The revisions dated 10/23/2007 to the plans dated 9-18-2007 for the captioned project have been reviewed
for compliance with the provisions of the Ohio Building Code (2007). The review was based upon the
following criteria:

2. A ducted return air system has been provided.
The architectural documents are sealed by William R. Davis, Ohio registered architect #5261, the HVAC
and plumbing documents by Sur it S. Sandhu, Ohio registered engineer #E36971, and the electrical
documents by Robert P. Gedeon, Ohio registered engineer #E34690, to comply with the requirements of
the OBC Section 106.3.4.1 and have been reviewed, therefore, in accord with OBC Section 104.1.
OBC 106.3.1 Approval of construction documents. When the construction documents have been
determined to conform to the applicable provisions of the rules of the Board in accordance with the
procedures set forth in Section 105.3.1, the building official shall endorse or stamp such plans as approved.
One set of construction documents shall be kept by the building official. The other set(s) shall be returned
to the applicant, kept at the work site and shall be open for inspection by the building official or the
building official's designated representative.
This APPROVAL does not preclude the acquisition of separate permits for plumbing, mechanical,
sprinkler or electric. Permits and fees for these items must be obtained from the Building Division prior to
the start of any work in these areas.
The following items are required for code compliance, but are not necessarily covered in detail in the
construction documents. This list is a reminder to the design professional and contractors of issues which are
to be satisfactorily dealt with in the field.
Item A OBC 106.3.1 Approval of construction documents. When the construction documents have
been determined to conform to the applicable provisions of the rules of the Board in accordance
with the procedures set forth in Section 105.3.1, the building official shall endorse or stamp such
plans as approved. One set of construction documents shall be kept by the building official. The
other set(s) shall be returned to the applicant, kept at the work site and shall be open for inspection

by the building official or the building official's designated representative.
Item B OBC 105.7.2 Posting. The certificate of plan approval shall be posted in a conspicuous location
outside of the building and in the front part of the premises on which is, or will be the approved
building or equipment to which the approved plans relate. The owner and the contractor shall, so
far as possible, preserve and keep the certificate posted until the completion of the work to which
the approved plans relate.
Item C OBC 106.4 Amended construction documents. If substantive changes to the building are
contemplated after first document submission, or during construction, those changes must be
submitted to the building official for review and approval prior to those changes being executed.
The building official may waive this requirement in the instance of an emergency repair, or similar
instance.
Item D OBC 1103.2.1 Specific requirements. Accessibility is required in buildings and facilities, or portions
thereof, to the extent indicated in ADAAG Section 4.1 and this chapter.
Item E All electrical will comply with the requirements of Article 27 OBC and the National Electrical Code,
NFPA 70, OBC approved edition and is subject to the approval of the electrical field inspector.
Item F The existing electrical conductors, if removed, abandoned, or altered, shall be accomplished to the
electrical field inspector's approval. Electrical work found not to meet the code's standards shall be
corrected to the electrical field inspector's approval
The start of construction indicates acceptance of all of the conditions listed above. This review does not
preclude the necessity to conform with provisions which may have been omitted or overlooked in the review
process, but which are requirements of the code. Ultimate responsibility for legal compliance with the
Standards of Safety rests with the registered design professional, the tenant and the owner. Approval will be
valid only upon receipt by the City of Dublin, Division of Building Standards, of one signed copy of this
addendum to the submitted plans.
TO REQUEST AN APPEAL HEARING, YOU MUST sent a written request, listing the items to be

Code.

This memo is a response to the attached e-mail which was sent to Jane Brautigam, City
Manager by Judy Beal, Assistant Clerk of Council, on October 23, 2007. You will note that Ms.
Cindy Olsworth was concerned about the status of the Davita building permit, a permit that is in
the process of being reviewed and issued. I have also attached the Commercial Permit Review
History concerning this permit and all associated, pertinent documents in order to present a
complete chronology of events to you.
The permit took a total of 49 days to be reviewed, that review included two re-submittals by the
applicant. There was never any time in which our in-house reviews exceeded our self-imposed,
25-day deadline, thus there was never any time in which we exceeded the state statutory
requirement of 30 days.
Also of note, are the various e-mail "conversations" that were held between staff and either the
applicant or the owner.
Finally, there is an attached chronology from Jan Rozanski explaining the specific events
surrounding the Building Standards' stars conversations with the woman who we now know
was Ms. Olsworth.

Hi, Jane.
In the event this inquiry is also forwarded to Council or your office; we wanted to make you aware of the phone call we
received yesterday afternoon and how it has been handled.
1. Cindy Olsworth called to inquire how to contact Council to learn the status on a building permit that has been denied.
The permit is for a dialysis center. Her husband must receive dialysis treatments. When they learned their doctor would be
relocating to Dublin when his new building was completed, the Olsworths moved 'across the street" from the new building
to be near him.
The building permit was initially denied. She has been informed that, although ifs been some time, a second submittal has
not yet been approved. Is it also being denied? The time involved in this process means that their doctor may be vacating
his present location and not relocating anywhere for awhile. If that occurs, she has been advised that she will need to seek
treatments for her husband elsewhere for awhile.
She called the Building Department about the status and was told she could go online and check the status of the permit.
She tried to do that, but could not. She just wanted to know the status on the permit was it a slow approval process, or
were there issues that were going to require her to investigate other options for her husband?
I told her that actually Council wouldn't know the status on the permit without first contacting the Building Department.
And since she had rot really been able to do that - if I could get the name of someone there for her to talk to, would she
want to do that first? Then, if she still didn't have satisfactory answers, she could certainly talk to Council. She agreed.
I called Building Dept and reached Jan Rozanski, who advised that Steve Snider would be able to tell her what the issues
were and a time frame for approval. I called Ms. Olsworth back and provided Steve Snidees # and told her to call us back
if she continued to have questions after speaking with him.
2. Jan called our office this AM to update us. Ms. Oisworth caged the Building Dept immediately after speaking with us and
actually reached Jan. After he spoke with her, Steve Smith, Jr. also caged him. Since then, he has faxed copies of the
City's correspondence to the architect, including the list of issues, to Steve Jr. Ray Harpham has informed him that with
the first permit submittal an extensive list of issues were identified. The list was sent to the architect. The architect
responded, addressing only 50%. Ray Harpham has been attempting to get the architect to provide the additional
information so that he is not forced to deny the permit again. So, its an architect issue ...and Steve Jr. is on it.
(Jan says that the has heard "through the grapevine" that Steve Jr.'s wife may work for this doctor... not sure??????)

We believe that the 2005 NEC (NFPA 70) requires emergency power for the dialysis machines and point to the following as the
basis for that position:
NEC 517.25 Scope The essential electrical system for these facilities shall comprise a system capable of supplying a limited
amount of lighting and power service, which is considered essential for life safety and orderly cessation of procedures during the
time normal electrical service in interrupted for any reason. This includes dinia, medical and dental offices, outpatient facilities, .
and other health care facilities serving patients.
NFPA 99 (2005)14.[Odw Health Care Fadlides]3A.2 Essential Electrical Distribution System. The essential electrical
distribution shall conform to a Type 3 system as described in Chapter 4.
NFPA 99 (2005)14.10ther Health Care Fadlitties]3A.2. 2 If Critical Care areas are present, the essential electrical
distribution shall conform to a Type 1 system as described in Chapter 4.
NFPA 99 (2005) 33.138.1 Critical Care Areas.... and similar areas in which patients are intended to be subjected to
invasive procedures and connected to line operated, patient-care-related electrical appliances.
NFPA 99 (2005) 4.6.2.2.2 Connection to the Essential Electric System [Type 3]. (Wftd we read) The system shall
supply power (1) for task illumination that is related to the safety of life and (2) that is necessary for the safe cessation of
procedures in progress.
and, for what it is worth, the state of Oregon, Dept of Human Services, Public Health Division currently maintains Licensing
procedures of outpatient renal dialysis facilities that, in section 333-700-0130, requires, among other things, that all facilities initially
licensed or constructed after 3uly 1, 2003, be made to allow connection to an alterative power source and that the alternate power
source provide on-going power for lighting and continued provision of dialysis services.
It has been represented to us that no other jurisdictions have required emergency power for the your dialysis units. We would
appreciate someone with DaVita being a part of the conference that would help us understand how the NEC can be interpreted to
establish that the dialysis machines should not be provided with emergency power. It may also be helpful to have someone
available that would be able to communicate the nature of the procedure and the risks to which patients are exposed when a power
outage occurs.

was to the design architect and applicant for the permit. It was intended to confirm the portion of the conversation regarding the
electrical issues that I instigated on Oct 17 after preliminarily reviewing his resubmitted documents.

Applicant was advised that the resubmission was 10-14 days away from review because of the current number of applications
pending and that insufficient or incorrect information was provided for the following matters identified in the initial correction
request:
1. The 2004 Energy Code was used instead of the 2006 Code required by OBC;
2. Graphics had not been provided for rated assemblies and fire stopping as had been requested;
3. It was important to indicate on the drawings where the wheelchair storage and coats were to be located that were not permitted
to be in the vestibule as was shown on the original submission;
4. Proper clearance for the electrical panels had to be provided; and,
5. A description of the Dialysis Procedures needed to be provided.
And that if the infor nation/revisions could be provided to our office within 10 days we would be able issue a full approval rather
than another correction request.

Shortly before 5:00 p.m. I received a call from Judy Beal (Assistant Clerk of Council) regarding a
building permit for Davita, Inc. A woman (do not have her name) called and wanted to know
why we had not issued a building permit for Davita, Inc.
While I was still speaking with Judy, the woman called my phone, at which time I ended my call
with Judy and took the call from the woman. The woman's concern was that we were holding up
the permit and that her dad needed treatment (dialysis), with us not issuing a permit, it would
create a hardship for both her and her father. I gave her Steven Snyder's (Review Services
Coordinator) name and phone number so that he could advise her of the status of the permit
application.
Shortly after her call, Steve Smith, Jr. (legal counsel) called with the same questions. I gave Mr.
Smith the same information. After speaking with Mr. Smith, I went upstairs to see Ray Harpham
(Commercial Plans Examiner) to find out for myself where the permit stood. By this time, Ray
had also received a call from Mr. Smith concerning Davita, Inc. After speaking with Ray and
another call with Mr. Smith, we felt that Mr. Smith had enough information to speak with the
woman intelligently.
The following day, I was informed that Robyn Harp (Permit Office Assistant) had spoken with
this same woman approximately one hour prior to the call I received. Robyn had informed the
woman of the status of the permit, plus Robyn gave her the permit number and how to access the
website to track the status of the permit herself.
I feel that too many people and too much time were spent on this (4 people from our office, plus
the Council Assistant and Legal Counsel, and still not including the time you have spent
reviewing the issue). We don't even know if this woman is a Dublin resident.

We have typically considered a door in the open position that encroaches upon 3'-0" required Depth of Working space to not comply
with the requirements of NEC 110.26(A)(1). Please relocate the panel or the door.
Your response to Item 5 induded a reference to NFPA, Annex B, Paragraph 61.4.1. Missing, I believe, is which NFPA Publication
contains the referenced annex B. I also note that you described what the procedure is not rather than what it is.
Please have the procedure described in detail. In parkular we are interested in the impact of a power outage on 12 very young or
aged, frail patients in the middle of a procedure. It will help us in our decision regarding the need for emergency power to the
equipment.

The architectural documents are sealed by William R. Davis, Ohio registered architect #5261, the HVAC
and plumbing documents by Sur it S. Sandhu, Ohio registered engineer #E36971, and the electrical
documents by Robert P. Gedeon, Ohio registered engineer #E34690, to comply with the requirements of
the OBC Section 106.3.4.1 and have been reviewed, therefore, in accord with OBC Section 104.1.
OBC 106.3 Examination of documents. The building official shall examine or cause to be examined
the accompanying construction documents and shall ascertain by such examinations whether the
construction indicated and described is in accordance with the requirements of this code.
The construction documents, which have been submitted, do not allow the City of Dublin to issue a permit
to begin construction. The following item(s) shall be brought into full compliance with the the
requirements of the OBC prior to the issuance of any plan approval.
Item 1 106.1.1 Information on construction documents. Construction documents shall be
dimensioned and drawn upon suitable material. Electronic media documents are permitted to
be submitted when approved by the building official. Construction documents shall be
coordinated and of sufficient clarity to indicate the location, nature and extent of the work
proposed and show in detail that it will conform to the provisions of this code. Construction
drawings shall include information necessary to determine compliance with the building,
mechanical, plumbing and fire protection codes such as:
a. 8. Ratings. The fire-resistance ratings of all structural elements as required by this
code, data substantiating all required fire-resistance ratings, including details showing
how penetrations will be made for electrical, mechanical, plumbing and communication
conduits; pipes and systems and the materials and methods for maintaining the required
structural integrity, fire-resistance rating and firestopping.
i. Please provide, on the drawings, the complete UL #U404 assembly available for

ii. Reference is made in the Wall Legend, Sheet A-1, to the rated assembly being
tight to the metal deck above. The structure is VB Wood Frame and the shell was
approved for wood roof sheathing. Please provide site-specific interior wall
sections that indicate how the wall will be terminated and how the truss member
penetrations of the rated assembly will be protected.
iii. Please provide graphic illustrations of through penetrations, required by OBC
712.3. of the rated walls
iv. The walls between Rooms 108 & 109 and 115 & 116 are f re-resistance rated one
hour. Please provide installation details for EH2 that maintain the required one
hour rating.
b. 9. System descriptions. Complete description of the mechanical and electrical
systems, including: materials, routing, and sizes of all piping; location and type of
plumbing fixtures and equipment; plumbing schematics and isometrics; materials,
routing and sizes of all ductwork; location and type of heating, ventilation, air
conditioning and other mechanical equipment and all lighting and power equipment
i. Provide the Reports for the lighting and HVAC systems that indicate compliance
with the applicable provisions of the 2006 International Energy Conservation
Code or the requirements of the 2004 ASHRAE 90.1 listed in Chapter 35 of the
code. Please insure that the mechanical and electrical drawings indicate
compliance with Section 3: Requirements Checklist for Lighting and Section 4
Requirements Checklist for Mechanical
ii. Please remove all reference to "as required" and "as required by the local
authority "from the documents. The authority having jurisdiction will review the
documents submitted for compliance with the 2007 Ohio Building Code. In
matters involving technical design analysis of work affecting public health or

electrical, plumbing or fire protection, the decision regarding applicability of a
code requirement must remain with the professional, registered in the state of
Ohio, who has prepared the documents to be reviewed.
(1) Specification 2H notes trap primers are to be installed where shown or "as
required" by Codes. Trap Primers are not shown on the drawings and
required by OPC 1002.4 where the required trap seal is subject to loss by
evaporation, a trap seal primer valve shall be installed. Indicate on the
drawings which trap seals are subject to loss by evaporation and require,
therefore a trap primer.
(2) Specification 3.6 notes dampers are to be provided as shown and required.
Dampers are not shown on the drawings and are required where supply
and return air ducts penetrate a rated assembly. Locate the dampers on the
drawings.
Item 2 1024.1 [Exit Discharge] General. Exits shall discharge directly to the exterior of the
building. The exit discharge shall be at grade or shall provide direct access to grade. The exit
discharge shall not reenter a building.
a. Room 100 Vestibule does not meet the required exceptions 2.3 and 2.4 to this
requirement. The vestibule is not separated from the remainder of the exit discharge by

construction providing protection at least the equivalent of approved wire glass in steel
frames and the vestibule must be utilized only for means of egress or exit and cannot
therfore be utilized for coat and wheelchair storage
Item 3 NEC 110.26 A requires 3 %2 feet clear working space in front of Panel MDP at least 30 inches
wide.
a. Door 121 encroaches on the required front working space of Panel MDP
Item 4 OBC 1006.3 requires that the illumination emergency power system shall provide power for a
duration of not less than 90 minutes.
a. Please indicate on the drawings that the fixtures indicated to have an emergency ballast
be capable ofproviding illumination for 90 minutes.
Item 5 NEC 517.45 Essential Electrical Systems for Other Health Care Facilities. Requires the
essential electrical distribution system to be a battery or generator system.
a. The dialysis machines require an alternative source ofpower complying with NEC
517.30 to 517.35. Please describe the system in the documents for review.
Item 6 The grounding system for the existing 60 amp panel may not be sufficient to comply with the
requirements of NEC 250.50 for the proposed new 600 amp panel. Please provide additional
information.
Item 7 Review and Approval of Plumbing Drawings and inspection of Plumbing installations are
performed by the Franklin County Board of Health
Item 8 The Washington Township Fire Marshal has requested an opportunity to provide input to the
Dublin building department on issues relating to fire protection. The building official has
evaluated the Fire Marshal's comments related to the fire protection provisions of the OBC
and incorporates those comments, by reference, into this Phased Plan Approval and Correction
Request.
a. Please include resolution of the matters of the Fire Marshal's correspondence to
Building Standards in your reply to this Correction Request.
This review is based upon the information contained within the submitted drawings and related documents.
Once corrections are made, submit four (4) new and complete sets of plans to the City of Dublin, Division

Mr. Harpham:
We have reviewed the Construction Drawings for the referenced project dated 09/18/2007, submitted to the Division of
Building Standards on September 18, 2007, for matters of concern to the Washington Township Fire Department regarding
rules relating to fire prevention and the Dublin Fire Code(DFC) based upon the 2000 International Fire Code.
We are able to recommend a phased approval of the plans and note the following:
1. OBC 106.1.1.1 Fire protection system drawings. Drawings for the fire protection system(s) shall be submitted to
indicate conformance with this code and the construction documents and shall be approved prior to the start of system
installation. Drawings shall contain all information as required by the referenced installation standards in OBC Ch. 9.
a. Sheet Al indicates that a "Sprinkler System" is to be provided The Application for Permit indicates
otherwise. Please verify
b. When the are made available, submit for approval, prior to the start of system(s) installation, complete
information regarding the fire protection systems or the alteration of the system(s) information required by
NFPA 13 and 14, Chapter 8, Plans and Calculations for Fire Suppression Systems. If such a system is to be
provided
2. DFC 505.1 Address numbers. New and existing buildings shall have approved address numbers, building numbers or
approved building identification placed in a position that is plainly legible and visible from the street or road fronting the
property. These numbers shall contrast with their background. Address numbers shall be Arabic numerals or alphabet
letters. Numbers shall be a minimum of 4 inches (102 mm) high with a minimum stroke width of 0.5 inch (12.7 mm).
a. Please verify that approved address numbers will be provided in accordance with the provisions of this code
section.

3. OMC 606.4 Controls operation. Upon activation, the smoke detectors shall shut down the air distribution system. Air
distribution systems that are part of a smoke control system shall switch to the smoke control mode upon activation of a
detector.
606.4.1 Supervision. The duct smoke detectors shall be connected to a fire alarm system. The actuation of a
duct smoke detector shall activate a visible and audible supervisory signal at a constantly attended location.
Exceptions:
1. The supervisory signal at a constantly attended location is not required where the duct smoke
detector activates the building's alarm-indicating appliances.
2. In occupancies not required to be equipped with a fire alarm system, actuation of a smoke detector
shall activate a visible and an audible signal in an approved location. Duct smoke detector trouble
conditions shall activate a visible or audible signal in an approved location and shall be identified as
air duct detector trouble.
No coordination was provided between the Mechanical and Electrical Sheets indicating compliance with this code
section. If a Fire Alarm System is NOT to be provided within this Tenant space, the requirements of Section 606.4.1
Exception 2 shall apply. Please verify these requirements. The information you have provided, does not deny or
confirm either of these situations. Please verify.
