09-87 ResolutionRECORD OF RESOLUTIONS National Graphics Corp., Cols., O. ^x~' ^gfa~jl'GS Form No. 6233-A 09-87 P~tsserl ----------------------------------------------19-------- A RESOLUTION ESTABLISHING A COMMUNITY REINVESTMENT AREA WITHIN "d'HE VILLAGE, OF DUBLIN WHEREAS, the Ohio Revised Code empowers municipal corporations to designate areas as community reinvestment areas; and WHEREAS, it is in the best interests of the citizens of Dublin to designate an area known as Post Road Community Reinvestment Area , and more fully described in the document entitled "Boundaries of Community Reinvestment Area" which is attached hereto and incorporated herein as Exhibit "A" as a community reinvestment area; and WHEREAS, the above-referenced area includes housing facilities or structures of historical significance and new housing or repair of existing facilities is discouraged; and WHEREAS, Council has previously caused to be conducted various surveys of this and other areas of the Village including but not limited to traffic and master planning studies; NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Dublin, State of Ohio, 6 of its elected members concurring that: Section 1. Council hereby designates the above referenced area as a Community Reinvestment Area. Section 2. Village Manager or designee is hereby designated to serve as the "Housing Officer" as required by law. Box 7 Hilliard OH 43026 Hand Deliver Dear Mr. Banchefsky: RE: Dublin Local Schools Tax Abatement +ALSO ADMITTED DISTRICT' OF COLU6lBIA BAR 'ALSO ADMITTED FLORIDA SAR ROBERT E TEAPOAD COUNSEL Pursuant to our telephone conference of May 12, 1987, we are sending you this letter. At that time, we explained that the Board of Education was desirous of obtaining something in return for our agreeing to support fully the five year 50% real property tax abatement on the new building to be constructed by White Consolidated Industries, off Post Road. If the building is valued as indicated by Mayor Close, we would lose about $75,000 a year in real property taxes, or over the five year period, $375,000. If the payroll is as high as indicated by the Mayor, you will have a substantial windfall, while we would be losing the aforementioned amount of money. Therefore, we suggested to the Mayor that we wanted some agreement to, in some manner, have the Village share with the Board of Education during that five year period some of the benefits that the Village receives in payroll tax, in return for our working with the Council to support this abatement. No matter how well intentioned our abatement may be, there are always elements in the community who will perceive this in a negative fashion. Thus, we feel it is important to show that both our clients are working together for the betterment of Dublin. This type of sharing agreement will clearly show that the community and its facilities will not suffer from the abatement, but, rather, will be enhanced because of our efforts Therefore, we have developed the following proposal. FVe understand that at the Village Council Meeting on May 18, 1987, legislation will be proposed to create a Community Reinvestment District which would include this White Consolidated site, and Mitchell Banchefsky, Esq. May 13, 1987 Page 2 several adjoining homes, which would allow within that district certain areas, i.e. the White Consolidated property, to have its new improvements abated at 50% of the real estate tax for five years. We suggest that you add to that legislation the following paragraph: '~ "Consistent with the powers granted to the Village in Article u Section 2.04(A), and Article VII, Section 7.03(A), of the Charter of the Village of Dublin, and Ohio Revised Code 5755.16, the Village hereby sets aside 37 1/2 percent of all Village income tax receipts from employees working within this Community Reinvestment District during any abatement period granted hereunder to be used in conjunction with the Dublin Local Schools for the joint acquisition, development, management, and operation of parks, playgrounds, gymnasiums, swimming pools, indoor recreational centers, or other public purpose facilities as allowed by law." We hope that you will distribute this letter to the members of the Village Council as soon as possible in order to determine whether or not they are willing to add this to the legislation. As indicated, we intend to keep this proposal confidential until the Council has had time to review same. We feel that this would be a positive step forward in community acceptance of the abatement-program and look forward to your early reply. - ~3dffcev A.
