Form No- 30045 35-09 Passed . 20 A RESOLUTION ACCEPTING THE LOWEST AND BEST BID FOR THE AVERY-MUIRFIELD DRIVE OVER U.S. 33 BARRIER IMPROVEMENTS PROJECT WHEREAS, formal advertising and competitive bidding procedures have been conducted, pursuant to Section 8.04 of the Dublin Charter and Chapter 37 of the Dublin Code, for the Avery-Muirfield Drive over U.S. 33 Barrier Improvements Project; and WHEREAS, Council has determined that the bid submitted by the Righter Company constitutes the lowest and best bid; and WHEREAS, Council has determined that there may be a legitimate need to declare the relocation of the utilities in connection with the above-referenced project as a "single source" procurement, for reason that the company owning the utilities in question has the exclusive rights to relocate such utilities. NOW, THEREF E, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That the bid submitted by the Righter Company in the total amount of $694,299.50 is hereby accepted. Section 2. That the City Manager is hereby authorized to enter into contracts with the Righter Company for performance and completion of the Avery-Muirfield Drive Over U.S. 33 Barrier Improvements Project pursuant to the Advertisement, Proposal and Contract Documents for said project on file in the office of the City Engineer. Section 3. That this Resolution shall take effect and be in force on the earliest date permitted by law. Richardson, P.E., Engineering Manager -Design Date: July 30, 2009 Re: Resolution 35-09 -Avery-Muirfield Drive over U.S. 33 Barrier Improvements Project Summary On July 27, 2009, three (3) bids were received, publicly opened and read for the Avery-Muirfield Drive over U.S. 33 Barrier Improvements Project. Staff has reviewed all bids. The Engineer's estimate was $730,000. Funding for this project is provided through the annual Capital Improvement tax fund. The Righter Company submitted the lowest and best bid of $694,299.50. At that time, the City received only one (1) bid for this project in the amount of $756,176.00. As a result, it was decided by staff to reject the one bid as staff could not verify that the City had received the lowest and best bid. The City Manager reported this action to City Council at the July 1, 2009 meeting. Subsequently the project was re-advertised for bid, with bids being opened on July 27, 2009. This project will provide steel-backed timber guardrail behind the bikepaths along the east and west sides ofAvery-Muirfield Drive, north and south of the Avery-Muirfield Drive bridge over U.S. 33, with connections to rebuilt concrete bridge parapet walls. The existing stone walls located at the corners of the U.S. 33 ramps will be reconstructed with curvature following the roadway radii to allow for proper connection of the guardrail ends. The guardrail extending from the stone walls east along the ramps will be deep-beam steel guardrail. All the newly installed guardrail, whether timber or steel, will be painted a wolf grey color. The Ohio Department of Transportation (ODOT) has thoroughly reviewed these improvements and approved them through the issuance of alimited-access right-of--way permit. At least one bikepath along Avery-Muirfield Drive in the project area will be open at all times during construction. Traffic on Avery-Muirfield Drive will be maintained during construction. Res. 35-09 -Avery-Muirfield-US 33 Barrier Improvements Project July 30, 2009 Page 2 However, between the times of 8:30 a.m. and 4:00 p.m. on weekdays, one lane of traffic on Avery-Muirfield Drive in the project area maybe closed. All U.S. 33 ramps will remain open to traffic with no intended closure throughout the project duration. The project completion date is November 20, 2009. A general location exhibit is attached for reference. Additionally, a copy of the Avery-Muirfield Drive over U.S. 33 Barrier Improvements Project construction drawings has been placed in the Council conference room for your reference and review. Staff has thoroughly reviewed the Righter Company bid and has found it to be complete. Previous City experience with the Righter Company has been favorable, including the 2004 Clover Court Channel Improvements project. Recommendation Staff recommends Council approval of Resolution 35-09 accepting the bid of the Righter Company in the amount of 5694,299.50 as the lowest and best bid and authorizing the City Manager to enter into a contract with the Righter Company.
