The premises, as of the date this agreement is signed; has not met all requirements of the Dublin Codified Ordinances, hereinafter known as the Code, and therefore additional final inspections cannot be approved. 3. The list of items, which is attached to and is a part of the agreement, is accepted by both the Project Manager/General Contractor and the Owner/Occupant, documentation of those items necessary to be completed prior to the project receiving final approval. 4. Acknowledging that the --premises are not completed and that certain, items, as shown, are requirements of the Code of the City, the Owner/Occupant, requests that the City allows occupancy of the premises and use of the property as of the date of this agreement. 5. In return for such above Conditional Approv 1, tbp Project. Manager/General Contractor agrees to complete all items as shown by (date) and further agrees to release, hold harmless and indemnify the City and its agents, assigns and employees from any and all obligation, liability, and/or responsibility that might arise as a result of permitting occupancy under a Conditional Approval Agreement. 6. In return for the City allowing 'conditional approval, the Owner/Occupant hereby releases the City, its agent, assigns and employees from any and all obligations and/or responsibilities related to the completion of the premises, and further agrees to release and hold harmless the City, its agents, assigns and employees from any and all liability that might arise as a result of occupancy of the premises- Further, the Owner/Occupant accepts the responsibility for the completion of those items shown as incomplete, and recognizes that the City may revoke the Conditional Approval \\DUBLINDATA PER SERVER\PER\PER\THOMMOFFICE\wP\DOCS\DO(VORMS\CONDITiONAL OCCUPANCY AGREEMENT.doc Page 1 of 2 Updated 402 Agreement causing the premises to be vacated; and/or the City may initiate legal action, if these items are not completed on a timely basis, and within the schedule contained in item 5 of this agreement. The Owner/Occupant agrees that the City or its agent shall have full access to the property to inspect, or at it's sole and exclusive discretion cause to be made any improvement necessary to bring any part of the premises into compliance with this Conditional Approval Agreement. 7. The Owner/Occupant and the Project Manager/General Contractor both agree that the City, by accepting this Agreement in allowing occupancy as of the date of this Agreement has in no way waived, forfeited or otherwise relinquished any rights and/or powers that it would have if this Agreement were not in effect. 8. The Owner/Occupant acknowledges that he is under no obligation whatsoever to enter into this Agreement, but that absent this Agreement, Conditional Approval to use the property will not be granted. 9. This Conditional Approval Agreement will serve as the Temporary Occupancy Permit the Building Official may issue in accordance with 4101:2-1-27(E) of the Ohio Administrative Code when the entire scope of the building work has not been completed, but the Building Official has determined the building can be. occupied safely. This is letter will be required to be on record for Dublin Inspections to allow us to pour with temperatures below 28 degrees, please let me know if this would be a accepted method. In addition to your suggested cold weather pouring method the structural engineer has given the following guidelines and shall be considered addendum to specifications for concrete work: Swifications for pouring concrete slab at air temperature of 20 F or higher 1. Before pour verify that subgrade 12" and 18" below exposed surface is at 50 F or higher by digging a 12" test pit into subgrade and measuring the subgrade with a thermometer within 10 minutes of the hole being opened. Place compacted fill and restore vapor barrier penetration. 2. Remove hydronic heating tubes the day of the pour and bring reinforcing to correct level in the stab section 3. Within 20 minutes prior to pour verify in at least two spots that the surface of subgrade, immediately below the vapor barrier is above 45 F. Restore vapor barrier penetration. 4. Concrete Ready-Mix shall be 60 F upon arrival at the job site but the aggregates shall not be heated above 150 F in plant. 5. After placing concrete maintain slab surface temperature at 50 F for three days. At a minimum the hydronic heater lines shall be placed onto slab after the concrete finish is stable enough not to be marked. Blankets shall be placed atop the hydronic heater lines immediately after the lines are placed. Maintain extra insulation along edges and points of the concrete work. 6. Contractor to be aware that the concrete hydration is significantly retarded at colder temperatures. The stab will not be suitable for heavy wheeled traffic such as cranes for an extended period of time. 7. As represented to us, the Field Inspector had concerns over the number of fasteners used at various sheathing conditions and the typical track splice as follows: 1. The #10 screw spacing was more than the 4" o.c. called for at the perimeter of the shearwall. 2. The #10 screw spacing at the shearwall field should have been 4" o.c. 3. The #10 screw spacing at the typical sheathing was 2'-0" in some locations. 4. The splice detail shown in 1 & 4/S.501 was not installed according to the detail. We have investigated the above comments in relation to the governing 2007 OBC and hereby provide the following responses: 1. The maximum design load required for the exterior shearwall was 300 PLF (pounds per linear foot) of shear. The use of #10 Sheet metal screws at 4" o.c. as specified on the perimeter of the shearwall as specified would provide 705 PLF of available shear strength which exceeds the maximum design load. 2. The change in perimeter spacing to 6" on center as installed would still provide 455 PLF of allowable shear, also exceeding the design load and adequate to resist the design loads. The 6" spacing would therefore be acceptable to our design criteria. Both values were taken from Table C2.1-1 of the AISI Standard for Cold formed Steel Framing -Lateral Design document as referenced by the 2007 OBC and factored by a safety factor to determine the available shear strength. 3. Per AISI-Lateral Table C2.1-1 #10 screws are to be applied at 12" o.c. in the field of the panel as called out on Sheet 5.501. 4. We understand that the Field Inspector and Contractor have discussed the installation of a 4" x 16 Ga. strap installed to the inside face according to Detail SK-6, as issued in our RFI Response dated February 21, 2008. This additional step would certainly be acceptable and would be adequate to take the full design loading. If used, the diagonal I strapping should run diagonally from opposite corners of the shear panel. As an alternate, at typical wall locations where installed spacings exceeded those specified, it is acceptable for the Contractor to drive #10 sheet metal screws at 6" o.c. from the inside of the wall, through the metal stud flange into the wood sheathing. 6. The Contractor may use either stud or track material in the splice detail shown on our Details 1/- and 4/5.501 as long as the splice was made with same number and size of fasteners shown. The track insert and the running track should be of the same gauge as the wall studs used at the splice. The referenced details require that (4) #10 screws be installed to each side of the joint. Should the Contractor desire, the screws may be driven through the 6" web in Detail 1. With either case, a minimum edge spacing of 3/8" is to be observed. While not noted by the inspector, we observed that the typical truss clip had been installed to the interior side of the wall. Detail 2/S.501 showed the clip to be installed on the exterior face where the sheathing adds strength and be tter transfer to the ground than the drywall panel. This can be remedied by the installation of the same Simpson LSTA12 strap specified for the exterior face (1-. '/a" x 20 Ga. strap). It. should be installed in a length of 6" to the interior vertical flange of the metal stud with.(2) #12 screws and then to the vertical surface of the double wood top plate with (2) 10d nails. We appreciate your time spent inspecting the structural framing and your comments. Please let us know if you have additional comments or if the Field Inspector's comments have been misrepresented.
