Resolution 16-22 To: Members of Dublin City Council From: Dana L. McDaniel, City Manager Date: April 5, 2022 Initiated By: Alison LeRoy, Community Events Director Re: Resolution No. 16-22 – A Resolution to Approve the Application Filed by the City Manager Thereby Expanding the Designated Outdoor Refreshment Area in Downtown Dublin and Enacting Regulations Background Attached for Council consideration is Resolution 16-22, which will expand the Designated Outdoor Refreshment Area (DORA) in Downtown Dublin, establishing a single DORA in Downtown Dublin. At the February 28, 2022 City Council meeting, the Council directed the City Manager to submit the necessary application to City Council for the expansion of the Downtown Dublin DORA. There are currently two DORAs in Dublin, a Historic Dublin DORA and a Downtown Dublin DORA. In addition to this resolution expanding the Downtown Dublin DORA, the Council will also be considering a resolution dissolving the Historic Dublin DORA at its April 11, 2022 meeting. The new Downtown Dublin DORA will encompass the areas in Bridge Park and Historic Dublin that were previously two separate DORAs, will connect the two existing DORAs via the Dublin Link Pedestrian Bridge and East Plaza of Riverside Crossing Park, and will allow the City to consider future expansion of the DORA as the Bridge Park development grows without the need to submit future applications to the State of Ohio. Upon the approval of this resolution, City staff will send the approved resolution and necessary application to the State of Ohio. The State will then process the application and provide permits for the new Downtown Dublin DORA area. This process takes approximately three weeks. A map of the proposed expansion for the Downtown Dublin DORA, the signed application for the expansion of the DORA in Downtown Dublin, and the staff report from the February 28, 2022 City Council meeting on this subject are attached for reference. If the Council approves the expansion of the Downtown Dublin DORA, City staff will produce various communications pieces and social media announcements to promote the expanded area. McDaniel, City Manager Date: February 22, 2022 Initiated By: Alison LeRoy, Director of Community Events Matt Earman, Director of Parks and Recreation Re: Recommendation from Public Services Committee – DORA Boundary Expansion Background In order to increase the flexibility of the Designated Outdoor Refreshment Area (DORA) boundaries, staff is proposing expansion of the boundaries by way of an application to the State of Ohio. This expansion will allow Council to activate or deactivate any area within the approved boundary with a single motion in the future without having to submit a new application to the State. If approved, when a new restaurant opens outside of the current active area, or there are requests to extend the active area for a specific event, Council can approve or disapprove the expansion at any time. At its January 24, 2022 meeting, Council referred the issue of potentially expanding boundaries of the City’s DORAs to the Public Services Committee (PSC). The staff memo to City Council for its January 24, 2022 meeting is attached for reference. Summary The PSC considered the issue of expanding the DORA boundaries at its February 16, 2022 meeting (the staff memo and presentation from the February 16 PSC meeting, as well as a committee report are attached for reference). The PSC focused on the following primary issues: • Should Staff prepare a new application to the State of Ohio and approve the proposed boundaries? (Map 1 attached to February 16 PSC memo) • Review and discuss the new active areas recommended by staff. (Map 2 & 3 attached to February 16 PSC memo) • Review and discuss the activation of the Dublin Link Bridge and Riverside Crossing Park East Plaza for implementation after the new DORA boundaries are approved by the State. The PSC also reviewed the following next steps if the Council supports expanding the DORA boundaries: • March 4, 2022 – City Manager presents formal application for expansion of DORA boundaries to full Council. o Advertised notices will run in local papers as required by the State. • April 11, 2022 – City Council consideration of resolution approving application to expand DORA boundaries and directing staff to submit resolution to the State. McDaniel, City Manager Date: January 18, 2022 Initiated By: Alison LeRoy, Director of Community Events Re: DORA Boundary Changes Background Two Designated Outdoor Refreshment Areas (DORA) have been active in Downtown Dublin since spring of 2021. Feedback from residents, business owners and guests have been mostly positive with few reported issues related to the DORA. As a result of the feedback, the DORA hours were continued in the fall of 2021 and into the future. In order to increase the flexibility of the DORA boundaries, staff is proposing expansion of the boundaries by way of an application to the State of Ohio as shown in the attached maps. This expansion will allow Council to activate or deactivate any area within the approved boundary with a single motion in the future without having to submit a new application to the State. If approved, when a new restaurant opens outside of the current active area, or there are requests to extend the active area for a specific event, Council can approve or disapprove the expansion at any time. Recommended expansion of the boundaries are illustrated in the attached map, highlighted in red. With new boundaries, Council may also consider adding Riverside Crossing Park and the Dublin Link bridge in the active area, whether on a daily basis or for specific events. This is not an option within the current boundaries. When a survey was conducted in the summer, the most mentioned topic in the open-ended questions was related to having the DORA extend across the Dublin Link Bridge. Summary If Council approves the expansion of the boundaries, the City’s application with the State of Ohio would need to be resubmitted.
