Adoption of this ordinance is the final step in the annexation process. This annexation contains 38.9 acres, including 30 acres of land on the west side of Hyland-Croy Road just north of Brand Road and a substantial amount ofHyland-Croy Road right-of--way. At first reading, no agreement had been reached concerning the payment of reparations to Jerome Township should the City of Dublin choose to change the township boundary after the annexation is complete. Pursuant to the Ohio Revised Code, Dublin must pay Jerome Township a portion of the taxes to which the Township would have been entitled had the land not been annexed. For this reason, the annexation was postponed at two previous meetings. The negotiations between the Township and the petitioner on the reparations issue were ultimately unsuccessful. The City has negotiated with the petitioner to determine the manner in which this issue should be handled to ensure that the petitioner is responsible for any reparations that are due to the Township over atwelve-year reparations period. This process has concluded in apre-annexation agreement that was presented to City Council as a first reading on June 1, 2009 as Ordinance 27-09. This ordinance will have a second reading at the June 15, 2009 City Council meeting and can be approved at that time. The Law Director will be able to provide additional explanation at the second reading. Recommendation Planning recommends approval of Ordinance 08-09 subject to approval of Ordinance 27-09. This ordinance provides for the acceptance of an annexation of 39.8 acres of land on the west side of Hyland-Croy Road north of Mitchell-DeWitt Road in Jerome Township (including a substantial amount ofHyland-Croy right-of-way). This Ordinance has been postponed several times to allow the petitioner to negotiate with Jerome Township over reparations. The goal in negotiating the preannexation agreement is to ensure that the petitioner is responsible for any reparations that are due to the Township over the twelve year reparations period. We hope to have a preannexation agreement for Council consideration at the June 1, 2009 meeting. C ONCLUSION AND RE C ONIIVIENDATION: Since the parties have not yet developed a preannexation agreement for Council consideration, the Law Department recommends that City Council postpone Ordinance 08-09 to the June 15, 2009 meeting. Our goal is to have the preannexation agreement ready for first reading at the June 1, 2009 meeting. (We would not recommend accepting the annexation prior to considering the preannexation agreement.) Then, City Council would be in a position to hold the second reading for both the preannexation agreement and the annexation acceptance ordinances on June 15, 2009. Summary This proposed Regular Annexation is for 39.8 acres located on the west side of Hyland-Croy Road north of Brand Road. The acreage consists of both undeveloped land as well as portions of the Hyland-Croy right-of--way. Per the Ohio Revised Code regarding annexations, the City of Dublin was required to provide a resolution stating what services the municipality will provide. Accordingly, Resolution 70-08 was approved by City Council on October 20, 2008. (Copies of that Resolution and the informational memo are attached for reference.) This property is located within the negotiated expansion area under the City of Dublin's water and sewer service agreement with the City of Columbus. On November 8, 2007, the City of Columbus approved Ordinance 1554- 2007, giving their consent to Dublin's annexation of this 39.8+/- acres within the negotiated expansion area. The Union County Commissioners' final hearing on the annexation took place on December 15, 2008. The Commissioners approved the annexation by motion at that meeting. (A copy of their journal entry is attached.) Process Per the Ohio Revised Code, following the hearing with the County Commissioners, the transcript is forwarded to the clerk of the municipal corporation to which annexation is proposed. Upon receipt, the clerk is required to hold the transcript for a period of 60 days. Following the expiration of 60 days, at the next regularly scheduled Council meeting, an ordinance accepting the annexation is introduced. The Council shall then accept or reject the petition for annexation within a period of 120 days after the first reading of the ordinance. If the ordinance is approved at the second reading/public hearing or at a subsequent meeting, Ordinance 08-09 will be effective 30 days after passage and the property will be incorporated into the City of Dublin. Hyland Croy Right-of--Way Portion This annexation is somewhat unusual, as it includes a substantial amount of Hyland-Croy right-of- way. It required the signatures of a large number of property owners along Hyland-Croy Road because their ownership extends to the centerline of the road. Therefore, these property owners have been included in the petition. With approval of this annexation, the full right-of--way width for Hyland-Croy Road will be annexed, extending from just north of the traffic circle at Glacier Ridge Memo re Ordinance 08-09 -Annexation -Celtic Capital LLC February 26, 2009 Page 2 Boulevard down to the northern edge of the Bishop's Run subdivision located just south of Brand Road. Pre-annexation Agreement Prior to Council consideration of the statement of services resolution in October, the petitioners and the City evaluated the potential of aPre-Annexation Agreement to determine the reparations for the cost associated with removing this property from Jerome Township and placing it in Washington Township. To date, this issue has not been resolved, although the applicant has been negotiating with Jerome Township regarding aone-time payment in lieu of the standard reparation schedule. Consideration of the actual removal of this property from Jerome Township would be scheduled for future City Council action. Applicant's Request to Postpone The agent for the applicant has notified the City via the attached correspondence of their desire that Council postpone action on the annexation petition for two weeks to allow additional time to negotiate the reparations issue inherent in the draft pre-annexation agreement with the City of Dublin. Recommendation Consistent with past practice, staff recommends introduction and first reading of the ordinance on March 2, 2009 and Council consideration of the applicant's request to postpone further action for two weeks. The applicant has indicated that they would like to have action on this item at the City Council meeting of October 20. The subject territory is located near the northwest corner of Mitchell-Dewitt Road, west of Hyland-Croy Road ("Territory"). It has been the policy of the City of Dublin ("Dublin") to leave any annexed territory west of Hyland-Croy Road within township boundaries. As an extension of this policy, annexed territory west of Hyland-Croy Road would continue to receive fire services from the township from which the territory was annexed. If the City Council wishes to take action on this Resolution of Services it will be able to do so since action on the annexation will not take place for at least 80 days during which time more information may become available. If annexed Dublin would also have the option to remove the Territory from Jerome Township via a boundary adjustment and ensure that fire services will instead be provided by Washington Township. A preannexation agreement would have to be executed to address repazations which the applicant has agreed to do. However, this option defies Dublin's currently understood policy for areas of Jerome Township west of Hyland Croy Road. Readler, Assistant Law Director DATE: October 16, 2008 RE: Provision of Fire Services to Proposed Annexation Territory from Jerome Township, Union County (Petitioner: Celtic Capital, LLC) Numerous issues recently arose related to the provision of fire services to certain property located in Jerome Township that is the subject of a recent annexation petition filed by Celtic Capital, LLC (Stavroff) ("Developer"). As a result, we aze recommending tabling of the Resolution providing the Statement of Services for this property. The subject territory is located near the northwest corner of Mitchell-Dewitt Road, west of Hyland-Croy Road ("Territory"). It has been the policy of the City of Dublin ("Dublin") to leave any annexed territory west of Hyland-Croy Road within township boundaries. As an extension of this policy, annexed territory west of Hyland-Croy Road would continue to receive fire services from the township that the territory was annexed from. However, Legal Counsel for Jerome Township ("Township Counsel") contacted our office last week and opined that the Territory, upon Dublin's annexation, could no longer receive fire services from Jerome Township. Township Counsel explained that the Territory is a part of a "fire district," and that this fire district is funded by a particular levy that does not allow incorporated areas within Jerome Township to be served by the fire district. The Territory is currently unincorporated. However, according to Township Counsel, if annexed the Territory would become incorporated and the levy which funds Jerome Township's fire district could not be applied to the Territory. Of course, one option that Dublin has is to remove the Territory from Jerome Township via a boundary adjustment and ensure that fire services will instead be provided by Washington Township. A preannexation agreement would have to be executed to address reparations and these service issues. However, this option defies Dublin's currently stated policy and further investigation must be undertaken for Staff to recommend a course of action. Reynolds III filed an annexation petition on behalf of Celtic Capital, LLC with the Union County Commissioners. The petition is for 39.8+/- acres of land located near the northwest corner of Mitchell-Dewitt and Hyland-Croy Roads and including Hyland-Croy right-of--way from just south of Brand Road to Glacier Ridge Boulevard in Jerome Township. The petition was filed pursuant to R.C. 709.02, which is also known as the "Regular" annexation. Under this process, the City must first adopt a resolution relating to municipal services within twenty days prior to the Union County hearing. Resolution 70-08 has been prepared for this purpose and for your consideration. The Union County Commissioners may grant the proposed annexation after the hearing scheduled on November 10, 2008. If neither the municipality nor the Township object, the Commissioners must grant the proposed annexation, provided all required procedures have been met. This proposed annexation is for 39.8i/- acres and includes a substantial amount of the Hyland- Croy Road right-of-~vay. The non right-of-way portion of this proposal is the 30.6 acres of land along the west side of Hyland Croy Road just north ofMitchell-Dewitt Road. In this annexation area, all Hyland-Croy rights-ot=way have been outside of the City of Dublin. The City and Union County Engineer's office have made a considerable effort to facilitate the inclusion of this right- of-~vay into the petition. Dublin Engineering and Planning support the inclusion of this area into the City. Sewer and water access is defined by the terms of an agreement with the City of Columbus. Under the terms of that agreement, the location of this annexation is within the Negotiated Area, which requires that any annexation to the City of Dublin be approved by the City of Columbus. Memo re Res.70-08 -Annexation of 34.8 Acres -Statement of Services October 2, 2008 Page 2 of 4 The City of Columbus has consented to this annexation by adoption of an Ordinance, File Number: 1554-2007. Township Determination The application was filed as a regular annexation, which permits the City to determine the Township designation of the property upon annexation. In previous annexations the City has placed properties into Washington Township in order to secure Washington Township Fire and EMS services. A change of township is not contemplated in this annexation, although the City could make this change in the future. The west side of Hyland-Croy Road has generally been understood as an area that will remain in Jerome Township and Jerome will continue to provide Fire and EMS services. As this is the current arrangement for Fire and EMS and no other issues have been raised, no Pre Annexation Agreement has been prepared and no reparations are contemplated at this tune. Background ZONING arzd COtI'IMUNITYPLAN The current Jerome Township zoning classification for this property is U-1 Rural District, which allows for single-family residence on large Iots. Upon annexation, the property will be automatically zoned R, Rural, under the Zoning Code of the City of Dublin. This would allow farm operations and single-family dwellings on a minimum one-acre lot. The 2007 Community Plan anticipates annexations in this area. The adopted Future Land Use Map calls for Mixed Residential Rural Density for the entire tract. Existing adjacent properties include: township Iarge lot single family to the west, notch and south; and Dublin Jerome High School across Hyland-Croy Road to the east. SERVICE ASSESSMENT Police Protection The City of Dublin has five police districts and deploys a minimum of five cruisers at any given time. The subject annexation is located approximately 4.07 driving miles from the Justice Center, the Division of Police headquarters. The City of Dublin provides police and communications services on a twenty-four hour basis and has mutual aid agreements with other jurisdictions. The annexation area will be fully served with these services at the same or similar levels now being provided to other areas of the City. Fire Protection and En:ergency.Medical Service (EMSJ Ahhough the Washington Township Fire Department provides fire protection to most of this portion of Dublin, this location will be served by the Jerome Township Fire Department. Most previous annexations in this area have been removed from Jerome Township and placed into Washington Township. This location is the first annexation west of Hyland-Croy Road since state annexation laws changed. The City has reached an understanding with Jerome Township to not change township designation for any areas annexed west ofHyland-Croy and these locations Memo re, Res.70-08 -Annexation of 39.8 Acres -Statement of Services October 2, 2008 Page 3 of 4 will continue to utilize Jerome Fire and EMS. The Jerome Township fire station is approximately 3.74 miles away on SR 42. Solid Waste Collection The City of Dublin provides residential solid waste collection at no additional fee. The annexation area will be served with solid waste services at the same or similar levels now being provided to other areas of the City. Water Distribution The property is located within the Negotiated Expansion area of the Water Service Agreement with the City of Columbus. The Columbus City Council passed Ordinance 1554-2007 on November 8, 2007 consenting to the annexation of this property into Dublin and modifying the Water Service Agreement. A 16-inch waterline is located on the east side of Hyland-Croy Road and will serve this property. Sanitary Sewer Collection The property is located within the Negotiated Expansion azea within the Sanitary Service Agreement with the City of Columbus. City of Columbus Ordinance 1554-2007 consents to the annexation of this property into Dublin and modifies the Sewer Service Agreement. This property is located within the tributary area of the North Fork Indian Run trunk sewer. A 12-inch sanitary sewer is located on the east side of Ryland-Croy Road at the southern corner of the site and will serve this property. A study of the capacity of the existing sanitary trunk sewer will be needed to identify any mitigation work that will be needed to provide capacity in the trunk sewer to allow collection of additional flows from this property when developed. Storrnwater Alanagement and Floodplain This property is Iocated in the North Fork Indian Run Watershed as defined by the Stormwater Master Plan. The property drains towards a tributary of the North Fork Indian Run located roughly in the center of the property. This tributary connects into North Fork Indian Run just south of Mitchell-Dewitt Road. The Stream Corridor Protection Zone regulations will apply to this tributary and the Stormwater Regulations will apply to any development of this property. This property is located outside any FEMA designated floodplains. Roads arzd Streets The primary road serving this property is Hyland-Croy Road. The annexation does have a small frontage on Mitchell-Dewitt Road right-of--way which will remain outside the city. Per The Thoroughfare Plan, Hyland-Croy Road is classified as a minor arterial with a planned right-of- way of 100 feet. Mitchell-Dewitt Road is classified as a collector with a planned right-of--way of 80 feet. This annexation will change the ownership/maintenance responsibility of Hyland-Croy Road bet`veen the northern edge of the Bishop's Crossing subdivision northward to Glacier Ridge Boulevard from Union County to the City of Dublin, a distance of 1.83 miles. WHEREAS, a Regular Annexation petition for 39.8 acres, more or less, from Jerome Township, Union County to the City of Dublin was filed in the offices of the Union County Commissioners on August 22, 2008, by Jackson B. Reynolds, III, Attorney/Agent for Petitioners, Celtic Capital LLC; and WHEREAS, Section 709.03 (D) of the Ohio Revised Code requires that, prior to the hearing of the annexation petition, the Municipal Authority shall adopt a statement indicating what services the Municipal Corporation will provide to the territory proposed for annexation and an approximate date by which it will provide services to the territory proposed for annexation upon annexation; and WHEREAS, the area proposed for annexation lies within Dublin's Negotiated Water and Sewer Service extension area, as provided under the agreements with the City of Columbus; and WHEREAS, the proposed annexation is in conformance with the annexation area contained in the Dublin Community Plan, adopted by Council on December 10, 2007. The City of Dublin will provide the following municipal services for the 39.8 acres, more or less in Jerome Township, Union County upon the annexation of the area to the City of Dublin, Ohio: Police. The City of Dublin has five police districts and deploys a minimum of five cruisers. The subject annexation is located approximately 4.07 miles away miles from the Justice Center, the Division of Police headquarters. The annexation area will be fully served with police and communications services at the same or similar level now being provided to other areas of the city with similar land use and population. Fire and EMS. Washington Township Fire Department currently provides fire protection and EMS services to Dublin residents. Dublin will ensure that this area of Dublin is provided with fire protection and EMS services at the same or similar level now being provided to other areas of the City by either Washington Township or a comparable fire and EMS department upon annexation. Solid Waste Collection. Residential refuse collection services are contracted by the City and are currently provided at no charge. Street Maintenance. The City's Streets and Utilities Division provides excellent service in the area of street and road maintenance. The City currently maintains portions of Hyland-Croy Road and other streets intersecting with Hyland-Croy Road in the area of this annexation and will continue to do so at the same levels upon annexation of this property. Section 2. The City has Water and Sanitary Sewer Service Agreements with the City of Columbus, and the subject property is within the Negotiated Service area of both agreements. Conditioned upon the ability of the City of Columbus to provide water supply and to provide sufficient sanitary sewerage disposal capacity, sufficient public water distribution and sanitary sewer collection systems exist in this area to serve this property at the current time. Commissioner Lee opened the meeting stating that the public hearing was recessed so that all the parties involved could meet and discuss the issues in regards to the annexation dealing with fire and EMS services. Mr. Paul Hammersmith, City of Dublin, stated that they meC on November 19, 2008 with Jerome `T'ownship and their legal counsel and the conclusion was to have Washington Township serve the area with Fire and EMS services. Jackson Reynolds, Agent, passed out a map showing the fire station and the property to be annexed and stated that the fire house was approximately 1.5 miles from the area to be served. Commissioner McCarthy stated that if the property is annexed, it will then be removed from Jerome Township as in past practices and Jerome Township will lose the tax revenues from Elie property. Bob Merkle, Jerome Township Trustee, wanted this put on record that Jerome Township will not be responsible to service the area and that service will be provided either though contract with Jerome Township or by Washington Township. Commissioner McCarthy made the motion to approve the annexation with Conunissiaier Hall seconding the motion. Mr. Reynolds distributed to the County Commissioners copies of a memo from the County Engineer's office stating the reasons for the annexation request; a copy of a letter from the County Engineer's office to the Hyland-Croy Road landowners; a copy of a letter from Metro Parks to the Comity Commissioners; a copy of a memorandum in support of the annexation that was submitted from Jackson Reynolds; and a copy of the map with the area to be amtexed highlighted. Matt Stauroff spoke in regards to meeting with Kathleen Crowley, City of Marysville, on several occasions in regards to the statement of services. Steve Stolte, County Engineer summarized a few things in regards to the annexation regarding extending the right of way. Commissioner McCarthy asked how long it would take to get the answers regarding the fire services between Dublin and Jerome Township. Commissioner McCarthy suggested recessing the hearing for approx. 45 days and re-convene in December. It was decided at the hearing with all present, to re-convene on Monday, December I5, 2008 at 9:30 a.m. The resolution follows. At our request, Celtic Capital LLC included in their annexation all of the property within the existing road right-of-way of Hyland-Croy Road from the existing corporation line of the City of Dublin at the south property line of the 9.939 acre tract of Suzanne B. Feasel, Trustee, north to the existing corporation line (extended) of the City of Dublin at the south property line of the 1.435 acre tract of Gang-Fung and Li-Li H. Chen. See the attached map. Our reasons for this request were: 1. Since the increasing traffic and the need for future road improvements on Hyland-Croy Road are created largely by development of subdivisions along the east side of Hyland- Croy Road and in the City of Dublin, it makes most sense for Dublin to be responsible for road maintenance and future road improvements. 2. Without the annexation of the Hyland-Croy Road right-of-way, annexations on the west side of Hyland-Croy Road will create multiple locations where the Dublin Corporation line crosses the road creating numerous road segments. Such segments will create road maintenance problems and confusion for emergency response personnel. If the road right-of-way is all within the City of Dublin, these jurisdictional issues are minimized. I personally met with many of the landowners along the road who were affected by this request to explain these issues to them. Annexation Petition Fully Complies with R.C. 709.033 (A, 1 thru 6) All elements required under R.C. 709.033 have been met with this application, therefore the Board of County Commissioners should approve the amnexation petition. Following are the applications of R.C. 709.033 as fulfilled by this Petition: "The Petition Contains All Matlers Required in Section 709.02 of the Revised Code [709.033(A)(1)J. " A majority of property owners signed the annexation petition as required by R.C. 709.02(C)(1 thru 3) when it was filed with the Board of County Commissioners and no withdrawals were made during the process, further the Petition contained: (a) A full and accurate legal description and accurate map or plat of the territory to be annexed; (b) A statement of the number of owners in the territory to be annexed and included the date the signature was secured and all were secured within 180 days of filing the annexation petition. (c) The name of the person to act as agent for the petitioners. (d) A list of all the tracts, lots or parcels contained in the territory to be amrexed and all the tracts, lots or parcels located adjacent to or directly across the street fi~om the area to be annexed, including the name and mailing address of the owner of each tract, lot or parcel and the permanent parcel number as provided by the county auditor's parcel numbering system. As stated by the Clerk of the Board of County Commissioners, the Petition, map and description fully comply with R.C. 709.02. 2. "Upon being notifted of the date of the hearing, the agent for the petitioners shall do all of the following [709.03(B)(1 and 2)J." (a) Within 5 days after the setting of the hearing date the agent filed a notice on the clerks of the municipal corporation and the township included in the annexation territory. (b) Within 10 days after the setting of the hearing date all property owners within the amnexation territory was sent notice of the hearing and told their signature could be withdrawn from the petition by filing a notarized affidavit with the clerk of the Board of C`~unty Commissioners. Further a notice was sent to all the abutting property owners of the annexation tenritory giving the date, time and place of the hearing and included a map of the area to be annexed. The clerk of the Board of County Commissioners was notified within ] 0 days of the mailing of the two (2) notices by a notarized affidavit provided by the agent for the petitioners. 3. "Notice has been Published as Required by 709.03 of the Revised Code Proof of public notice and notice to the Clerks is on file with the Board of County Commissioners and meets all requirements. 4. "A Majority of Owners of Real Estate in the Annexation Territory have Signed the Petition {709.033(A)(2)}. " Thirty-one of Thirty-five property owners have signed the annexation Petition for an 89% signature rate which constitutes a majority of owners in the area to be annexed and no request for withdrawal of a signature has been made up to the date of the hearing. 5. The City of Dublin has Passed the Service Resolution [709.03(D)J. The service resolution passed by the City of Dublin is on file with Board of County Commissioners (No. 70-08). 6. The Territory is not Unreasonably Large [709.033(A)(4)]. The area to be annexed consists of 39.8 acres and is not unreasonably large in light of the totality of Jerome Township. The courts have adopted a three prong test in reviewing the question of unreasonably large and those factors include: (a) the geographic character, shape, and size of the territory to be annexed in relation to the annexing municipality, and in relation to the annexing mwricipality, and in relation to the territory remaining after the annexation; (b) the ability of the city to provide necessary municipal services to the additional territory; and (c) the effect on the remaining township territory if annexation is permitted. See In Re: Annexation of 1544.61 Acres in Northampton Twp. to the City of Akron (1984) 14 Ohio App. 3d 231. 2 (a) Size, Shape and Character of the Area to be Annexed The-39.81 acre tract is an extremely small portion of the total area of Jerome Township. The courts have held much larger areas of annexation do not violate the size criteria. See In Re: Appeal of Jefferson Twp. Bd. of Trustees (1992) 78 Ohio App. 3d 493 (5% not unreasonably large, In Re: Annexation of Territory M, Of Columbus Twp. (1984) 14 Ohio App. 3d 260 (3% not unreasonabl}~ large). In this particular case, 39.81 acre reduction of Jerome Township cannot be characterized as unreasonably large for annexation to the City of Dublin. Additionally the area to be annexed is on the periphery of the Townships southeast border and futther isolated by the Metro Parks Glacier Park system of lands and therefore its inclusion into the City of Dublin is appropriate. (b) The City of Dublin can Provide All Services The City of Dublin eau provide all necessary city services as set forth in the submitted service resolution. The City of Dublin could, and would, provide water service to the site, as a water main is currently located in the Hyland-Croy Road right-of--way. Sewer service to the site can be provided by the City of Dublin, as it has a line located in Hyland-Croy Road which can be extended to service the area. Police Fire and rMS service can also be provided as the Police Station is located at Perimeter Drive and Commence Parkway and Station 93 of the Washington Township Pire Department is located at 5825 Brand Road, approximately 1.5 miles from the territory sought to be annexed. (c) There is no Appreciable Effect on the Township The area to be annexed is currently undeveloped and used for agricultural uses. The total property tax paid by the property owners for 2008 was $105.98, which is a very small amount and could not represent more than one percent (1%) of the total revenues for Jerome Township for the 2008 tax year. A $105.98 loss of revenue is extremely small and the Court of Appeals in In Re: Annexation of 99, 5476 acres of Land in Franklin Twp. CA9310-198 (12`" Dist. Ct. of App., March 28, 1994), held that "Even if the impact of an annexation on a township's tax base is a proper consideration in determining whether annexation territory is unreasonably large, it should be given little weight. Clearly most townships will have fewer available financial resources after annexation, however, those Townships are no loner responsible for servicing the annexation territory." The slight loss of revenue to the Township is insufficient to support a conclusion that the proposed annexation is umeasonably large and therefore no effect can be determined by the Board of County Commissioners under this element. Given the review of the three (3) elements outlined in the Northampton case, the territory to be annexed in this case is not unreasonably large and this portion of 709.033(A)(4) has been satisfied for approval of the annexation of Petitioner's. property. The Territory to be Annexed is Contiguous to the City of Dublin [709.02(A)J. The annexation territory abuts the municipal boundaries of the City of Dublin for a distance of 9,451 feet out o~ a total outside dimension of 22,657 feet or 42% contiguity to the City. R.C. 709.033(A) requires that all matters in R.C. 709.02 be met for approval of the amtexation petition and that includes the territory to be annexed be "adjacent" to the municipality to which the annexation is sought. hi Watson v. Doolittle (1967), 10 Ohio App. 2d 143, 146-147, the Court of Appeals defined the adjacency requirement with the synonymous words contiguous or adjoining to illustrate the legislature's requirement that property to be annexed must be "contiguous," adjacent, or adjoining to the village or city. The Supreme Court of Ohio further defined the adjacency requirement in the case Middletown v. McGee (1988), 39 Ohio St. 3d 284, by stating "White it is generally agreed that some touching of the municipality and the territory is required, the law is unsettled as to what degree of touching is needed to fulfill the contiguity requirement." The Court went onto say that the use of connecting strings, strips, subterfuge, corridor, etc..to create the contiguity to a municipality do not satisfy the basic concept that the city be a unified body. The proposed amtexation does represent a cohesive piece of a collective body as the City of Dublin's municipal boundaries is located to the south and east in a slowly annexing area of Jerome Township. This proposal for annexation is one of unity, of compactness, or contiguity, and should be approved. As the Twelfth District Court of Appeals has also recognized that the percentage of total linear feet that municipal boundary actually touches the annexation territory is not the test to determine whether the property is contiguous. The Twelfth District held that 356.1 linear feet out of 8,500 total linear feet (only 4.2%) was sufficient to satisfy R.C. 709.02, In Re Petition for Annexation of 75.14 Acres (Clermont Cty., Sept. 16, 1996), CA 96-02-013. The contiguity and collective requirements are fully complied with in this annexation petition. On balance, the general good of the territory, proposed to be annexed will be served and the benefits to the territory, proposed to be annexed and the surrounding area will outweigh the detriments to the territory proposed to be annexed and the surrounding area, if the annexation petition is granted [709.033(A)(S)J. The requirement that the general good be served by annexation has been interpreted by various courts of the State of Ohio and the courts have ruled that the focus of the Board of Commissioner's decision in determining the general good is on the general good of the area to be annexed and with the new view of township territory within one half mile of the territory to be amrexed, one has to weigh the good of both areas. The Court of Appeals further clarified In Re: Char Standards in (1978) 59 Ohio App. 3d 146, 150, holding that: "Under R.C. 709.033, the Board is obligated to give primary consideration to the wishes of the property owners in the amnexation territory in deciding what is in their own general good, especially in cases as this, where all property owners in the territory are in favor of annexation. * * * "`fhe ultimate focus of annexation proceedings (must) be on the general good of the territory sought to be annexed and requires granting of the petition when it is shown that such benefit will result." Laricca v. Mahoning Cty. Bd. of Commrs. (1974) 38 Ohio St. 2d 99. Although the new language contained in 709.033 requires the Board of County Commissioners to look beyond the area to be annexed there is no evidence presented that there will be any detriment to those township areas surrounding the annexation territory. The submitted evidence to the Board of Commissioners in this case is that the general good of the area will be served by annexation of the territory to the City of Dublin. The property owners have reviewed the municipal services and benefits that would accrue upon annexation to the City of Dublin and finds that the enhancement of its property would be served by annexation to Dublin. R.C. 709.033 directs the ultimate focus of annexation proceedings be on the general good of the territory sought to be annexed and in this instance no detriment has been shown on surrounding township properties so on balance the annexation of the territory is appropriate. In Re: Annexation of 118.7 acres in Miami 7ivp. (1990) 52 Ohio St. 3d 124, 131. Annexation should be denied only if there has been a showing that the area to be annexed will not be served adequately if annexation occurs, to such an extent that the "general good" is impaired or undermiued or thwarted." Laricca v. Mahoning Cty. Bd. Of Commrs. Supra. at 99. There is no testimony or evidence before the Board of Commissioners that the area to be annexed will be harmed or threatened, or any surrounding township areas, rather the evidence proves the opposite, that the general good will be served by the approval of the annexation. There are many reasons for seeking annexation besides for water and sewer service, and the property owner has reviewed and accepted those services which include but are not limited to improved police and fire protection, reduced property taxes, and more favorable zoning standards. The improvement of police and fire service is most certainly a viable reason for• seeking annexation. See Stefanko v. Tuscarawas Twp. Bd. Of Trustees (Stark Cty., August 5, 1991), Case No. CA-8446, In Re: Annexation of 99.5476 Acres in Jefferson Township Montgomery Cty., October 16, 1990, Case No. 11896, Laricca v. Mahoning Cty. Bd. of Commrs., Supra. Tax rates are valid reasons for seeking annexation and do run to the general good of the territory to be annexed and it has been shown that annexation to the City of Dublin would provide a benefit to the Petitioners' property by providing a wider variety of services based on the taxes levied by the municipality. See In Re: Annexation of 57.035 Acres of Liberty Township (Trumbell Cty., Sept. 15, 1995) No. 95-T-5186, In Re: Annexation of 118.7 Acres in Miami Twp., Supra, Jefferson Twp. Bd. v. Caton (Montgomery Cty., October 16, 1990) Case No. 11896. Finally, favorable zoning standards in a municipality have also been cited by various courts as appropriate grounds for requesting annexation. In Re: Annexation of Certain Territory (1992) 82 Ohio App. 3d 377; In Re: Annexation of Territory in Olmsted Twp. (Cuyahoga Cty., 1984) 14 Ohio App. 3d 260. 5 The testimony presented to the Board of Commissioners proves that the general good of the territory sought to be armexed will be served by the annexation. On balance the benefits to the territory sought to be annexed outweigh any detriments to the territory to be annexed as well as the surrounding areas. The opponents have not presented to the Board of Commissioners any clear and convincing evidence thaf't~re annexation of the 39.8E acres would have a detrimental effect on the coutinued operation of Jerome Township or the surrounding areas and therefore the focus should be on the general good of the area to be annexed. It is clear from the evidence presented to the Board of Commissioners that the general good standard in R.C. 709.033(A)(5) has been met and that the annexation be approved. 9. No street or highway will be divided or segmented by the boundary line between a township and the municipal corporation as to create a road maintenance problem, or if a street or highway will be divided or segmented; the municipal corporation has agreed as a condition of the annexation, that it will assume the maintenance of that street or highway. (709.033(A)6)J. The Union County Engineer has worked with the petitioners to include as much right-of- way of Hyland-Croy Road to insure the City of Dublin is responsible for the road maintenance for those municipal areas which border the right-of--way near the annex area to preclude any division of segmentation of the roadway. CONCLUSION The property owners have petitioned to annex the property to the City of Dublin to obtain municipal services and other benefits not available in the township. The municipal services and benefits will enhance the 39.8 acres and the only way to secure those services and benefits and determining that the general good of its property will be served by the annexation. In reviewing the weight of the above evidence, the territory is not um~easonably large, the City of Dublin cau provide municipal services to the property, and all statutory requirements of the Ohio Revised Code have been satisfied. Jeffrey respect to the possibility of having land that Metro Parks owns along HyJand- Greg S. Lashutka Croy Road annexed to the City of Dublin to facilitate improvement and Ellen t.. Tripp management of the road. Our understanding is that this annexation would only involve a narrow strip of our land along Hyland-Croy Road. It is generally Director: recognized that traffic along Hyland-Croy is likely to increase significantly in the John R. O'Meara coming years as the surrounding area becomes more developed. Metro Parks, along with Union County, the City of Dublin and Jerome Township, Battelle Darby Creek signed an agreement in 1997 whereby we agreed to cooperate on the establishment of a Metro Park. The park, now known as Glacier Ridge Metro Blacklick Woods and Golf Courses p~.k, opened in 2002. As part o£ that agreement, Metro Parks agreed not to support annexation any of the land to any village or municipal corporation. We Biendon Woods are intent on keeping our commitments in the agreement. Therefore we are not willing to sign the petition for annexation. Chestnut Ridge We have been told #hat it is possible that our pzoperty could be annexed without Clear Creek our signature on the annexation petition. We would not object to having a small Glacier Ridge piece of our land along Hyland-Croy Road, as represented on the documents shared with us by Steve Stolle, annexed to the Clty of Dublin if both the .City of Heritage Park Dublin. and Union County agree that is in the best interest of all concerned. We would also hope that Jerome Township doesn't object to.the annexation. This annexation also provides the opportunity to annex the Hyland-Croy Road right-of-way from Mitchell-Dewitt Road north to the roundabout at the Metro Park entrance. I have had several discussions with our Union County Commissioners and with City of Dubiin officials about the idea of annexing the right-of-way of Hyland Croy Road to the City of Dublin. We are in agreement that it makes sense to do so. I have two reasons for supporting such an annexation. First, since the increasing volume of traffic in the next several years is going to be created by the development of existing subdivisions on the east side of Hyland-Croy Road and in the City of Dublin, it makes most sense to me that Dubiin should be responsible for road maintenance (snow removal, road repairs, resurfacing, etc.). Second, annexations on the west side of Hyland-Croy Road wits create multiple locations where the Dublin corporation line will cross the road. Such jurisdictional changes make it difficult for road maintenance, law enforcement and fire department personnel. The changes can lead to the wrong Jurisdiction responding to calls for maintenance or, more importantly, for emergencies. If the road right-of-way is all within the City of Dublin, then these jurisdictional issues are minimized. Washington Township Fire Department currently provides fire protection and EMS services to Dublin residents. Dublin will ensure that this area of Dublin is provided with fire protection and EMS services at the same or similar level now being provided to other areas of the City by either Washington Township or a comparable fire and EMS department upon annexation. Solid Waste Collection. Residential refuse collection services are contracted by the City and are currently provided at no charge. Street Maintenance. The City's Streets and Utilities Division provides excellent service in the area of street and road maintenance. The City currently maintains portions of Hyland-Croy Road and other streets intersecting with Hyland-Croy Road in the area of this annexation and will continue to do so at the same levels upon annexation of this property. WHEREAS, a Regular Annexation petition for 39.8 acres, more or less, from Jerome Township, Union County to the City of Dublin was filed in the offices of the Union County Commissioners on August 22, 2008, by Jackson B. Reynolds, III, Attorney/Agent for Petitioners, Celtic Capital LLC; and WHEREAS, Section 709.03 (D) of the Ohio Revised Code requires that, prior to the hearing of the annexation petition, the Municipal Authority shall adopt a statement indicating what services the Municipal Corporation will provide to the territory proposed for annexation and an approximate date by which it will provide services to the territory proposed for annexation upon annexation; and WHEREAS, the area proposed for annexation lies within Dublin's Negotiated Water and Sewer Service extension area, as provided under the agreements with the City of Columbus; and WHEREAS, the proposed annexation is in conformance with the annexation area contained in the Dublin Community Plan, adopted by Council on December 10, 2007. The applicant has indicated that they would like to have action on this item at the City Council meeting of October 20. The subject territory is located near the northwest corner ofMitchell-Dewitt Road, west of Hyland-Croy Road ("Territory"). It has been the policy of the City of Dublin ("Dublin") to leave any annexed territory west of Hyland-Croy Road within township boundaries. As an extension of this policy, annexed territory west of Hyland-Croy Road would continue to receive fire services from the township from which the territory was annexed. If the City Council wishes to take action on this Resolution of Services it will be able to do so since action on the annexation will not take place for at least 80 days during which time more information may become available. If annexed Dublin would also have the option to remove the Territory from Jerome Township via a boundary adjustment and ensure that fire services will instead be provided by Washington Township. A preannexation agreement would have to be executed to address reparations which the applicant has agreed to do. However, this option defies Dublin's currently understood policy for areas of Jerome Township west of Hyland Croy Road. However, Legal Counsel for Jerome Township ("Township Counsel") contacted our office last week and opined that the Territory, upon Dublin's annexation, could no longer receive fire services from Jerome Township. Township Counsel explained that the Territory is a part of a "fire district," and that this fire district is fianded by a particular levy that does not allow inco~po~ated areas within Jerome Township to be served by the fire district. The Territory is currently unincorporated. However, according to Township Counsel, if annexed the Territory would become incorporated and the levy which fiands Jerome Township's fire district could not be applied to the Territory. Of course, one option that Dublin has is to remove the Territory from Jerome Township via a boundary adjustment and ensure that fire services will instead be provided by Washington Township. A preannexation agreement would have to be executed to address reparations and these service issues. However, this option defies Dublin's currently stated policy and fiarther investigation must be undertaken for Staff to recommend a course of action. Consequently, given all of the recent developments beyond Dublin's control, we would recommend tabling of this Resolution. Reynolds III filed an annexation petition on behalf of Celtic Capital, LLC with the Union County Commissioners. The petition is for 39.8+/- acres of land located near the northwest corner of Mitchell-Dewitt and Hyland-Croy Roads and including Hyland-Croy right-of--way from just south of Brand Road to Glacier Ridge Boulevard in Jerome Township. The petition was filed pursuant to R.C. 709.02, which is also known as the "Regular" annexation. Under this process, the City must first adopt a resolution relating to municipal services within twenty days prior to the Union County hearing. Resolution 70-08 has been prepared for this purpose and for your consideration. The Union County Commissioners may grant the proposed annexation after the hearing scheduled on November 10, 2008. If neither the municipality nor the Township object, the Commissioners must grant the proposed annexation, provided all required procedures have been met. This proposed annexation is for 39.8+/- acres and includes a substantial amount of the Hyland- Croy Road right-of--way. The non right-of--way portion of this proposal is the 30.6 acres of land along the west side of Hyland Croy Road just north ofMitchell-Dewitt Road. In this annexation area, all Hyland-Croy rights-of--way have been outside of the City of Dublin. The City and Union County Engineer's office have made a considerable effort to facilitate the inclusion of this right- of-way into the petition. Dublin Engineering and Planning support the inclusion of this area into the City. Sewer and water access is defined by the terms of an agreement with the City of Columbus. Under the terms of that agreement, the location of this annexation is within the Negotiated Area, which requires that any annexation to the City of Dublin be approved by the City of Columbus. Township Determination The application was filed as a regular annexation, which permits the City to determine the Township designation of the property upon annexation. In previous annexations the City has placed properties into Washington Township in order to secure Washington Township Fire and EMS services. A change of township is not contemplated in this annexation, although the City could make this change in the future. The west side of Hyland-Croy Road has generally been understood as an area that will remain in Jerome Township and Jerome will continue to provide Fire and EMS services. As this is the current arrangement for Fire and EMS and no other issues have been raised, no Pre Annexation Agreement has been prepared and no reparations are contemplated at this time. Background ZONING and COMMUNITYPLAN The current Jerome Township zoning classification for this property is U-1 Rural District, which allows for single-family residence on large lots. Upon annexation, the property will be automatically zoned R, Rural, under the Zoning Code of the City of Dublin. This would allow farm operations and single-family dwellings on a minimum one-acre lot. The 2007 Community Plan anticipates annexations in this area. The adopted Future Land Use Map calls for Mixed Residential Rural Density for the entire tract. Existing adjacent properties include: township large lot single family to the west, north and south, and Dublin Jerome High School across Hyland-Croy Road to the east. SERVICE ASSESSMENT Police Protection The City of Dublin has five police districts and deploys a minimum of five cruisers at any given time. The subject annexation is located approximately 4.07 driving miles from the Justice Center, the Division of Police headquarters. The City of Dublin provides police and communications services on a twenty-four hour basis and has mutual aid agreements with other jurisdictions. The annexation area will be fully served with these services at the same or similar levels now being provided to other areas of the City. Fire Protection and Emergency Medical Service (EMS) Although the Washington Township Fire Department provides fire protection to most of this portion of Dublin, this location will be served by the Jerome Township Fire Department. Most previous annexations in this area have been removed from Jerome Township and placed into Washington Township. This location is the first annexation west of Hyland-Croy Road since state annexation laws changed. The City has reached an understanding with Jerome Township to not change township designation for any areas annexed west of Hyland-Croy and these locations Memo re Res.70-08 -Annexation of 39.8 Acres -Statement of Services October 2, 2008 Page 3 of 4 will continue to utilize Jerome Fire and EMS. The Jerome Township fire station is approximately 3.74 miles away on SR 42. Solid Waste Collection The City of Dublin provides residential solid waste collection at no additional fee. The annexation area will be served with solid waste services at the same or similar levels now being provided to other areas of the City. Water Distribution The property is located within the Negotiated Expansion area of the Water Service Agreement with the City of Columbus. The Columbus City Council passed Ordinance 1554-2007 on November 8, 2007 consenting to the annexation of this property into Dublin and modifying the Water Service Agreement. A 16-inch waterline is located on the east side of Ryland-Croy Road and will serve this property. Sanitary Sewer Collection The property is located within the Negotiated Expansion area within the Sanitary Service Agreement with the City of Columbus. City of Columbus Ordinance 1554-2007 consents to the annexation of this property into Dublin and modifies the Sewer Service Agreement. This property is located within the tributary area of the North Fork Indian Run trunk sewer. A 12-inch sanitazy sewer is located on the east side of Hyland-Croy Road at the southern corner of the site and will serve this property. A study of the capacity of the existing sanitary trunk sewer will be needed to identify any mitigation work that will be needed to provide capacity in the trunk sewer to allow collection of additional flows from this property when developed. Stormwater Management and Floodplain This property is located in the North Fork Indian Run Watershed as defined by the Stormwater Master Plan. The property drains towards a tributary of the North Fork Indian Run located roughly in the center of the property. This tributary connects into North Fork Indian Run just south of Mitchell-Dewitt Road. The Stream Corridor Protection Zone regulations will apply to this tributary and the Stormwater Regulations will apply to any development of this property. This property is located outside any FEMA designated floodplains. Roads and Streets The primary road serving this property is Hyland-Croy Road. The annexation does have a small frontage on Mitchell-Dewitt Road right-of--way which will remain outside the city. Per the Thoroughfare Plan, Hyland-Croy Road is classified as a minor arterial with a planned right-of- way of 100 feet. Mitchell-Dewitt Road is classified as a collector with a planned right-of--way of 80 feet. This annexation will change the ownership/maintenance responsibility of Hyland-Croy Road between the northern edge of the Bishop's Crossing subdivision northward to Glacier Ridge Boulevard from Union County to the City of Dublin, a distance of 1.83 miles. This property was identified within the proposed annexation areas of the Community Plan and is located within the Negotiated Expansion service area as defined in the water and sewer agreements with the City of Columbus. Columbus has agreed to allow Dublin to annex this property and modify the Sewer and Water Service Agreements. Recommendation Approval of Resolution 70-08 is recommended. Readler, Assistant Law Director DATE: September 8, 2008 RE: Stavroff Annexation We just received notice that the Stavroff annexation has been filed in Union County (the annexation area includes Celtic Capital LLC parcels of 25.961 acres and 2.149 acres, plus the roadway along Hyland-Croy up to just north of Glacier Ridge Boulevard in Union County). We anticipate presenting the statement of services resolution at the October 6, 2008, City Council meeting. The County Commissioners' meeting on the annexation is currently scheduled for November 10, 2008. Consistent with the direction we obtained from Council in the past, we have not sought a preannexation agreement with the developer that provides for the removal of the annexation area from the Jerome Township boundaries and the subsequent payment of reparations. Our direction, we believe, is not to seek the removal of property from Jerome Township when such property is located west of the Hyland-Croy Road right-of--way line. As a result, Jerome Township's fire department will service this annexation area, not Washington Township. Of course, nothing would prohibit Dublin from removing this territory from Jerome Township's boundaries in the future, if it so desires.
