Hereiuafter known as the OwncdOccupant, and the City of Dublin, hereinafter lrnown as the f iry, who
mutualiy agree and covmant as follows:
1. The Project Managec/General Contraetor, who is eonstructing a new premises at:
Building permit No. 07_2&-M-/ , bas applied for a Certifieate of Oceupancy.
2. The premises, as of the date this agreement is signed, has not met all requirements of the Aubain
Codified Ordir?ances, hereinafter lrnown as the Code, and therefore additianal fanal inspections
cannot be approved,
3. 'rhe list Qf items, which is attached ta and is a part of the agreement, is accepted by both the k'roject
Manager/Genera) Gontractor and the Owner/Occupant, documentatioxa of thase iterns necessary to
be completed prior to the project receir?ing final approval,
4. Aclrnowledging that the premises are not completed and that certain items, as showrA, ere
requirements of the Code of the City, t'he Cawner/Occupant, requests that the City allows occupancy
of the premises and use of tlae property as of the date of this agreement.
S. In retutn for such above Conditional Approval, the Project Manager/General Contractor agrees to
compltte all items as shown by (date) ? 31 and further agrees to release, hold
harmless and indemnify the Ciry and its agents, assigns and emp]oyees from any and all obligation,
liability, and/ar responsibility that might arise as a result of percnitting occupaney under a
Conditional Approval Agreernent.
6. In return for the City allowing conditional approval, the Ownerl4ccupant hereby releases the City,
its agent, assigns and employees &om any and all obligations and/or responsibilities rtlated to tlae
complerion of the premises, and fiuther agrees to release and bold harmless the City, its agents,
assigns and ernployees from any and all liability that might arise as a result of oecupancy of the
pxpmiceG. Furthe,r; the (hwmer/Occupant accepts the responsibility for the completion of th,ose items
shovvn a5 incomplete, and recognizes that the City may rev'oke the Conditional Approval

Agreement causing the premises to be vacated; and/or the City xnay._initiate legal action, if these
items are not completed on a rimely basis, and nvithin the schedule contained in item 5 of this
agreement. 1fie Owner/Occupant agrees that the City or its agent shall have full access to tlae
property to inspect, or at it's soae and exclusive discretion cause to be made any improvement
necessary to bring any part of the preanises ixtto compliance with this Conditional Approval
Agrtemcnt.
7. The Owner/Occupant and the Project lVtanager/General Contractor both agree thafi the City, by
accepting this Agreement in allowing occupancy as of the date of tlus Agreement has in no way
waived, foifeited or otherwise relinquished any rights arid/ar powers that it would have if this
Agreement were not in effect.
8. The Owner/Occupant acknowledges that he is under no obligation whatsoever to enter into this
Agreement, but that absent this Agreexn,ent, Conditional Approval to use the prc,perty wi]1 nat be
granted.
9. This Conditional Approval Agreennen,t will serve as the Temporary Occupancy Permit the Building
pfficial may issue in accordamce with 4101:2-1-27(E) of the Ohio Administrative Code when the
entire scope of the building work has not been completed, but the Building Official has determined
the building can be occupied safely.
