CONDITIONAL APPROVAL AGREEMENT

Herein after known as the Project Manager/General Contractor, and lL~~~,5 ~~~e
(Owner/Occupant)
Hereinafter known as the Owner/Occupant, and the City of Dublin, hereinafter known as the City, who
mutually agree and covenant as follows:
1. The Project Managgerr/General Contractor, who is constructing a new premises at:
Building Permit No. (97-20117-'7_, has applied for a Certificate of Occupancy.
2. The premises, as of the date this agreement is signed, has not met all requirements of the Dublin
Codified Ordinances, hereinafter known as the Code, and therefore additional final inspections
cannot be approved.
3. The list of items, which is attached to and is a part of the agreement, is accepted by both the Project
Manager/General Contractor and the Owner/Occupant, documentation of those items necessary to
be completed prior to the project receiving final approval.
4. Acknowledging that the premises are not completed and that certain items, as shown, are
requirements of the Code of the City, the Owner/Occupant, requests that the City allows occupancy
of the premises and use of the property as of the date of this agreement.
5. In return for such above Conditional Approval, the Project Manager/General Contractor agrees to
complete all items as shown by (date) 6 i Op and further agrees to release, hold
harmless and indemnify the City and its agents, assigns and employees from any and all obligation,
liability, and/or responsibility that might arise as a result of permitting occupancy under a
Conditional Approval Agreement.
6. In return for the City allowing conditional approval, the Owner/Occupant hereby releases the City,
its agent, assigns and employees from any and all obligations and/or responsibilities related to the
completion of the premises, and further agrees to release and hold harmless the City, its agents,
assigns and employees from any and all liability that might arise as a result of occupancy of the
premises. Further, the Owner/Occupant accepts the responsibility for the completion of those items
shown as incomplete, and recognizes that the City may revoke the Conditional Approval

Agreement causing the premises to be vacated; and/or the City may initiate legal action, if these
items are not completed on a timely basis, and within the schedule contained in item 5 of this
agreement. The Owner/Occupant agrees that the City or its agent shall have full access to the
property to inspect, or at it's sole and exclusive discretion cause to be made any improvement
necessary to bring any part of the premises into compliance with this Conditional Approval
Agreement.
7. The Owner/Occupant and the Project Manager/General Contractor both agree that the City, by
accepting this Agreement in allowing occupancy as of the date of this Agreement has in no way
waived, forfeited or otherwise relinquished any rights and/or powers that it would have if this
Agreement were not in effect.
-8. The Owner/Occupant acknowledges that he is under no obligation whatsoever to enter into this
Agreement, but that absent this Agreement, Conditional Approval to use the property will not be
granted. '
9. This Conditional Approval Agreement will serve as the Temporary Occupancy Permit the Building
Official may issue in accordance with 4101:2-1-27(E) of the Ohio Administrative Code when the
entire scope of the building work has not been completed, but the Building Official has determined
the building can be occupied safely.

Certificate of Occupancy.

Dear Mr. Malone:
in accordance with your request, BBCM Engineering, Inc. (BBCM) has observed the
footing excavations at the referenced lot. A summary of the work performed is submitted
herewith for your records.
On September 17, 2007, BBCM observed that water was seeping into the northwest corner
of the basement footing excavations where the sanitary sewer tap entered into the
proposed structure. As recommended by BBCM, uncontrolled backfill and natural saturated
soils were removed to depths of up to 7 feet below the plan basement footing grade. The
soils observed in the bottom of the overexcavation appeared to consist of very-stiff to hard
natural cohesive soils. The overexcavation was backfilled with K-Krete up to the plan
basement footing grade. BBCM recommended that two No. 4 steel reinforcing bars be
placed across the transitions from K Krete to natural bearing soils.
On September 19, 2007, BBCM returned to the site to observe the final footing excavations.
The garage and porch footing excavations were terminated in hard natural cohesive soils
with hand-penetrometer readings ranging from 4.0 to 4.5+ tons per square foot (tsf). The
basement footing excavations were terminated at plan grade in natural granular soils (fine
to coarse sand) intermixed with cohesive soil. Penetration into the bearing soils with a No.
4 steel rod ranged from 2 to 5 inches. Standing water (groundwater seepage) was
observed throughout the basement footing excavations. BBCM recommended that the
excavations be mucked out and that two No. 4 steel reinforcing bars be placed throughout
the entire basement wall footing excavations.
Based on our field observations, the bearing conditions observed are expected,to provide
adequate support for the proposed residential structure. Our conclusions are. based on the
assumption that soils conditions with depth are as good as or better than -those observed at
the bottom surface of the garage footing excavations.' The... ek6avation dimensions
appeared to be in accordance with the approved plan minimum specifications.

INTRODUCTION
As requested and authorized by Ms. Deborah Rurik-Goodwin of Multicon Builders, Inc., Geotechnical
Consultants, Inc. (GCI) has performed a preliminary and limited subsurface exploration for the proposed SW
Dublin Golf Community Project to be located west of Columbus (Ohio) in Washington Township, Ohio.
Bird Houk & Associates provided GCI with preliminary site development information prior to drilling. No
final site or grading plans have been developed. Our report does not address environmental issues.
The intent of this report is to provide the results of the drilling program, evaluate general subsoil conditions
encountered and offer preliminary recommendations relative to anticipated development. After completion of
grading and utility plans, a review of subsoil conditions and additional borings will be necessary at specific
building locations.
Our study consisted of 30 standard penetration borings performed across the site and walk-over site
observations. Copies of the test boring logs are appended to this report and the approximate boring locations
are shown on the attached sketch. We have attached a sketch showing the approximate boring locations and
copies of the boring logs. Boring locations were established visually from assumed property boundaries and
site landmarks. We placed wood stakes near the majority of our drill holes so that M-E Companies could
include the hole locations in a survey of the area, however several of the stakes were removed by farmers
during plowing.
This report has been prepared for the exclusive use of Multicon Builders, Inc. and their consultants for
specific application to the referenced SW Dublin Golf Community Project in Washington Township, Ohio in
accordance with generally accepted soil and foundation engineering practices. No other warranty, expressed
or implied, is made.
SITE AND PROJECT DESCRIPTION
The site is irregularly shaped, approximately 550f acres in total size and located within an existing
residential and agricultural area, west of Columbus, Ohio in Washington Township, Ohio. Shier-Rings Road,

houses and farmland border the north portion of the project. Farmland and houses, with Avery Road further
east border the east portion of the site. Rings Road, houses, farmland and railroad tracks bound the southern
portion of the property. Cosgray Road, houses and farmland border the western portion of the site. A
general site location map is attached to this report.
The subject site contains several residences, farm fields, treelines and wooded areas on approximately 550
acres. Woemer Temple Road generally bisects the property in an east to west direction. Kramer Ditch enters
the southeast portion of the site and Cosgray Ditch enters the northwest portion of the site. A high pressure
gas line enters the north portion of the site on the eastern quadrant.
Proposed :construction is to consist of a mixed-use development to include single and multi-family
construction, retail and light commercial areas, a golf course, lakes and associated roadways and utilities. We
suggest that GCI review the final site plans and provide additional recommendations, if needed.
SUBSURFACE CONDITIONS
On October 19, 1999, GCI mobilized two, truck-mounted, rotary drill rigs to the site and drilled 22 Standard
Penetration test borings across accessible portions of the property. Several areas on the eastern portion of the
site were not accessible due to existing crops. We returned to the site on November 8, 1999 (once the crops
had been removed) and performed 8 Standard Penetration borings in the areas not accessed during the first
visit. The borings were extended to depths of 13.5 to 15 feet below existing grades. Approximate boring
locations have been indicated on the attached Boring Location Plan.
Surface Cover
The borings encountered surface topsoil, ranging in thickness from 0.3 to 0.9 feet. Note that topsoil
thicknesses can vary between borings and within wooded or low areas.

Beneath the topsoil cover, natural soils generally consisted of brown glacial till consisting of clay-silt with
embedded sand and gravel. The brown till was stained dark in several borings, to a depth of 1.5 feet below
existing grades. Borings B-1, B-12 and B-29 terminated within the brown till at respective depths of 13.5, 15
and 15 feet below existing grades. The till changed color to gray in the remaining borings, at depths ranging
from 7.5 feet to 13.5 feet below existing grades. The gray till normally contains more embedded sand and
gravel and is less plastic than the brown till. Thin to thicker sand and gravel lenses and seams were
encountered within the till. Borings B-2 to B-11, B-13 to B-28 and B-30 terminated within the gray till at

depths of 15 feet below existing grades. Standard Penetration N-valves recorded in the natural soils indicate
the tills are generally stiff to very stiff in cohesive consistency, with several random medium stiff samples
noted.
Bedrock
Bedrock was not encountered within the limits of the borings (maximum 15 feet). Where deep (over 15 feet)
sewers are designed, additional borings should be performed along the sewer alignment.
Groundwater
Groundwater seepage was observed in B-10 at 7.5 feet and within B-24 at 8 feet below existing grades,
within a perched sand and gravel seams of the till. Seepage was not noted within the remaining borings
during or after completion of drilling. Note that groundwater observations and levels fluctuate due to
changes in precipitation, climate, stabilization time, and other factors that may differ from the time the
measurements were made. The driller characterized the retrieved soil samples generally as "moist".
ANALYSIS AND CONCLUSIONS
GEOTECEMCAL EVALUATION
A generalized subsurface profile consists of a variable ft th_topsoil cover overlying natural till soils. The
natural soils found beneath the surface topsoil are considered suitable for the support of the anticipated
housing and relatively light commercial - buildings on shallow spread footings. Pertinent geotechnical
considerations are discussed below.
Surface topsoil, vegetation and stumps from removed trees should be removed from below building and
pavement areas prior to construction. The natural clay based site soils can become unstable if saturated.
Careful routing of construction traffic is advised to help minimize instabilities of near surface soils during wet
seasons. Depending on the time of year of construction, the natural soils may be "very moist". The practical
ramifications of this for site preparation are that site soils may require stabilization prior to any fill placement.
Under favorable drying conditions (late spring and summer), a subgrade stabilization program consisting of
disking of the soils to enhance air-drying followed by recommended compaction is expected to be sufficient.
During wet seasons (late fall, winter and early spring) air-drying may not be practical, and the use of lime may
be required to complete subgrade stabilization. Use of No. 2 stone, punched into the subgrade as a bridge lift, is
also feasible if the site is to be filled. Off-site fill or fill from any site cuts or borrow pits may also require
drying to achieve compaction, depending on the time of year of the earthwork.

Soft/wet subgrade conditions may result in additional materials being removed during surface stripping due
to rutting and pumping of the subgrade soils. If work is to be performed during traditionally drier times of
the year (late spring or summer), problems associated with soft subgrade soils are expected to be minimal.
FOUNDATIONS
Continuous wall and column footings bearing in either the natural soils or properly compacted fill soils are
feasible and should be designed for a gross allowable bearing capacity not to exceed 3,000 pounds per square
foot. Regardless of the calculated values, a minimum width of 16 inches for wall footings and 30 inches square
for column footings is recommended. Placement of fill within building areas should be completed to finished
subgrade elevation prior to excavation of foundations. Exterior footings should have a minimum soil cover
equal to the local frost code depth (32" for Columbus, 36" for Dublin). Interior footings can be placed shallow
as feasible provided proper bearing is achieved.
If soft soils are encountered at footing subgrade, undercut to stable soils. Undercut areas can be brought to
footing subgrade using controlled density fill such as K-Crete.
SEISMIC FACTOR
The borings encountered stiff to very stiff glacial till. Bedrock was not encountered within the maximum 15-
foot depths of the borings. Based on available information we would characterize the site as a soil type S,
and accordingly a site coefficient of 1.0 is recommended.
BASEMENT AND GARAGE FLOOR SLABS
It is recommended that a minimum of four inches of granular fill (washed crushed stone or stone and coarse
sand) be placed beneath at-grade building floor slabs to prevent capillary rise of ground moisture. This layer
should be 6 to 8 inches thick below basement slabs to enhance drainage to a sump pit. A vapor barrier is
normally recommended for below grade slabs and where floor coverings can be adversely affected by water
vapor. Any basement excavation with unstable or fill soils at footing depth should be brought to our attention
prior to over-excavation.

RETAINING STRUCTURES
Retaining walls restrained at both top and bottom should be designed to resist at-rest lateral soil pressures, plus
any surcharge loads from adjacent slabs. The design loading depends on the type of backfill material used. The
following equivalent fluid pressures are recommended:

(Placed with some compactive effort)
Free-draining sand and gravel is the recommended backfill material behind all walls designed as retaining
structures. This fill should be placed in a wedge shaped area extending from the base of the wall upward at an
angle of 35 degrees from the vertical to use the lower design values. Cohesive soil is not recommended as wall
backfill due to its poor drainage characteristics and potential for lateral wall loads resulting from surface frost.
We recommend that exterior footing drains and underslab drainage leading to a permanent sump be installed for
below grade slabs to minimize the build-up of hydrostatic forces behind the wall and below the slab.
EXCAVATIONS AND GROUNDWATER
Bedrock was not encountered in the borings (maximum drilled depth of 15 feet). The natural clay-silt site soils
can be excavated with conventional track hoe equipment. All excavations should comply with current OSHA
regulations.
Borings B-10 and B-24 encountered groundwater seepage at respective depths of 7.5 and 8 feet below existing
grades. We do not anticipate that groundwater will pose significant problems with shallow footing, utility or
basement excavations. If water is encountered in site excavations, the excavations should be dewatered to allow
footing construction and backfilling in dry conditions. Additional waterproofing requirements may be needed
in areas where a basement excavation encounters flowing water. Use of working mats of crushed stone and
local sumps should be sufficient for the anticipated seepages related to the perched sand and gravel. Seasonal

wet subgrades may cause subgrade stability problems during site preparation. Subgrades should be brought to a
stable condition prior to placement of fill. These have been discussed elsewhere in this report.
SLOPES
The steepest recommended fill slope without soil reinforcement is 2 (Horizontal): 1 (Vertical), assuming soils
are compacted as a structural fill. Although a 2(H): 1(V) cut slope is considered stable, 3(H): 1(V) is
suggested and will aid in the establishment of vegetation and feasibility of mowing.
PONDS
"Wet" ponds can be constructed within the site clay-silt soils. Gouge out isolated sand and gravel layers to
provide a minimum of 18 inches of compacted clay-based soil fill. If thick sand and gravel layers are
encountered, an 18-inch thick clay layer will be needed to retain water. Water seepage from any wet,
saturated sand and gravel layer will have to be controlled to construct a clay-based soil pond liner.
PAVEMENTS
The glacial till soils typically found in Central Ohio have soil subgrade CBR values ranging from 2 to 6. A
roadway pavement design is beyond the scope of this report. GCI can provide one if requested. This would
require additional laboratory testing and traffic count criteria.
As a matter of practice, roadway pavement areas should be steel-wheel rolled to a smooth surface prior to
placement of aggregate base material. Subgrade preparation during wet seasons may require the use of
engineering fabric or geogrid. Some adjustment in pavement section thickness may be necessary in the field if
softer soils are encountered at actual subgrade. Providing adequate subbase drainage is critical to future
roadway pavement performance. Weep holes in all inlets and under drains in any swales are suggested and
should be designed by the site civil engineer.

SITE PREPARATION AND EARTHWORK
As a general approach to the site preparation, the following is recommended:
1. Remove any surface organics, vegetation and stumps (from tree removal) from beneath proposed
building and pavement areas.
2. Perform any required cuts and carefully proof roll all pavement and building area subgrades. Soft areas
should be stabilized by disking and drying or other appropriate methods.
3. Natural non-organic site soils are acceptable for use as structural fill. Some moisture adjustment may
be necessary, depending on weather conditions at the time of earthwork. Any off-site borrow
should be approved by GCI prior to its use.
4. Place all fills in 8-inch loose lifts and compact to 98% of the optimum Standard Proctor dry density.
The moisture in the site soils should be controlled to within ±3% of the optimum Standard Proctor
moisture content. Site soils are generally cohesive and will compact best with a sheepsfoot roller. Any
sand and gravel soils will compact best with a vibratory roller.
Excessive moisture will make earthwork difficult with the cohesive site soils. Use of lime can be
designed into a wet weather fill operation, but is not advised unless air drying is not possible. Some
care also would be advised with respect to construction traffic patterns so as to avoid excessive: _
pumping of the subgrade soils.
5. After fill placement for the building pads is completed, excavate for footings. Footings may bear in
existing or new fill or natural site,soils. Undercut any isolated soft zones to achieve firm bearing
conditions.
6. Pavement areas should be steel-wheel rolled to a smooth surface prior to placement of base aggregate.
Subgrade preparation during wet seasons may require the use of engineering fabric or geogrid.
7. It is recommended that this firm be retained to observe proof rolling operations, cut and fill
operations and footing excavations.
8. If work is performed during the winter (e.g., when freezing temperatures occur), special protective
measures will be required during filling and footing construction procedures. Contact GCI for
additional cold weather recommendations, as needed.
FINAL
We recommend that GCI be provided the opportunity for general review of the final project plans and
specifications in order that earthwork and foundation recommendations be properly interpreted and
implemented. In the event that any changes in the nature of the development are planned, conclusions and
recommendations contained in this report shall not be considered valid unless changes are reviewed and
conclusions of this report are modified or verified in writing.

The recommendations given in this report are the professional opinion of Geotechnical Consultants, Inc.
based on available information and subsurface findings and the assumption that this project will be properly
constructed and maintained. Recommendations of this report may be modified based on the final
development information, findings of any new borings and construction observations.
It should be noted that the nature and extent of variations between borings might not become evident until
construction. If variations then appear evident, it will be necessary to re-evaluate the recommendations of
this report. This report is for preliminary design purposes only and is not sufficient to prepare an accurate bid
document.

If we have any soil data for Ballantrae or any of our subdivisions this may be adequate to
resolve a problem that we are going to be faced with in the near future. Charlie, can we
get this info. from you or the Geotech company that may have done testing.
As a result of building departments adopting the 2004 Residential Code of Ohio we will be
looking at several new requirements. One area will be soil bearing assumed as 1500 psi
vs. 2000 psi (Dublin) and 3000 psi in most other areas. We could see 1500 psi enforced in
just about every location that we build.
This could be expensive to have our Structural engineer go back and check many of our
houses. We may just have to increase all pad sizes to work for all cases. Currently our
houses show from 24"sq. to 48" sq. conc. pads, depending on how the beam is loaded. This
could even affect our footing width and depth when we have 2-story brick veneer. Width
and Height could increase to 2011(w)x10"(d) i.l.o. 16"(w)xB"(d). Dale is looking into 1-
story brick and brick water tables as they would pertain to footing sizes.
Are we to a point where we have soils testing done to keep our plans as shown.
Chris/Charlie do you know how much it could cost per house to supply minimum data to make
Dublin happy?
I can not imagine that the soil Cpl f less the 2000 psi generally. There may be
some areas that are except4 to be allot of rock out there vs. soft
clay. ~w.
In my limited amount of what I have found so far. There may well
be other areas this will - loads are going to be a factor as well.
Shear walls, every 25-30 `v re already being enforced for Single
Family homes in the City c _-ding departments communicate with each
other on these J `
issues, meaning we will be other municipalities.
