THOMAS ESTATE AND BORDERED ON THE WEST BY THE SCIOTO RIVER, ON THE SOUTH BY INTERSTATE 270, ON THE EAST BY STATE ROUTE 257, AND ON THE NORTH BY PROPERTY OWNED BY CHARLES T. AND KATHY L. CARMICHAEL, TO BE A NUISANCE AND DIRECTING THE LAW DIRECTOR TO ABATE THE SAME AND DECLARING AN EMERGENCY. --------..19 WHEREAS, that certain 5.5 acre landfill located off State Route 257 in the Village of Dublin is operating in violation of Dublin Code Chapter 1313; and WHEREAS, the property owner has failed to comply with the terms of a Land- fill Plan Agreement between said owner and the Village of Dublin, pursuant to the issuance of a Flood Damage Prevention Development Permit; and WHEREAS, said permit expired on January 17, 1986; and WHEREAS, the owner continues to utilize said site as a landfill or allow said property to be used as a landfill without a Flood Damage Prevention Permit, in violation of Dublin Code Chapter 1313; and WHEREAS, the Village of Dublin has contacted the owner and his counsel on numerous occasions in an effort to resolve these issues; and WHEREAS, the owner is unwilling to compJ.y with the terms of the above referenced Landfill Plan and continues to utilize or allow said property to be utilized as a landfill; NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Dublin, Ohio, ~_ of the elected members concurring; that Section 1. The said 5.5 acre Landfill site, bordering State Route 257 (also known as Riverside Drive), due to the owner's failure to comply with the Landfill Plan Agreement and the owner's continued use and operation of the site as a landfill in violation of Dublin Code Chapter 1313, be and hereby is declared to be a public nuisance. Section 2. That the property owner, the Estate of John I. Thomas, shall be served with a copy of this Resolution with the provision that the Landfill Plan be complied with, and the site be secured so as to prevent any and all future illegal dumping, within ten (10) days, so as not to constitute a public nuisance. Section 3. Upon failure of the property owner to comply with the provisions of Section 2. herein, the Law Director of the Village of Dublin be and is hereby directed to take all appropriate remedies to abate the afore- said nuisance. Section 4. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare to abate a public nuisance and shall take effect and be in force immediately upon its passage. BE I RESOLVED by the Council of the Village of Dublin, State of Ohio, of the elected members concurring: Section 1. That the estimated aggregate maximum amount of public funds subject to the control of said Council to be awarded to an eligible financial institution on deposit as Interim deposits at any time during the period of designation is $5,000,000.00, and the probable maximum amount of public monies to be awarded and be on deposit as Active deposits at any time during the period of designation is $100,000.00. Section 2. That notice is hereby given that the period of designation for depositories shall be from March 1, 1987, to March 1, 1989. Section 3. That notice is hereby given that the designation of the Official Depository(s) shall be made on March 2, 1987, during a regular meeting of the Council of the Village of Dublin, Ohio. Section 4. That this Resolution be and the same hereby is, declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of the residents of the Village of Dublin, Ohio, and for the further reason that these estimates must be made prior to designating Financial Institutions as Public Depositories, and that this Resolution shall take effect and be in force immediately upon its passage. I am not estimating any funds for inactive deposits (investments between one and two years) because that has not been recommended and the Village is much more limited on these types of investments. I would appreciate Council considering this for passage as an emergency at the February 2nd meeting so that I can send notices to financial institutions giving them ample time to respond and allowing us to review their applications prior to the meeting on March 2nd. I would like to request a joint meeting of the Finance Committee and Treasury Investment Board between February 20th and February 26th to review the applications and prepare an ordinance designating depositories for inclusion in the packet for March 2nd.
