteriorated and is in need of repair. The lining should extend the life of the trunk sewer approximately 30-50 years. The 2010 Sewer Lining project was year three of the current contract with Reynolds Inliner. The OEPA is requiring that the work be re-bid so that the contract can include the requirements of the ARRA. Reynolds Inliner has agreed to non-perform this work in their current contract, as staff has developed a list of other sewers that need lining which is of the same cost value. Vlemo re. This will allow the bid to be reviewed by the OEPA and place the award of the funding on the WPCLF Board's agenda in November. Recommendation Staff recommends approval of Resolution 41-09 authorizing acceptance of the ARRA Funds for the 2010 Sanitary Sewer Project.
