Hartmann, Assistant Law Director Re: Ordinances 49-22, 50-22, 51-22 – Acquisition of Easement and Appropriation of Right-of-Way for the Sanitary Sewer Extension Area 1B Project (21-013-CIP) Summary The Sanitary Sewer Extension – Area 1B Project (21-013-CIP) (the “Project”) includes the installation of 2,185 feet of 12-inch sanitary sewer and reconstruction of the Trails End Drive roadway. The Project was previously identified in the Public Water and Sanitary Sewer Extension Policy (2015) as an area in need of sanitary sewer service. A sanitary sewer extension project Area 1C was completed last year and installed the downstream connection required for the Areas 1B (Trails End Drive) sanitary sewer installation. In addition to the sanitary sewer extension project, the City’s Asset Management Division identified and programmed Trails End Drive for roadway reconstruction in the City’s Annual Street Maintenance program. The City initiated design of the sanitary sewer for Trails End Drive (Area 1B) in 2021 with sanitary sewer construction and the street reconstruction programmed for 2022. The Project requires the acquisition of property interest from two property owners located at the northern no outlet end of Trails End Drive. A “hammerhead” turnaround is to be constructed at the end of Trails End Drive as part of the roadway reconstruction as no viable turnaround exists presently at the end of the street. The turnaround requires additional right-of-way from the properties located at the end of Trails End Drive. The Project also requires the acquisition of property interest from one property owner located at 8171 Trails End Drive to construct a new storm sewer in connection with the roadway reconstruction. Acquisitions A Good Faith Offer Letter, appraisal report and associated information, were provided to the three property owners in June 2022. The City has participated in good faith discussions with the property owners for the easement acquisition and appropriation of additional right-of-way, and have come to mutually agreeable terms for each acquisition. On September 27, 2022, bids were received for the construction of the Project. Council acceptance for the lowest and best bid is scheduled for October 10, 2022. Construction activities are expected to commence in the spring of 2023. Recommendation Staff recommends adoption of Ordinances 49-22, 50-22, and 51-22 at the second reading/public hearing on October 24, 2022, as these ordinances authorize the City Manager to execute all necessary conveyance and contract documents to formally accept the necessary property interests described above.
