CONDITIONAL APPROVAL AGREEMENT

Herein after known as the Project Manager/General Contractor, and ,e

Hereinafter lrnown as the Owner/Occupant, ana the City of Dublin, hereinafter lrnown as the City, who
mutually agree and covenant as follows:
1. The Project Manager/General Contractor, who is constructing a new premises at:

Building Permit No657' ?66163 , has applied for a Certificate of Occupancy.
2. The premises, as of the date this agreement is signed, has not met all requirements of the Dublin
Codified Ordinances, hereinafter known as the Code, and therefore additional final inspections
cannot be approved.
3. The list of items, which is attached to and is a part of the agreement, is accepted by both the Project
Manager/General Contractor and the Owner/Occupant, documentation of those items necessary to
be completed prior to the project receiving final approval.
4. Acknowledging that the premises are not completed and that certain items, as shown, are
requirements of the Code of the City, the Owner/Occupant, requests that the City allows occupancy
of the premises and use of the property as of the date of this agreement.
5. In return for such above Conditional Approval, the Project Manager/General Contractor agrees to
complete all items as shown by (date) ?_? and further agrees to release, hold
harmless and indemnify the City and its agents, assigns and employees from any and all ohligation,
liability, and/or responsibility that might arise as a result of permitting occupancy under a
Conditional Approval Agreement.
6. In return for the City allowing conditional approval, the Owner/Occupant hereby releases the City,
its agent, assigns and employees from any and all obligations and/or responsibilities related to the
completion of the premises, and further agrees to release and hold harmless the City, its agents,
assigns and employees from any and all liability that might arise as a result of occupancy of the
premises. Further, the Owner/Occupant accepts the responsibility for the completion of those items
shown as incomplete, and recognizes that the City may revoke the Conditional Approval

Agreement causing the premises to be vacated; andlor the City may initiate legal action, if these
items are not completed on a timely basis, and within the schedule contained in item 5 of this
agreement. The Owner/Occupant agrees that the City or its agent shall have full access to the
property to inspect, or at it's sole and exclusive discretion cause to be made any improvement
necessary to bring any part of the premises into compliance with this Conditional Approval
Agreement.
7. The Owner/Occupant and the Project Manager/General Contractor both agree that the City, by
accepting this Agreement in allowing occupancy as of the date of this Agreement has in no way
waived, forfeited or otherwise relinquished any rights and/or powers that it would have if this
Agreement were not in effect.
S. The Owner/Occupant acknowledges that he is under no obligation whatsoever to enter into this
Agreement, but that absent this Agreement, Conditional Approval to use the property will not be
granted.
9. This Conditional Approval Ageement will serve as the Temporary Occupancy Permit the Building
Official may issue in accordance with 4101:2-1-27(E) of the Ohio Administrative Code when the
entire scope of the building work has not been completed, but the Building Official has determined
the building can be occupied safely.

Proposal: An extension of a special permit for a model home within the
Tartan West Subarea G subdivision located on the north end of
Vineyard Haven Drive, approximately 560 feet south of Corazon
Drive.
Request: Review and approval of a special permit under the provisions of
Code Section 153.098.

Case Summary:
The applicant is requesting the renewal of this special permit for six-months to operate a
condominium as a model home and sales office for Subarea G within the Tartan West
subdivision. No structural or exterior changes aze proposed for this extension. Planning
recommends approval of this request with two conditions.
Case Background:
This specia] permit was originaily approved on August 25, 2005 (See Board Order Case #05-
1325P) for this location and expires on August 25, 2007.
Site Description:
Site Location The overall site is a 28.3-acre parcel located south of Corazon Drive arid east of Hyland-Croy
Road. The final development for this subarea includes 111 attached condominium home units
(two to three units per structure), 8.2 acres of private open space, and 8.2 acres of public open
space. The model home and sales office are currently located in building 28, a two-unit structure
located near the entrance to the condominium units.

Surrounding Zoning and Uses
The site and all surrounding areas are zoned PUD, Planned Unit Development District, as part of
the Tarta.n West Subdivision plan.
Proposal Description:
,Siting
The model home is located in the northwestern portion of the subarea at the intersection of
Vineyard Haven Drive and Winemack Lane. The 3,908-syuaze-foot model home contains a side-
loaded, two-car garage temporarily serving as the sales office.
Integration und Lighting
The building materials far the model home consist of Hardi-piankT'" siding and cultured stone
which are consistent with the approved materials for the development. No exterior lighting of the
model home is proposed.
Duration
The applicant is requesting to operate this model home and saies office for an additionaI six
months. Cuirently, 39 of the I11 homes, whieh reflects approximately 35% of the project's
completion, are occupied or have been issued building germits.
Sign
Aai existing sign is located in the front yard of the model home to assist in identification and
way-finding. The sign is a 3.5-foot wide by 2.5- foot tall rectangular sign rnounted an two, 4-foat
posts. This sign will incorporate 8 square feet and meets the size, height, and location
requirements af the Code.
Operation Details
The model home wili be in operation from Monday through Sunday from 12:0(}p.m. - until
6:00p.m. and will be closed on Fridays. There wiil be one sales associate on-site during hours of
operation. Parking is provided in six parking spaces located adj acent to the site and in the model
home drivevciay.
SECTI4N II - REVIEW STANDARDS:
The purpose of regulations for model homes is to preserve the opportunity for potential residents
of tlie City to inspect housing available within the nnunicipaiity; to provide home builders a
forum to demonstrate housing types; to preserve the quality of residential Iife for nearby
residents; aud to protect residential areas from uses which are not residential in nature.
Planning 4pinion and Recommendation:
Section 153.098 of the Code identifies criteria for the review and approval for a Special Permit.
In accordance with this Section, the Board of Zaning Appeals shall approve, disapprove, or
approve with conditians a special permit based on its proposed location in the eommunity. In
making its decision, the Boaid shall consider that the proposed model home be in compliance
with the following:

Sitiag (Criterion I). The model horne should be sited so that it is easily accessible ancl
identifiable.
Criterion is met: The model home lacation is easily accessible to potentaal visitors. The
existing sign also aids in the identification of the unit as a model.
Integration & Lighting (Criterion 2). The model home should'be integrated into the residential
character of the neighborhood with external lighting approved on a case-by-case basis. No
e,xterior lighting other than usual and custornary residential lighting shall be permitted at the
moded house af'ter 9:00 p.m.
Criterion mav be met thraugh Condition; The proposed model home is integrated into
the community and no additional lighting is proposed. The Board has also expressed
concerns regarding the potential trespass of interior lighting and all interior lightiuig, with
the exception of lighting in a maximum of two rooms should be turnad off by 9:00 p.m.
and remain off until 8:00 a.m. daily (Condition 1).
Duration (Criterion 3). The special permit should be approved for a limited duration not to
exceed two years for n:odel hornes in new subdivisions and not to exceed one year in developed
or mature neighborhoods. Extension of the duration of model homes may be permitted by
applicatian to the Board of Zoning tlppeals. The Board shall consider the same criteria in
approving extensiorES as is prescribecl for initial application.
Criteriorc may be rnet throuFh Condition: The Code limits special permits to a one-year
#ime frame for deveioped or mature neighborhoods. Typically, renewals of special
permits have been limited to this time period by Planning and the Board of Zoning
Appeals if the development exceeds 50% compietion. In this case, the devetopment is
approximately 35% developed, ancl may be considered immature and given up to two
years. However, the applicant plans to reloeate the model home and sales office within
this section of the development within six inonfihs. Therefore, only a six-month extension
is requested, with the special permit to expire on February 25"', 2008 (Condition 2).
Sign (Criterion 4). The model home should be identifted by no inore than one sign in compliance
with the Sign Code.
Criterion is neet: The existing sign meets the above criteria and no additionaI signs are
proposed.
Operation Details (Criterion S). The special permit application will describe the use proposed
for the model home, including the hours of operation, number and type of employees, maximum
number of employees to be on site at any time, provision for parking for en:ployees and
customers. _
Criterion is ncet: The details of the proposed model home operation, including the hours
of operation and number of empioyees, are indicative of operations typicatly associated
with a model home. The parking provisions will adequately serve this model. In
addition, the property wilt be required to remain in compliance with all portions of the
Zo»ing Code.

SECTION. III - RECOMMENDATION:
This proposal meets the criteria tisted in Code Section 153.098 and the location of this model
home and sales oi?ice remains appropriate for continued use as a model hame. Planning
recommends approval of this application with two conditions:
