CONDITIONAL APPROVAL AGREEMENT

Herein after known as the Project Manager/General Contractor, and 1CO )Fi?e 1 B W Q Q?' S
(Owner7Occupant)
Hereinafter known as the Owner/Occupant, and the City of Dublin, hereinafter known as the City, who
mutually agree and covenant as follows:
1. The Project Manager/General Contractor, who is constructing a new premises at;

Building Permit No. 67- a Oe qy,5 , has applied for a Certificate of Occupancy.
2. The premises, as of the date this agreement is signed, has not met all requirements of the DubIin
Codified Ordinances, hereinafter known as the Code, and therefore additional final inspections
cannot be approved.
3. The list of items, which is attached to and is a part of the agreement, is accepted by both the Project
Manager/General Contractor and the Owner/Occupant, documentation of those items necessary to
be completed prior to the project receiving final approval.
4. Aclrnowledging that the premises are not completed and that certain items, as shown, are
requirements of the Code of the City, the Owner/Occupant, requests that the City allows occupancy
of the premises and use of the property as of the date of this agreement.
5. In return for such above ConditionaT Approval, the Project Manager/General Contractor agrees to
complete all items as shown by (date) 7-):?', p% and further agrees to release, hold
harmless and indemnify the City and its agents, assigns and employees from any and all obligation,
liability, and/or responsibility that might arise as a result of permitting occupancy under a
Conditional Approval Agreement.
6. In return for the City allowing conditional approval, the Owner/Occupant hereby releases the City,
its agent, assigns and employees from any and all obligations and/or responsibilities related to the
completion of the premises, and further agrees to release and hold harmless the City, its agents,
assigns and employees from any and all liability that might arise as a result of occupancy of the
premises. Further, the Owner/Occupant accepts the responsibility for the completion of those items
shown as incomplete, and recognizes that the City may revoke the Conditional Approval

Agreement causing the premises to be vacated; andlor the City may initiate legal action, if these
items are not completed on a timely basis, and within the schedule contained in item 5 of this
agreement. The Owner/Occupant agrees that the City or its agent shall have full access to the
property to inspect, or at it's sole and exclusive discretion cause to be made any improvement
necessary to bring any part of the premises into compliance with this Conditional Approval
Agreement.
7. The Owner/Occupant and the Project Manager/General Contractor both agree that the City, by
accepting this Agreement in allowing occupancy as of the date of this Agreement has in no way
waived, forfeited or otherwise relinquished any rights andlor powers that it would have if this
Agreement were not in effect.
8. The Owner/Occupant aclrnowledges that he is under no obligation whatsoever to enter into this
Agreement, but that absent this Agreement, Conditional Approval to use the property will not be
granted.
9. This Conditional Approval Agreement will serve as the Temporary Occupancy Permit the Building
Official may issue in accordance with 4101:2-1-27(E) of the Ohio Administrative Code when the
entire scope of the building work has not been completed, but the Building Official has determined
the building can be occupied safely.

The plans dated June 7 2007 for the captioned project have been reviewed for compliance with the provisions
of the Ohio Building Code (2005). The review was based upon the following criteria:

Notes: An Industrial Equipment Platform is being provided in the Attic.
The architectural documents are sealed by Gary L. Sebach, Ohio registered architect #10628, the landscape
by James M. Houk, Ohio registered Landscape Architect #442 the HVAC, plumbing, fire protection and
electrical by RD Fields, GC Topp & ML Young, Ohio registered engineers # E43806, 51988 & 43335, the
structural by Karl L. Walters, Ohio registered Engineer # E60652 and the site civil by Stephen D. Schehl,
Ohio registered engineer #E67549, to comply with the requirements of the OBC Section 106.3.4.1 and
have been reviewed, therefore, in accord with OBC Section 104.1.
OBC 106.3.3 Phased approval. The building official shall issue an approval for the construction of
foundations or any other part of a building or structure before the construction documents for the whole
building or structure have been submitted, provided that adequate information and detailed statements have
been filed complying with pertinent requirements of this code. The holder of such approval for the
foundation or other parts of a building or structure shall proceed at the holder's own risk with the building
operation and without assurance that an approval for the entire structure will be granted. Such approvals
shall be issued for various stages in the sequence of construction provided that all information and data
required by the code for that portion of the building or structure has been submitted. The holder of a
phased plan approval may proceed only to the point for which approval has been given.
This Phased Plan Approval is FOR FOUNDATIONS ONLY
Item 1 The revised Mechanical Mezzanine, without exit stairs conforming to the requirements of
OBC 1009, can only be utilized as an "Industrial Equipment Platform" and will need to be
identified as an Industrial Equipment Platform on the drawings. The platform cannot be

utilized for storage and will need to be posted to warn against using the platform for storage.
The Mechanical Mezzanine, at 495 SF, is less than 10% of the Gross Building Area and could
have Storage as an accessory use if egress stairs from the space conforming to OBC 1009 were
provided and the space were suppressed. Fire Protection is provided on the P drawings even
though Storage is prohibited on the Mechanical Mezzanine without proper egress.
a. The Mechanical Mezzanine needs to be properly referred to on Sheet A1.02 and the
Plumbing, Mechanical and Electrical drawings as an "Industrial Equipment
Platform ". Coordinate the confguration of the `Attic" on the P, H and E drawings
with the configuration shown on sheet A1. 02.
b. The Sprinkler Riser up to the attic is shown rising through the Attic Access panel.
c. Provide signage prohibiting Storage on the Platform.
d. General Fire Protection Note 9 provides a spec only for upright heads in areas without
ceilings. The Mechanical Mezzanine is the only area to be suppressed. If it is to remain
suppressed, given the 594 SF of space, would a limited area sprinkler system properly
accomplish the designer's objectives?
e. Reference was made in the response to Correction Request #1 Item Sa to an attached
letter which was not provided.
Item 2 Roof Trusses shall be submitted for review; contain all of the information required by OBC
2304.4.1; and be approved before any trusses are installed.
a. Utilize Attic Trusses only for the portion of the attic that will enclose the Industrial
Equipment Platform. Revise Attic Truss Types TI, TIB, GTl, GTIA, GTIB, GTl C, T2,
GT2 T3, GT3, and GT3 as required to permit only the construction of the access to the
Clock Platform from the Mechanical Mezzanine.
Item 3 804.3 [Interior Floor Finish] Testing and identification. Floor covering materials shall be
tested by an approved agency in accordance with NFPA 253 and identified by a hang tag or
other suitable method so as to identify the manufacturer or supplier and style, and shall
indicate the interior floor finish or floor covering classification according to Section 804.2 .
Carpet-type floor coverings shall be tested as proposed for use, including underlayment. Test
reports confirming the information provided in the manufacturer's product identification shall
be furnished to the building official upon request.
a. It is noted that the Floor Finish is shown to be exposed concrete in the Finish Schedule
and is unusual for a store of this nature. Please identify, in the schedule, the ultimate
floor finish, whether it is to be provided by the Contractor or the Owner's Interior
Designer. Installed carpet will have to comply with the requirements of OBC 804 and
its proper installation will be a precondition of final occupancy.
Item 4 OBC 717.4 [Draftstopping in Attics].3 Other groups. Draftstopping shall be installed in
attics and concealed roof spaces, such that any horizontal area does not exceed 3,000 square
feet (279 m 2 ).
a. The reviewer understands from the Attic Plan sheet A1.03, the the drafstopping will
divide the entire attic into S spaces. Please indicate on the drawings how compliance
with OBC 1209.2 Attic spaces access is accomplished
Item 5 Provide information on the drawings that indicates how Roof Insulation (R-30) will be
secured to the structure.
Item 6 OBC 1507.7[Slate Shingles].3 Underlayment.
a. The Roof Plan correctly indicates the extent of underlayment required for compliance

Item 7 Indicate on the drawings how access from the Clock Access Platform to the time piece and
double tube lights 12 '+/- feet above the platform will be provided.
Item 8 OMC 501.2 Outdoor discharge. The air removed by every mechanical exhaust system shall
be discharged outdoors at a point where it will not cause a nuisance and from which it cannot
again be readily drawn in by a ventilating system. Air shall not be exhausted into an attic or
crawl space.
a. Toilet Exhausts are shown to terminate in the ventilated soffit. Terrninate Toilet
Exhausts through the roof.
Item 9 Review and Approval of Plumbing Drawings and inspection of Plumbing installations are
performed by the Franklin County Board of Health
Item 10 The Washington Township Fire Marshal has requested an opportunity to provide input to the
Dublin building department on issues relating to fire protection. The building official has
evaluated the Fire Marshal's comments related to the fire protection provisions of the OBC
and incorporates those comments, by reference, into this Phased Plan Approval and Correction
Request.
a. Please include resolutionof the matters of the Fire Marshal's June 27, 2007
correspondence to Building Standards in your reply to this Correction Request.
This review is based upon the information contained within the submitted drawings and related documents.
Once corrections are made, submit four (4) new and complete sets of plans to the City of Dublin,
Division of Building Standards with any revisions clouded. Please also provide a letter that identifies the
action taken in rsponse to any of the Items contained in this Correction Request.
The following items are required for code compliance, but are not necessarily covered in detail in the
construction documents. This list is a reminder to the design professional and contractors of issues, which are
to be satisfactorily dealt with in the field:
Item A OBC 106.3.1 Approval of construction documents. When the construction documents have
been determined to conform to the applicable provisions of the rules of the Board in
accordance with the procedures set forth in Section 105.3.1, the building official shall endorse
or stamp such plans as approved. One set of construction documents shall be kept by the
building official. The other set(s) shall be returned to the applicant, kept at the work site and
shall be open for inspection by the building official or the building official's designated
representative.
Item B OBC 105.7.2 Posting. The certificate of plan approval shall be posted in a conspicuous
location outside of the building and in the front part of the premises on which is, or will be the
approved building or equipment to which the approved plans relate. The owner and the
contractor shall, so far as possible, preserve and keep the certificate posted until the
completion of the work to which the approved plans relate.
Item C OBC 106.4 Amended construction documents. If substantive changes to the building are
contemplated after first document submission, or during construction, those changes must be
submitted to the building official for review and approval prior to those changes being
executed. The building official may waive this requirement in the instance of an emergency
repair, or similar instance.

Item E OBC 109.1 General. Construction or work for which an approval is required shall be subject
to inspection by the building official and such construction or work shall remain accessible
and exposed for inspection purposes until approved.
a. This includes f restopping and draftstopping (Chapter 7 OBC), mechanical work,•
piping, ducts and systems (Chapter 3 OMC), structural members and connections
(Chapter 16 OBC), and electrical work (Chapter 27 OBC). All systems and elements

OBC 106.3.3 Phased approval. The building official shall issue an approval for the construction of

Item 2 Roof Trusses shall be submitted for review; contain all of the information required by OBC
2304.4.1; and be approved before any trusses are installed and before any further approvals
may be issued.
Item 3 804.3 [Interior Floor Finish] Testing and identification. Floor covering materials shall be
tested by an approved agency in accordance with NFPA 253 and identified by a hang tag or
other suitable method so as to identify the manufacturer or supplier and style, and shall
indicate the interior floor finish or floor covering classification according to Section 804.2 .
Carpet-type floor coverings shall be tested as proposed for use, including underlayment. Test
reports confirming the information provided in the manufacturer's product identification shall
be furnished to the building official upon request.
a. It is noted that the Floor Finish is shown to be exposed concrete in the Finish Schedule
and is unusual for a store of this nature. Please identify, in the schedule, the ultimate
floor finish, whether it is to be provided by the Contractor or the Owner's Interior
Designer. Installed carpet will have to comply with the requirements of OBC 804 and
its proper installation will be a precondition of final occupancy.
Item 4 Review and Approval of Plumbing Drawings and inspection of Plumbing installations are
performed by the Franklin County Board of Health
This review is based upon the information contained within the submitted drawings and related documents.
Once corrections are made, submit four (4) copies of the informaion requested above to the City of
Dublin, Division of Building Standards with any revisions clouded. Please also provide a letter that

We have reviewed the revised construction documents for the referenced New Building project with Revision #1 dated 07-20-
07, submitted to the Division of Building Standards July 20, 2007, for matters of concern to the Washington Township Fire
Department regarding rules relating to the 2005 Ohio Building Cnde (OBC) and the fire prevention and the Dublin Fire
Code(DFC) based upon the 2000 tntemational Fire Code.
We are able to recommend a phased approval of the plans and note the following:
OBC 106.1.1.1 Fire protection system drxwings. Drawings for the fire protection system(s) shall be submitted to
indicate conformance with this code and the construction docwnents and shall be approved prior to the start of system
installation. Drawings shall contain ali information as required by the refr.renced installation standards in OBC Ch 9.
a. When available, submit for approval, prior to the start of system(s) installation, complete infornration
regarding the partial Fire Suppression System shall contain information required by NFPA 13 and 14, Chapter
8, Plans and Calculations for Fire Suppression and Standpipe and Hose Systems.

OBC 1063 Ezamination of documents. The building official shall ezamine or cause to be ezamined
the accompanying construction documents and shall ascertain by such ezaminations whether the
construction indicated and described is in accordance with the requirements of this code.
The construction documents, which have been submitted, do not allow the City of Dublin to issue a pernut
to begin construction. Substantial portions of the OBC have not been complied with, as indiCated by the

2304.4.1; and be approved before any trusses are installed.
Item 3 OBC 1014.2.1 Two exits or exit access doorways. Where two exits or exit access doorways

distance between doors 100 and 122 is 39 feet and must be at least 54 feet in an

Item 11 Reviewer notes that the ladder shown from the lower attic space to the clock access floor
cannot be constructed to comply with the minimum perpendicular clearance between the
centerline of the frxed ladder rungs and any obstruction on the climbing side of the ladder of
30" required by OSHA Publication 3124-12R 2003 for Stairways and Ladders.
Item 12 OBC 1507.7[Slate Shingles].3 Underlayment. Underlayment shall comply with ASTM D
226, Type U. In areas where the avera.ge daily temperature in January is 25°F (-4°C) or less or
where there is a possibility of ice forming along the eaves causing a backup of water, an ice
barrier that consists of at least two layers of underlayment cemented together or of a self-
adhering polymer-modified bitumen sheet, shall extend from the eave's edge to a point at least
24 inches (610 mm) inside the exterior wall line of the building.

construction drawings:
a. Specs for Building Insulation call for R-13. Energy Compliance Report utilized a
Cavity R-Value of 17.0 and a Cont R-Value of 5.0.
b. The Compliance Report utilized Metal Framed with a Thermal Break, Double Paned
Tinted Glass with an SHGC of 0.33. The construction documents do not specify nature
of glass to be installed.
c. The Specs for Foundation Insulation call for R-8 and the Compliance Report utilized R-
10.
d. Lighting and Power Compliance requires 1) occupant sensing lighting control
conference/meeting rooms and employee lunch and break iooms; 2) Automatic shutoff
control for lighting in building larger than 5,000 SF.
i. Coordinate Compliance Report with Construction Documents. Indicate on
Drawings any information utilized as basis for Compliance. Call out glass on
drawangs.
ii. Provide occupant sensing lighting control in Room 123 and 124 and automatic
shutoff control for lighting in the Building.
Item 14 Provide Lighting for the Clock Tower service platform.
Item 15 Provide the manufacturer's installation and maintenance instructions for review and to

1. OBC 106.1.1 Iaformation on cooatruction documptts. Because the construction documents do not have enough
information for a complete plan review, this correction letter is a request for missing information and contains a review
only of the items submitted. A complete review will be performed upon receipt of the reqaired information. This mav
result in additional items not contain_ed in this correction lotter Section 106 OBC.
a. Although the Site Plam shaws the extent of `Hemy-Duty' pavement, we are unsure of the extent of tlte Fire
apprrratus access road/drive (FAAR) and where it rs to be located and how it is to be navigated. As curnently
show», the heavy-duty pavement shown only has a small portion that is located within 40 feet from the building.
This portion of ihe FAAR is shown at only 18 feet wide and is located to the left of the ntain entrance drive
where a turning radius of only 4. S feet would need to be negotiateai. Please have tbe Applicant submit a detailed

DFC Appended D103.6 Signs. Where required by the code official, fire apparatus access roads shall be marked by the
property Owner with permanent NO PARIQNG - FIRE LANE signs complying with Figure D103.6.
All such signs shall be conspicuously located and either attached to the exterior of the structure on the premises or
attached to a pole not to exceed seven feet in height
Such signs shall have a minunum dimension of 12 inches wide by 18 inches high and have red letters on a white
reflective background with "Ordinance NO. 37-801" inscribed_ Signs shall be posted on one or both sides of the fue
apparatus road as required by Section D103.6.1 or 103.6.2.
a. YVhen the apparatus access drive has been coordinated and properly shown on the plans, it shall be marked by
the property Owner with permanent NO PARKING - F7RE LANE signs complying with Figure D103.6 of the
Dublin Fire Code. Such signs shall be located adjacent to ihe referenced apparatus access drive. Please
indicate compliance on the drawings. Attached with this review letter, please find the sign types as required by
DFzC D 103.6
4. DFC 503.2.1 Dimensions. Fire apparatus access roads shall have an unobstructed width of not less than 20 feet (6096
mm), except for approved security gates in accordance with Section 503.6, and an unobstructed verticai cleazance of
not less than 13 feet 6 inches (4115 mm).
a. A portion of the `heavy-duty' pavement drives, as located on the site plan, is dimensioned at only 12 feet. Is this
drive to be considered part of the required FAAR?
b. The heavyduty pavement drive shawn entertng from Stoneridge Lane, extends into the site and makes an
'abrupt' hard left turn and ihen shortly thereafter, turns abruptly left again. None of ihe heavy-duty pavement
areas circulate up to the front of this building where access by fire apparatus is needed. Please review these
concerns arral contact the Fire Marshal, Alan Perkins, who may be reached at (614) 652-3930, to funher discnss
these issues.
DFC 503.2.4 Tuming Radius. The turning radius on any fire apparatus access road, public or private, that provides
access to a structure or equipment, shall be a minimum tuming radius of 45 feet on the outside and 25 feet on the inside.
a) Many turning radii, as shown on the Sfte Staking Plan, do not meet with these requirements. Please review these
requirements with respect to the turning radii located along and around the areas designated as, heavy-duty
pavement, starting with the radius' provided off of Shamrock Boulevard as weg as the ones provided off of the
Staneridge Lane entrance.
6. DFC 505.1 Address numbers. New and existing buildings shall have approved address numbers, building numbers or
approved building identification placed in a position that is plainly legible and visible from the street or road fronting the
property. These numbers shall contrast with their background. Address numbers shall be Arabic numerals or alphabet
letters. Numbers shall be a minimum of 4 inches (102 mm) high with a minimum stroke width of 0.5 iiich (12.7 mm).

8. DFC 912Z [Fire Department Connections] Locxtion. With respect to hydrants, driveways, buildings and -
landscaping, fire department connections shall be so located that fire apparatus and hose connected to supply the system
will not obstruct access to the buildings for other fire apparatus. The location of fire department connections shall be
approved. Fire Department Connections shall be located not more than 100 feet from the nearest fire hydrant connected
to an approved water supply and aze permitted to exceed 100 feet when approved by the code official.
DFC 912.2.1 Visible loeation. Fire department connections shall be located on the street side of buildings, fully visible
and recognizable from the street or nearest point of fire department vehicle access or as otherwise approved by the fire

Appendix D103.6 Signs. Where required by the code official, fire apparatus
access roads shall be marked by the property owner with permanent NO
PARKING -`FIRE LANE signs complying with Figure D103.6.
All such signs shall be conspicuously located and either attached to the exterior
of the structure on the premises or attached to a pole not to exceed seven feet
in height.
Such signs shall have a minimum dimension of 12 inches (305mm) wide by 18
inches (457mm) high and have red letters on a white reflective background

Dear Mr. Sebach,
This is a courtesy notification of the plan review status for this commercial
permit. Review Services has completed review of submitted materials and at this
time, the overall review status is generally favorable. You may wish to forward a
copy of this notice to the developer/property owner.
Site engineering mylars were recently requested from the project's civil engineer
with an itemization of remaining engineering andlor zoning review comments to
be addressed. Once we have received and approved the mylars, the Team plan
review will be formally upgraded to approval. (Until then, the overall review
outcome may appear as a disapproval in our plan tracking software.)
When received, the updated mylar sheets will be checked for compliance, and
routed internally for signature by Dublin City Engineer and the Director of Land
Use & Long Range Planning. Copies of approved mylars will then be assembled
into approved permit plan sets for delivery to our Building Standards staff who
will prepare the Permit and obtain the signature of the Chief Building Official.
Building Standards staff will contact you when the permit is ready for pick-up.
Dublin activities from receipt of approvable mylars to call for permit pick-up are
usually completed in 2 to 5 work days. Please call if you have any questions.
