The list of items, which is attached to and is a part of the agreement, is accepted by both the Project Manager/General Contractor and the Owner/Occupant, documentation of those items necessary to be completed prior to the project receiving final approval. 4. Acknowledging that the premises are not completed and that certain items, as shown, are requirements of the Code of the City, the Owner/Occupant, requests that the City allows occupancy of the premises and use of the property as of the date of this agreement. 5. In return for such above Conditional Approval, the Project Manager/General Contractor agrees to complete all items as shown by (date) d and further agrees to release, hold harmless and indemnify the City and its agents, assigns and employees from any and all obligation, liability, and/or responsibility that might arise as a result of permitting occupancy under a Conditional Approval Agreement. 6. In return for the City allowing conditional approval, the Owner/Occupant hereby releases the City, its agent, assigns and employees from any and all obligations and/or responsibilities related to the completion of the premises, and further agrees to release and hold harmless the. City, its agents, assigns and employees from any and all liability that might arise as a result of occupancy of the premises. The Owner/Occupant acknowledges that he is under no obligation whatsoever to enter into this Agreement, but that absent this Agreement, Conditional Approval to use the property will not be granted. 9. (GC1) representative reported to the above referenced house on July 30, 2007 to observe foundation soils at design grade, Construction consists of a wood-framed structure with poured concrete foundation walls. Approximately three-fourths of the basement was excavated prior to our arrival. Sidewall pbservations indicated a profile of approximately 4 to 6 feet of existing fill underlain by 2 to 3 feet of natural stained brown clayey silt. This house is designed to have a "walk-out" basement. The "walk-out" footing encountered natural brown to brown mottled gray lean clay with limestoaner cobbles at design footing grade. Based on past experience with adjacent lots, the lean -,clay eventually grades to a saturated silty sand and gravel. Water seepage in the "walk-out» "footing was measured to be about 3 to 4 inches deep. The water seepage may stabilize near the level of the creek located along the rear property boundary. GCI does not have documentation pertaining to the till placement. This lot appears to be the last vacant lot in the development and the development appears to be "established" with older, homes. We do not know how long ago this 'fill was placed. Probing of the existing fill at desig n bearing grade towards the front of the basement using a 0.5-inch diameter metal rod indicated firm and stable conditions. The existing; fill consisted of "clean" brown lean clay and appeared to have been compacted when placed. The fill transilioned into the stained layer within 30 feet of the rear, "walk-out" wall footing. It appeared the top of the stained layer that consisted of "friable" soil (topsoil) and root mat was removed from the wall footing excavations by design. The topsoil layer was more prominent in the rear portion of the basement and appeared to be "stripped" prior to fill; placement towards the front of the basement. Based on our site discussion, front porch wall footings will-be extended to basement grade. It appears garage wall footings will bear in 3 to 4 feet of existing fill. Probing of the natural soils at design beating grade using a 0.5-inch diameter metal rod generally indicated firm and stable conditions. Several, isolated questionable areas were encountered during probing. The first was to perform undercuts through existing fill to natural, stable soil. This option probably would affect the garage wall footings only. The second option was to not perform undercuts and install a minimum of two #5 steel reinforcing bars in all wall footings; also in part due to isolated areas of softened, natural bearing soil. This option involves more inherent risk to the builder because of the perceived "undocumented" fill. The second option was chosen. during our visit. Site plans indicated interior column footings (mats) are designed with the installation of re-steel. We also understand the poured concrete basement foundation walls have horizontal wall re-steel installed by design. The re-steel should be placed near the top (1' from top of wall) and bottom (1' from top of footing) portions of the wall to help create a "grade-beam'.` effect " a precautionary measure, if not already designed. The garage stem walls should also have top and bottom re-steel installed prior to concrete placement as a precautionary measure. GCI suggests tl..),e floor slabs be designed to "floaf' independently of foundations and wall elements as a precautionary measure.
