A RESOLUTION ACCEPTING THE LOWEST AND BEST
BID FOR THE EMERALD PARKWAY/ INNOVATION
DRIVE INTERSECTION MPROVEMENTS PROJECT

WHEREAS, formal advertising and competitive bidding procedures have been
conducted, pursuant to Section 8.04 of the Dublin Charter and Chapter 37 of
the Dublin Code for the Emerald Parkway/Innovation Drive Intersection
Improvements Project; and
WHEREAS, Council has determined that bid submitted by Decker
Construction Company constitutes the lowest and best bid; and
WHEREAS, Council has determined that there may be a legitimate need to
declare the relocation of the utilities in connection with the above-referenced
project as a "single source" procurement, for reason that the company owning
the utilities in question has the exclusive rights to relocate such utilities.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin,
State of Ohio, ~ of the elected members concurring:
Section 1. That the bid submitted by Decker Construction Company in the
total amount of $361,122.30 is hereby accepted.
Section 2. That the City Manager is hereby authorized to enter into
contracts with Decker Construction Company for performance and completion
of the Emerald Parkway/Innovation Drive Intersection Improvements Project
pursuant to the Advertisement, Proposal and Contract Documents for said
project on file in the office of the City Engineer.
Section 3. That this Resolution shall take effect and be in force on the
earliest date permitted by law.

Improvements Project
Summary
On July 21, 2009 five (5) bids were received, publicly opened and read for the Emerald Parkway/
Innovation Drive Intersection Improvements Project. Staff has reviewed all bids. The Engineer's
estimate was $475,000. Funding for this project is through the established Thomas-Kohler tax-
increment financing (TIF) district fund. Decker Construction Company submitted the lowest and
best bid of $361,122.30. The bids are listed below:

This project will provide a traffic signal at the intersection of Emerald Parkway and Innovation
Drive, with a dedicated left turn lane for southbound Emerald Parkway vehicles turning into the IGS
property. The completion date for the signal is January 15, 2010, with an interim completion date for
the left turn lane and sidewalk improvements of October 30, 2009.
A copy of the Emerald Parkway/Innovation Drive Intersection Improvements Project construction
drawings has been placed in the Council Conference Room for your reference and review.
Staff has thoroughly reviewed Decker Construction Company's bid. Previous experience with
Decker Construction Company has been favorable, including their recent work as a major sub-
contractorperforming concrete work on the 2009 Street Maintenance Program.
Recommendation
Staff recommends approval of Resolution 34-09 accepting the bid of Decker Construction Company
in the amount of $361,122.30 as the lowest and best bid, and authorizing the City Manager to enter
into a contract with Decker Construction Company.
