Resolution 034-20RECORD OF RESOLUTIONS Dayton Legal Blank, Inc., Form No. 30045 Resolution No. 34-20 Passed .20 A RESOLUTION AFFIRMING THAT FUNDS DISTRIBUTED UNDER AMENDED HOUSE BILL 461 BY THE STATE OF OHIO TO TH E CITY OF DU BLIN SHALL BE EXPEN DED BY TH E CITY ONLY FOR COSTS PERMITTED UNDER THE FEDERAL CORONAVIRUS AID, RELIEF, AND ECONOMIC SECURITY ACT WHEREAS, the Coronavirus Aid, Relief, and Economic Security Act, 116 Public Law 136, ("'CARES Act") was signed into law by the President of the United States on March 27, 2020; and WHEREAS, the Ohio General Assembly established a process for distributing funds provided by the CARES Act in Amended House Bill 461 of the 133rd General Assembly (H.B. 461); and WHEREAS, H.B. 461 requires subdivisions receiving funds under Section 1 of the Act, to pass a resolution affirming that funds from the County Coronavirus Relief Distribution Fund may be expended only to cover costs of the subdivision consistent with the requirements of the CARES Act as described in 42 USC 801 (formerly 42 USC 601) and any applicable regulations before receiving said funds; and WHEREAS, Dublin is requesting its share of funds from the County Coronavirus Relief Distribution Fund; and WHEREAS, Dublin City Council believes that accepting such funds pursuant to the required conditions is in the best interest of the public health, safety, and welfare of the City of Dublin. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1: The City affirms that all funds received from the County Coronavirus Relief Distribution Fund pursuant to H.B. 461 shall be expended only to cover costs of the city consistent with the requirements of CARES Act as described in 42 USC 801 (formerly 42 USC 601), and outlined more specifically in Section 2. Section 2: The City shall spend funds received under H.B. 461 only on necessary expenditures incurred due to COVID-19 between March 1, 2020 and December 30, 2020 that were not accounted for in Dublin's most recently approved budget as of March 27, 2020. Section 3: If any federal or state revisions are made to the local expenditure requirements, the City affirms that it will use a I I funds received from the County Coronavirus Relief Distribution Fund consistent with those revisions. Section 4: The City Fiscal Officer is directed to take all necessary action to pay any unencumbered balance of money in Dublin's local coronavirus relief fund to the County Treasurer no later than October 15, 2020 as required by H.B. 461. Section 5: The City Fiscal Officer is directed to take all necessary action to pay the balance of any money in Dublin's local coronavirus relief fund to the state treasury in the manner prescribed by the Director of the Ohio Office of Budget and Management as required by H.B. 461; and RECORD OF RESOLUTIONS Dayton Legal Blank, Inc., Form No. 30045 Resolution 104'-2o passed Page 2 of 2 , 20 Section 6: The City Fiscal Officer is directed to provide information related to any payments received under H.B. 461 to the Director of the Ohio Office of Budget and Management as requested, and as required by H.B. 461. Stiffler, Director of Finance Re: Resolution No. 34-20 —Affirming that funds distributed under Amended House Bill 461 shall be expended by the City only for costs permitted under the Federal Coronavirus Aid, Relief, and Economic Security (CARES) Act Summary The adoption of this resolution is required for the City to receive its allocation of federal relief funding from the State of Ohio. The City estimates it will receive $330,000 from this initial allocation of funding. On March 27, 2020 the Coronavirus Aid, Relief, and Economic Security Act (CARES) was signed into law by the President of the United States. As part of that federal legislation, $4.6 billion was allocated to the State of Ohio. Of this amount $2.0 billion will be distributed to local governments with $775 million going to local governments with a population of over 500,000. Of the remaining $1.2 billion, $350 million will be distributed utilizing a county's undivided local government fund formula as required by Ohio Amended House Bill 461. The distribution formula and timing of remaining $850 million has yet to be determined. Recommendation Staff is requesting approval of Resolution No. 34-20 at the June 22, 2020 Council meeting.
