Form No. 30043 Ordinance No. 40-23 Passed , 20 AUTHORIZING THE CITY MANAGER TO EXECUTE AND ACCEPT NECESSARY CONVEYANCE DOCUMENTS AND CONTRACTS TO ACQUIRE A 0.297-ACRE FEE SIMPLE WARRANTY DEED FOR RIGHT-OF-WAY, WITHOUT LIMITATION TO EXISTING ACCESS RIGHTS, AND A 0.155 ACRE PERPETUAL UTILITY EASEMENT, FROM RIVERSIDE MILL DEVELOPMENT LLC, AN OHIO LIMITED LIABILITY COMPANY FROM THE PROPERTY LOCATED AT 7049 RIVERSIDE DRIVE, FOR THE PUBLIC PURPOSE OF CONSTRUCTING ROADWAY IMPROVEMENTS, AND A SHARED- USE PATH, WHICH WILL BE OPEN TO THE PUBLIC WITHOUT CHARGE WHEREAS, the City of Dublin (“City”) is preparing to construct the Riverside Drive West Shared-Use Path Project, 22-019-CIP (“Project”); and WHEREAS, the Project requires that the City obtain the following property rights from the parcel identified as Franklin County Parcel Number 273-008600, owned by Riverside Mill Development LLC, an Ohio Limited Liability Company (“Property Owner”), as _ described in the attached Exhibits A and depicted in the attached Exhibits B: e 1-WD: a 0.297-acre fee simple right-of-way, without limitation to existing access rights. e 1-U: a 0.155-acre perpetual easement for the construction and maintenance of public utilities, storm drainage, ingress and egress for the purposes of culvert maintenance, and grading. WHEREAS, the City and Property Owner participated in good faith discussions and have come to mutually agreeable terms for the acquisition of the necessary property rights for the sum of $34,200.00; and WHEREAS, the City desires to execute and accept necessary conveyance documents and contracts to complete the transaction between the City and Property Owner. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Delaware, Franklin, and Union Counties, State of Ohio, _G of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute and accept all necessary conveyance documents and contracts to acquire the above referenced property rights from the property located at 7049 Riverside Drive, identified as Franklin County Parcel Number 273-008600, from Riverside Mill Development LLC, an Ohio Limited Liability Company to the City, for the sum of $34,200.00. Section 2. Council further hereby authorizes and directs the City Manager, the Director of Law, the Director of Finance, the Clerk of Council, or other appropriate officers of the City to take any other actions as may be appropriate to implement this Ordinance without further legislation being required. The Project will provide a valuable pedestrian connection to the Dublin Arts Council from the existing Dublin sidewalk and shared-use path network. Other Project improvements include a 130-foot single span pedestrian bridge over Billingsly Creek, new curb and gutter and 150 feet of guardrail along portions of Riverside Drive. Please see the attached Project Location Map and Acquisition Exhibit for reference. Summary At the October 9, 2023 City Council meeting, Council requested additional information regarding the $34,200 in compensation for the necessary property rights from the property located at 7049 Riverside Drive (Property), owned by Riverside Mill Development (Property Owner). The property rights being acquired are for a portion of right-of-way and a perpetual (permanent) utility easement (Parcel 1) required for the Project. The additional information requested by Council is provided below. Clarification of Property Appraisal Information As part of the presentation to Council on October 9, 2023, staff reviewed the necessary acquisition for Parcel 1, which involves two parts: a portion of right-of-way and a permanent utility easement. The sizes of each are defined in the legal exhibits for Parcel 1 provided as attachments to the ordinance and as follows: • 1-WD, 0.297 acres of right-of-way (of which 0.139 acres is Public Road Occupied (PRO) area) • 1-U, 0.155 acres of permanent utility easement The appraisal for this property was performed by the Horner Appraisal Group, Inc., who is a professional appraiser and has provided a number of property appraisals for the City. The full land value for the entire Property is, in the opinion of the appraiser, $235,525 per acre. The property rights being acquired as Parcel 1-WD consists of 0.297 acres of right-of-way with value summarized from three portions. First is 0.139 acres of PRO, which is essentially encumbered in its entirety by the southbound right-lane of Riverside Drive, with an appraised at $1. Second is 0.103 acres that overlaps an existing slope easement, which presently allows slope maintenance and reduces the utility of the acquired land to the Property Owner. As a result, the value of this portion of the acquired right-of-way is, in the opinion of the appraiser, reduced by 50 percent of the fee simple value (Property value of $235,525 per acre), resulting in an appraised valuation of $12,130. Finally, 0.055 acres of the proposed acquisition is valued as unencumbered residential land at $235,525/acre, resulting in an appraised valuation of $12,949.00. The sum of these three portions results in the total compensation of $25,080 for the right-of-way. Furthermore, the property rights being acquired as Parcel 1-U consists of 0.155 acres permanent utility easement. This easement fully overlaps an existing exclusive slope easement, which is 83 years old, and this acquisition acquires additional easement rights to allow the City to perform a variety of maintenance in this area, most importantly maintaining the existing box culvert within the easement. The proposed easement is, in the opinion of the appraiser, reduced by 75 percent of the fee simple value, resulting in an appraised valuation of $9,120. The sum of the appraised valuation for Parcel 1-WD and Parcel 1-U is $34,200, which results in the proposed compensation for the property rights to the Property Owner. Recommendation Staff recommends adoption of Ordinance 40-23, as this ordinance authorizes the City Manager to execute all necessary conveyance and contract documents to formally accept the necessary property rights described above. 2nd reading memo To: Members of Dublin City Council From: Megan D. Summary The final alignment for the Riverside Drive West Shared-Use Path requires the acquisition of a portion of right-of-way and a perpetual (permanent) easement from the property located at 7049 Riverside Drive and owned by Riverside Mill Development (Property Owner). The property is identified as Parcel 1 on the Acquisition Exhibit. Additionally, right-of-way is required from the property located at 7125 Riverside Drive and owned by the City of Dublin, Ohio. This property is where the Dublin Arts Council is located and is identified as Parcel 2 on the Acquisition Exhibit. The City’s engineering staff have been the point of contact with the Property Owner of Parcel 1 throughout this acquisition. The acquisition from this parcel provides 0.297 acres of new fee simple right-of-way and 0.155 acres of existing property for a permanent utility easement adjacent to Billingsly Creek. The City has participated in good faith discussions with the Property Owner and has arrived at mutually agreeable terms for this acquisition. Parcel 2 is owned by the City of Dublin. The acquisition from this parcel provides 0.237 acres of new right-of-way south of the Dublin Arts Council driveway and converts 0.378 acres of existing public road occupied (P.R.O.) to right-of-way. Acquisitions A Good Faith Offer Letter, the appraisal report, and associated information were provided to the Property Owner on August 8, 2023.
