O’Callaghan, P.E., City Manager Date: January 24, 2023 Initiated By: Matt Earman, Parks and Recreation Director Shawn Krawetzki, Landscape Architect Manager Re: Resolution 12-23 – Accepting the Lowest and Best Bid for the Muirfield Drive Greenway Corridor Tree Replacement Project and Authorizing the City Manager to Enter into a Contract for the Project Background At the February 25, 2020 Dublin City Council meeting, Council approved the recommendation from the Public Services Committee to proceed with securing voluntary landscape easements as part of the Avery-Muirfield/Indian Run Meadows Greenway Corridor Program. A series of ordinances for securing these easements was initiated by City Council in 2021 for the properties adjoining Avery- Muirfield Drive in the Indian Run Meadow subdivision. The purpose of these easements is to allow the City to assume responsibility to maintain the appropriate tree and shrub screening as it is reflected in the Indian Run Meadows development text. Of the 30 properties affected by the screening requirements, 20 landscape easements have been secured. Staff will continue to reach out to the remaining 10 property owners to inform them of the program and provide them with specific screening requirements respective to each property. If these property owners decline participation in the program and they remain non-compliant, staff will proceed with the appropriate code enforcement protocols. Attached is the staff report with the Public Services Committee detailed recommendations related to this project (Appendix A), an updated map of the individual properties (Appendix B), and a breakdown of work to be completed for each property (Appendix C). Summary On December 20, 2022, staff received one bid for the Muirfield Drive Greenway Corridor Tree Replacement Project (Project) from Timberwood Landscape Company, Inc. (Timberwood) in the amount of $100,301.00. The bid includes removing trees in poor condition at the cost of approximately $446 per tree and planting new trees at an average of approximately $490 per tree. Attached is a detailed breakdown of the costs for this project (Appendix D). The submitted bid was 2 percent lower than the Engineer’s Estimate of $500 per newly planted tree. The Engineer’s Estimate did not include the removal of trees that are in poor condition; however, the quoted cost for this portion of work is consistent with other recent City projects. The 25’ wide landscape easement will continue to be maintained by the City of Dublin after final acceptance of the project. Due to the nature and highly visible profile of this Project, the Parks and Recreation Department and Communications and Public Information Division has prepared a communications plan to inform residents prior to and during the construction of the Project. Recommendation Staff has thoroughly reviewed the Timberwood Landscape Company, Inc. bid and found the bid to be acceptable. Timberwood has performed well on many previous City projects, and Timberwood’s references returned favorable. If approved by City Council, a request to amend the annual appropriations for the fiscal year ending December 31, 2023 will include supplemental funding for this project for the first quarter of 2023. The supplemental funding request will allow this project to be funded with reforestation funds. Staff recommends approval of Resolution 12-23, accepting the lowest and best bid for the Muirfield Drive Greenway Corridor Tree Replacement Project in the amount of $100,301.00 and authorizing the City Manager to enter into a contract for the project. McDaniel Date: February 28, 2020 Initiated By: Matt Earman, Director of Parks and Recreation Re: Public Services Committee Recommendation – Greenway Beautification Pilot Program Avery-Muirfield/Indian Run Meadow Landscape Corridor Background The Indian Run Meadows Planned Unit Development was approved by Council in 1978 (Ordinance 79-78) and, at the time, included almost 200 acres of land. In 1986 the site was rezoned to clarify public and commercial uses within the PUD (Ordinance 33-86). The development text on file is dated July, 27 1986. As a prominent “gateway” through the community, the development text includes a roadway landscape buffer requirement for the development. The buffer extends nearly a mile just south of Valley Stream Drive to the northern edge of Scottish Corners Park, on both sides of Muirfield Drive. The landscape treatment is applicable to residential, institutional and commercial properties, and also includes landscaping standards for the Muirfield Drive median. The Landscape Edge and Median Treatments prescribe and depict graphically an explicit quantity of deciduous, evergreen and ornamental trees as follows: Edge Treatment - Plant Material (Per 300’ of Planting Segment per Side) 7 Shade Trees 2” - 2 ½” Caliper 15 Evergreen Trees 6’ - 7’ Height 6 Ornamentals 1 ¾” – 2” Caliper Median Treatment – Plant Material (Per 300’ of Planting Segment) 6 Shade Trees 2” – 2 ½” Caliper 6 Evergreens 6’ – 7’ Height 3 Ornamentals 1 ¾” – 2” Caliper Neither the development text nor any of the residential plats for Indian Run include language regarding the responsible party for maintenance and upkeep of this buffer. For the first 20+ years the trees and required mounding formed a dense vegetated buffer. Two of the most popular tree species available in the 1980s were Ash and Austrian pine trees, and these trees were used predominately in this buffer. Over the past several years, Ash and Austrian pine trees have been devastated by insects and diseases, and declined in combination with age and urban stresses. Due to the continual decline of evergreen species staff has, over time, replaced the majority of dead pines in the median with a more salt tolerant deciduous or ornamental tree. To date, there are only a few evergreen trees remaining in the median. The standard for the median requires more than 60 new evergreen trees to be planted; however, due to today’s engineering standards for intersection sight distances there is space for only 12 new evergreens. These trees will be planted early this spring to achieve minimal compliance on the City maintained property. In 2015, an inventory of the roadway edges of the buffer was completed and staff provided correspondence to property owners in January 2016 informing each of their unique landscape requirement and noted deficiencies. More than 60 residents were contacted regarding the landscape buffer and were encouraged to contact the City to discuss their respective options. A follow-up letter sent in spring of 2016 went to residents with major violations, (i.e. dead trees or large gaps in screening.) Residents were instructed to remove dead trees by September and install trees in conformance to the requirement by November 2016. While some residents complied with the buffer requirements by planting new trees or shrubs, others neglected to comply or refuted the compliance responsibility. The responsibilities for the installation and maintenance of this buffer treatment vary greatly across the residential lots as some lots include close to 200 feet of length along Avery- Muirfield Drive while others include less than 50 feet. On average, the lot length is between 65 and 75 feet. These variances affect the number of trees, and cost of replacements, for which each property owner is responsible. Based on the development text, the requirements for landscaping are specific about the number of trees per 300 linear feet; however, enforcement of the requirement for each parcel is interpreted differently by each landowner as the text does not specifically state the point at which the linear footage begins and ends. It is staff’s interpretation of the text that the initial 300-foot leg begins at the southern end of the development on Avery-Muirfield Drive, just south of Valley Stream Drive, heading north. The attached map indicates the current inventory of trees, tree condition, proposed replacements and additional trees to supplement the existing landscape in order to achieve the desired buffer, (Appendix A.) Discussion at the 2018 City Council Retreat included a desire for staff to explore options to add additional screening along the corridor, as the back of the private properties, including porches, play equipment and other structures are clearly visible from the roadway. Additional information was requested with the understanding that full implementation would require the permission of several residents to provide easements or otherwise allow for plantings on private properties, among other challenges. An updated inventory of the buffer was again conducted in spring of 2019 which included the number of new trees that would be needed, not only to meet the standard, but to accomplish the intended or desired screening along the corridor. Based on this inventory, a total number of new trees for the east and west sides of the corridor is approximately 184 trees for a total estimated cost of $92,000 at $500 per tree. Funding for the replacement of trees for this pilot program would be utilized from the City’s General Fund, including the existing reforestation funds generated by payments in lieu of tree replacements, which would require an appropriations supplemental approval by Council. As of year-end 2019, the balance of the reforestation fund was $700,197. Costs for preparing legal descriptions, exhibits and documents for the landscape easements would be funded from existing appropriations or an additional supplemental as needed. There are a total of 67 parcels that border the corridor which would require easements. The average cost for documentation and exhibits to record each property easement is approximately $750, with a total Memo re. Other related costs include routine maintenance of mulching, pruning and disease control and long term replacement of dead trees. At the February 18, 2020 Public Services Committee meeting, staff provided an update and facilitated discussion regarding next steps to fulfill the screening needs along the corridor. It was the desire of the Committee members that the City recognize this corridor as a significant “greenway” to ensure appropriate screening with the necessary tree scape and maintenance at a professional standard that will maximize the health and longevity of the trees. In order to achieve this standard, it was determined that it would be best for the City to initiate a pilot program which would assume landscape maintenance responsibilities and costs by way of establishing volunteer landscape easements for each property along the corridor. This would require the City to establish a landscape easement along the edge of the buffer, with cooperation from each property owner to provide the City the ability to plant and maintain the landscaping along the corridor. To incentivize collective and immediate participation with the program, each property owner would be provided a time-limited window to opt in to swiftly and efficiently implement the program. Additionally, there should be the expectation for property owners that do not participate to be fully responsible for replacing and maintaining trees to the required standard at their own expense until such an easement is obtained. For each, clear standards will need to be formally communicated to ensure proper enforcement requirements are understood. Additionally, the Committee requested staff to identify and recommend other corridors throughout the City that might also be determined as significant “greenways” that could also be included in a more holistic plan to incorporate landscape easements to achieve similar results. Other suggested corridors for consideration include Frantz Road, Woerner Temple Road, Dublin Road and Coffman Road. Based on the success of this pilot program, it is the Committee’s preference to possibly formalize this program and dedicate funding toward its implementation to preserve the high profile corridors throughout the City. For all future developments within the City, provisions for establishing appropriate landscape requirements and identification of responsible parties will be reviewed and clearly articulated. Recommendation Pursuant to the recommendations of the Public Services Committee of Council, staff requests City Council to authorize staff to proceed with the implementation of a “Greenway Corridor Pilot Program” for the Avery-Muirfield/Indian Run Meadow corridor by way of the following action steps pertaining to the recommendations by the Committee: 1. Seek to obtain voluntary easements along the Avery-Muirfield/Indian Run Meadow corridor by: a. establishing preferred easement distances for each property, b. establishing timeline and details for the program (time limitations, non-participatory expectations, etc.), c. developing and implementing a communication plan to inform/educate property owners, and d. establishing easement documentation. 2. Request appropriations supplemental approval by City Council for the use of reforestation funds. 4. Commence and continue tree replacements and maintenance of landscapes. Staff is also requesting direction from City Council regarding the preference to prioritize the aforementioned suggested corridors to be included in the pilot program.
