mutually agree and covenant as follows:
1. The Project Manager/General Contractor, who is constructing a new premises at:

2. The premises, as of the date this agreement is signed, has not met all requirements of the Dublin
Codified Ordinanees, hereinafter known as the Code, and therefore additionaI fmal inspections
eannot be approved.
3. The Iist of items, which is attache.d to and is a part of the agreement, is accepted by both the Pioject
Manager/General Contractor and the Owner/Occupant, docurnentation of those items necessary to
be completed prior to the project receiving final approval.
4. Aclrnowledging that the premises are not completed and that certain items, as shown; are
requirements of the Code of the City, the Owner/Occupant, requests that the City allows occupancy
of the premises and use of the property as of the date of this agreement,
5. In return for such above Conditional Approval, the Projeci Manager/General Con.tractor agrees to

harmless and indemnify the City and its agents, assigns and employees from any and all obligation,
liability, andJor responsibility that might arise as a result of permitting occupancy under a

6. In return for the City allowing conditional appraval, the Owner/Occupant hereby releases the City,
its agent, assigns and employees from any and all obligations and/or responsibilities related to the
completion of the premises, and further agrees to release and hold hannless the City, its agents,
assigns and emgloyees from any and all liability that mighf arise as a result of occupancy of the
premises. Further, the Owner/Occupant accepts the responsibility for the completion of those itexns
shown as incomplete, and recognizes that the City may revoke the Conditional Approval

Agreement causing the premises to be vacated; and/ar the City may initiate legal action, if these
items are not completed on a timely basis, and within the schedule contained in item 5 of this
agreement. The Owner/Occupant agrees that the City or its agent shall have full access to the
property to inspect, or at iYs sole and exclusive discretion eause to be made any improvement
necessary to bring any part of the premises into compliance «ith this Conditional Approval
Agreement.
7. The Owner/Occupant and the Project Manager/General Contractor both agree that the -City, by
acaepting this Agreement in allowing occupancy as of the date of this Agreement has in no way
waived, forfeited or otherwise relinquished any rights and/or powers that it would have if this
Agreement were not in effect. 8. The Owner/Occupant acknowledges that he is under no obligation tivhatsoever to enter into this
Agreement, but that absent this Agreement, Conditional Approval to use the property will not be
granted.
9. This Conditional Appr.oval Agreement will serve as the Temporary Oceupancy Permit the Building
O€ficial may issue in accordance with 4101:2-I-27(E) of the Qhio Administrative Code when the
entire scope of the building work has not been comgleted, but the Building. Official has determined
the building can be occupied safely.

The plans dated07-May 2007 and revised 3 July 2007 for the captioned project have been reviewed for
compliance with the provisions of the Ohio Building Code (2005). The review was based upon the following
criteria:

Notes:
The architectural documents are sealed by Mark Ford, Ohio registered architect #9337, the HVAC,
plumbing and electrical by Carl A. McMullen, Ohio registered engineer # E52389, the civil by Gerald J
Hetterscheidt, Ohio registered Engineer # E62424 and the landscape architectural by David R. Kaiser,
Ohio registered landscape architect #495, to comply with the requirements of the OBC Section 106.3.4.1
and have been reviewed, therefore, in accord with OBC Section 104.1.
OBC 106.3 Examination of documents. The building official shall examine or cause to be examined
the accompanying construction documents and shall ascertain by such examinations whether the
construction indicated and described is in accordance with the requirements of this code.
OBC 106.3.3 Phased approval. The building official shall issue an approval for the construction of
foundations or any other part of a building or structure before the construction documents for the whole
building or structure have been submitted, provided that adequate information and detailed statements have
been filed complying with pertinent requirements of this code. The holder of such approval for the
foundation or other parts of a building or structure shall proceed at the holder's own risk with the building
operation and without assurance that an approval for the entire structure will be granted. Such approvals
shall be issued for various stages in the sequence of construction provided that all information and data
required by the code for that portion of the building or structure has been submitted. The holder of a
phased plan approval may proceed only to the point for which approval has been given.
Item 1 THIS PHASED APPROVAL IS FOR ALL EXCEPT FIRE ALARMS and ANY OF
THE MATTERS OF THE FIRE MARSHAL'S JULY 14, 2007 CORRESPONDENCE.
Item 2 OBC 106.1.1 Information on construction documents. Construction documents shall be

dimensioned and drawn upon suitable material. Electronic media documents are permitted to
be submitted when approved by the building official. Construction documents shall be
coordinated and of sufficient clarity to indicate the location , nature and extent of the work
proposed and show in detail that it will conform to the provisions of the code. Construction
drawings shall include information necessary to determine compliance with the building,
mechanical, plumbing and fire protection codes such as:
a. Fire Alarm Drawings regarding the Addressable Monitoring Alarm and the Smoke
Detection System shall be submitted for review; contain all information required by
NFPA 72-2002 4.5.1.1 and explained in Annex A4.5.1.1; and be approved before any
equipment is installed or remodeled. A separate Permit from the city ofDublin is
required.
Item 3 Review and Approval of Plumbing Drawings and inspection of Plumbing installations are
performed by the Franklin County Board of Health
Item 4 The Washington Township Fire Marshal has requested an opportunity to provide input to the
Dublin building deparirnent on issues relating to fire protection. The building official has
evaluated the Fire Marshal's comments related to the fire protection provisions of the OBC
and incorporates those comments, by reference, into this Phased Plan Approval and Correction
Request.
a. The response to the Fire Marshal's letter was said to be included in Advanced Civil
Design's response and it was not.
b. Please include resolutionof the matters of the Fire Marshal's June 15, 2007
correspondence to Building Standards in your reply to this 2"d Correction Request.
This review is based upon the information contained within the submitted drawings and related documents.
Once corrections are made, submit four (4) complete sets of the necessary revisions of the plans to the City
of Dublin, Division of Building Standards with any revisions clouded. Please also provide a letter that
identifies the action taken in response to any of the Items contained in this Correction Request.
The following items are required for code compliance, but are not necessarily covered in detail in the
construction documents. This list is a reminder to the design professional and contractors of issues, which
are to be satisfactorily dealt with in the field:
Item A OBC 106.3.1 Approval of construction documents. When the construction documents have
been deternuned to conform to the applicable provisions of the rules of the Board in
accordance with the procedures set forth in Section 105.3.1, the building official shall endorse
or stamp such plans as approved. One set of construction documents shall be kept by the
building official. The other set(s) shall be returned to the applicant, kept at the work site and
shall be open for inspection by the building official or the building official's designated
representative.
Item B OBC 105.7.2 Posting. The certificate of plan approval shall be posted in a conspicuous
location outside of the building and in the front part of the premises on which is, or will be the
approved building or equipment to which the approved plans relate. The owner and the
contractor shall, so far as possible, preserve and keep the certificate posted until the
completion of the work to which the approved plans relate.
Item C OBC 106.4 Amended construction documents. If substantive changes to the building are
contemplated after first document submission, or during construction, those changes must be

submitted to the building official for review and approval prior to those changes being
executed. The building official may waive this requirement in the instance of an emergency
repair, or similar instance.
Item D OBC 109.1 General. Construction or work for which an approval is required shall be subject
to inspection by the building official and such construction or work shall remain accessible
and exposed for inspection purposes until approved. This includes firestopping and
draftstopping (Chapter 7 OBC), mechanical work; piping, ducts and systems (Chapter 3
OMC), structural members and connections (Chapter 16 OBC), and electrical work (Chapter
27 OBC). All systems and elements covered by code are to be inspected and approved before
being covered
Item E OBC 1103.1 Where required. Buildings and structures, temporary or permanent, including
their associated sites and facilities, shall be accessible to persons with physical disabilities.
Item F OBC 1103.2.1 Specific requirements. Accessibility is required in buildings and facilities, or
portions thereof, to the extent indicated in ADAAG Section 4.1 and this chapter.

We have reviewed the construction documents for the referenced New Building Shell Improvement project as well as the Site
Lighting & Utility Drawings, all dated 03 July 2007, submitted to the Division of Building 5tandards July 06, 2007, for matters
of concern to the Washington Township Fire Department regarding rules relating to the 2005 Ohio Building Code (OBC) and
the fire prevention and the Dublin Fire Code(DFC) based upon the 2000 Intemational Fire Code.
We recommend disapproval of the plans submitted at this time.

OBC 106.3 Examination of documents. The building official shall examine or cause to be examined
the accompanying construction documents and shall ascertain by such examinations whether the
construction indicated and described is in accordance with the requirements of this code.
The construction documents, which have been submitted, do not allow the City of Dublin to issue a permit
to begin construction. Substantial portions of the OBC have not been complied with, as indicated by the
following items. The following item(s) shall be brought into full conformance with the OBC prior to the
issuance of any plan approval.
Item 1 OBC 1014.2.1 Two exits or exit access doorways. Where two exits or exit access doorways
are required from any portion of the exit access, the exit doors or exit access doorways shall be
placed a distance apart equal to not less than one-half of the length of the maximum overall
diagonal dimension of the building or area to be served measured in a straight line between
exit doors or exit access doorways. Interlocking or scissor stairs shall be counted as one exit
stairway.

Slab on grade construction with metal-stud and structural-frame load-bearing walls and
metal roof truss framing. The building is proposed to have a monitored alarm system for
the HVAC smoke detection system.
We have reviewed the construction documents for the referenced New Building Shell Improvement project as well as the Site
Lighting & Utility Drawings, al( dated 07 May 2007, submitted to the Division of Building Standards May 22, 2007, for
matters of concem to the Washington Township Fire Department regarding rules relating to the 2005 Ohio Building Code
(OBC) and the fire prevention and the Dublin Fire Code(DFC) based upon the 2000 International Fire Code.
We recommend disapproval of the plans submitted at this time.
OBC 106.1.1 Information on construction documents. Because the construction documents do not have enough
information for a complete plan review, this conection letter is a request for missing information and contains a review
only of the items submitted. A complete review will be performed upon receipt of the required information. This mav
result in additional items not contained in this conection letter; Section 106 OBC.
1.1 The Legend on Sheet 316 indicates pavement designs are located on ` Sheet 2"however, this sheet was not
provided with this set of documents. Please provide so that we may continue our review of these pavement
designs.
2. DFC 503.2.1 Dimensions. Fire apparatus access roads shall have an unobstructed width of not less than 20 feet (6096
mm), except for approved security gates in accordance with Section 503.6, and an unobstructed vertical clearance of
not less than 13 feet 6 inches (4115 mm).
a. The fire apparatus access road located behind the building shall be provrded with signs, in accordance with
Sectron 503.3.

3. DFC Appended D103.6 Signs. Where required by the code official, fire apparatus access roads shall be marked by the
property Owner with permanent NO PARKING - FIIZE LANE signs comp(ying with Figure D 103.6.
All such signs shall be conspicuously located and either attached to the exterior of the structure on the premises or
attached to a pole not to exceed seven feet in height.
Such signs shall have a minimum dimension of 12 inches wide by 18 inches high and have red letters on a white
reflective background with "Ordinance NO. 37-80," inscribed. Signs shall be posted on one or both sides of the fire
apparatus road as required by Section D103.6.1 or 103.6.2.
a. The apparatiis access drive as shown on Sheet 316 shall be marked by the properry (9?vner with permanent NO
PARKING - FIRE LANE signs complying with Figure D103.6 of the Drrblin Fire Code. Scich signs shall be
located along the North and East sides of the Bttilding where adjacent to the referenced apparattts access drive.
Please indicate compliance on the drawings. Attached is sign types required by DFC D 103.6
DFC Section 508.5.1.1 Fire Hydrant Systems Where Required. Fire hydrant spacing in commercial use groups A,
B, E, I, M, S, F; H, and R, as defined in the Ohio Building Code, shall be as fo(lows:
a) One fire hydrant shall be provided within 150 feet of the terminus of a pubiic or private dead end street, or stub
street, or common access drive or cul-de-sac, adjacent to the street, drive or cul-de-sac.
b) Fire hydrants shall be provided within 50 feet of intersecting streets.
c) Hydrant flows shall be the needed fire flows using Insurance Service Office method described in The American
Waterworks Association Manual M31. 1998 edition.
d) Approval of the size of piping in fire service mains by the code official does not relieve the ownec, developer,
architect, or contractor of the responsibility to provide adequate water supply to fire hydrants, sprinkler systems,
standpipe systems, fire pumps, or other systems the furnish water for fire suppression purposes for the protected
building.
Exception: The code official is authorized to accept a deficiency of up to 10 percent but not on consecutive
hydrants.
No Fire Hydrants are shown on the Site Utility Plan for acse to verify compliance with these code reqtrirements. P/ease
review and verify the location of any ezisting or required new.fire hydrants so that we may contintee otrr review of this
application.
5. DFC 505.1 Address numbers. New and existing buildings shall have approved address numbers, buiiding numbers or
approved building identification placed in a position that is plainly legible and visible from the street or road fronting the
property. These numbers shall contrast with their background. Address numbers shall be Arabic numerals or alphabet
letters. Numbers shall be a minimum of 4 inches (102 mm) high with a minimum stroke width of 0.5 inch (12.7 mm).
a. Please verify that approved address naimbers for this building, will be provided in accordance tivith the
provisions oJthis code section.
OBC 106.1.1.1 Fire protection system drawings. Drawings for the fire protection system(s) shall be submitted to
indicate conformance with this code and the construction documents and shail be approved prior to the start of system
installation. Drawings shall contain all information as required by the referenced installation standards in OBC Chapter
9.

• Existing trees shown to be preserved at the southeast corner of the property are not
protected trees. Their preservation is not required.
• Coordinate grading near access drive with the adjacent development. Approved
development plans for 6700 Perimeter Drive show mounds screening the length of
access drive, bisected with a sidewalk. Revise to show a minimum 3.5 foot high
mound along the entire frontage or add evergreen plants at the low areas to provide
the required screening. The future sidewalk also needs to be taken into account.
Sheet L1 and L2 Landscape Plans
• Add street address and refer to all notes and comments on the check set.
• Reduce number of maple trees. Substitute other deciduous trees (Sterling Linden,
Hardy Rubber Tree, and Kentucky Coffeetree) for the Freeman Maples.
¦ Extend some Hick's Yew plantings for a continuous hedge around vehicular use
area.
• Space Hick's Yew Shrubs at no more than 36" O.C. to meet opacity requirements.
¦ Screen transformer with evergreen plants two-thirds the height of the transformer at

Owner acknowledges that the City may take any and all necessary action (including, but not limited
to, removing the sign located within the City Easement Area or causing the relocation of the
sigz at Property Owner's expense) necessary for its use and enjoyment of its rights under said
Easement and, in such event, the City shall not be liable for any expenses, damages to, or
reconstruction of the si n which encroach upon the City Easement Area.
2. Extension. Property Owner, its successors and assigns, agree not to extend the
s_igi any further into the City Easement Area than is shown on the attached Exhibit "A" or as
otherwise approved by the City.
3. Assumption of Liabilities. Property Owner, its successors and assigns, agree to be
financially responsible to the City for any and all costs, expenses or liabilities (including reasonable

fees of attorneys, paralegals, experts, court reporters and others) incurred to remove or bypass the
structure or appurtenance as directed by the City.
4. Indemnity. Property Owner shall indemnify, protect, defend, and hold harmless the
City from and against all loss, liability, damage, actions, causes of action, or claims for injury, death,
loss or damage of whatever nature to any person, property or business interest caused by or resulting
from an act or omission of Property Owner or their agents, employees, customers, servants,
licensees, tenants, subtenants, guests or invitees in respect to the matters set forth in this Agreement
and their use of the City Easement Area as that use relates to the si n and the area proximate to
the sign , and from and against any and all costs, expenses or liabilities (including reasonable fees
of attorneys, paralegals, experts, court reporters and others) incurred or anticipated by the City in
connection with any claim, action or proceeding in respect of any such loss, liability, damage, action,
cause of action, or claim.
5. Insurance. Property Owner shall maintain adequate insurance coverage insuring its
obligations hereunder. Property Owner shall provide total limits of insurance to include primary and
excess coverage in an amount not less than One Million Dollars (U.S. $1,000,000). Property Owner
shall name the City as an "Additional Insured" on the policy. Any cancellation, reduction or
diminution in coverage shall not be effective unless thirty (30) days prior written notice thereof has
been given to the City.
6. Termination. This Agreement shall automatically terminate when the encroachments
contemplated herein no longer continue to exist for any reason whatsoever. Alternatively, the
Agreement shall terminate at the option of the City.
7. Miscellaneous Provisions.
(a) Successors and Assi?ns. This Agreement shall run with the land and be binding upon
and inure to the benefit of the respective heirs, personal representatives, successors, transferees, and
assigns of the parties hereto.
(b) Counterparts. This Agreement may be executed in one or more counterparts, each of
which shall be deemed to be a duplicate original, but all of which, taken together, shall constitute a
single instrument.
(c) Captions. The captions contained in this Agreement are included only for
convenience of reference and do not define, limit, explain or modify this Agreement or its
interpretation, construction or meaning and are in no way to be construed as a part of this Agreement.
(d) Severabilitv. If any provision of this Agreement or the application of any provision
or any circumstance shall be determined to be invalid or unenforceable, then such determination
shall not affect any other provision of this Agreement or the application of said provision to any
other person or circumstance, all of which other provisions shall remain in full force and effect.
(e) Amendments in Writin?. No change, amendment, termination or attempted waiver
of any of the provisions of this Agreement shall be binding upon any party unless in writing and
signed by both of the parties hereto.

( fl Covenants Run With the Land. It is intended that the covenants, easements,
agreements, promises and duties set forth in this Agreement shall be construed as covenants which
run with the land.
(g) Restoration. If, as a result of the exercise of any easement rights created under this
Agreement, Property Owner shall damage or disturb the improvements of the City or City Easement
Area, then Property Owner shall promptly repair or restore the property of the City to, as near as
possible, the condition existing prior to such damage or disturbance.
(h) Conformance with Dublin Sign Code sections. Property Owner must be in full
compliance with regulations pertaining to signs as outlined in Dublin Code § 153.150, et. seq.
(i) Conformance with Dublin Right-of-Wav Code sections. Property Owner must be in
full compliance with regulations pertaining to right-of-way as outlined in Dublin Code, including but
not limited to, Chapter 98.
(j) Venue. The parties hereto hereby consent to the exclusive jurisdiction of the courts of
the State of Ohio in Franklin County, and the United States District Court for the Southern District of
Ohio, and waive any contention that any such court is an improper venue for enforcement of this
Agreement.
(k) Governing Law. This Agreement shall be governed by and construed in accordance
with the laws of the State of Ohio.

plumbing and electrical by Carl A. McMullen, Ohio registered engineer # E52389, the civil by Gerald J
Hetterscheidt, Ohio registered Engineer # E62424 and the landscape architectural by David R. Kaiser,
Ohio registered landscape architect #495, to comply with the requirements of the OBC Section 106.3.4.1
and have been reviewed, therefore, in accord with OBC Section 104.1.
OBC 106.3.3 Phased approval. The building official shall issue an approval for the construction of
foundations or any other part of a building or structure before the construction documents for the whole
building or structure have been submitted, provided that adequate information and detailed statements have
been filed complying with pertinent requirements of this code. The holder of such approval for the
foundation or other parts of a building or structure shall proceed at the holder's own risk with the building
operation and without assurance that an approval for the entire structure will be granted. Such approvals
shall be issued for various stages in the sequence of construction provided that all information and data
required by the code for that portion of the building or structure has been submitted. The holder of a
phased plan approval may proceed only to the point for which approval has been given.
Item 1 THIS PHASED APPROVAL IS FOR ALL EXCEPT FIRE ALARMS WHICH HAVE
BEEN SUBMITTED FOR REVIEW UNDER APPLICATION #07-201407
Item 2 OBC 106.1.1 Information on construction documents. Construction documents shall be
dimensioned and drawn upon suitable material. Electronic media documents are permitted to
be submitted when approved by the building official. Construction documents shall be
coordinated and of sufficient clarity to indicate the location , nature and extent of the work
proposed and show in detail that it will conform to the provisions of the code. Construction
drawings shall include information necessary to determine compliance with the building,
mechanical, plumbing and fire protection codes such as:

The start of construction indicates acceptance of all of the conditions listed above. This review does not
preclude the necessity to conform with provisions which may have been omitted or overlooked in the
review process, but which are requirements of the code. Ultimate responsibility for legal compliance with
the Standards of Safety rests with the registered design professional, the tenant and the owner. Phased
Plan Approval will be valid only upon receipt by the City of Dublin, Division of Building Standards, of
one signed copy of this Phased Plan Approval to the submitted plans.
