Resolution 062-19RECORD OF ORDINANCES BARRETT BROTHERS - DAYTON, OHIO Ordinance No. 66-19 Passed AN ORDINANCE AUTHORIZING THE PROVISION OF AN INCENTIVE TO RENAISSANCETECH LLC TO INDUCE IT TO PURCHASE A FACILITY TO RETAIN AND EXPAND ITS CORPORATE HEADQUARTERS AND ITS ASSOCIATED OPERATIONS AND WORKFORCE, ALL WITHIN THE CITY; AND AUTHORIZING THE EXECUTION OF AN ECONOMIC DEVELOPMENT AGREEMENT, Form 6220S WHEREAS® consistent with its Economic Development Strategy (the "Strategy) approved by Dublin City Council Resolution No. OY-c.4 adopted on June 20, 1994, and the updated Strategy approved by Dublin City Council Reksolution No. 30-04 adopted on July 6, 2004, the City desires to encourage commercial officEi development and create and preserve jobs and employment opportunities within the City; and WHEREAS,, RenaissanceTech LLC (the "C'ompany7 recently performed a comprehensive examination of its workforce needs, and based on the results of this examination, and induced by and in reliance on the economic development incentive provided in the proposed Economic Development Agreement (as described below), the Company is desirous of purchasing a facility to retain and expand its corporate headquarters and its associated operations and workforce, all within the City; and WHEREAS, this Council has determined that it is necessary and appropriate and in the best interests of the City to provide an economic development incentive to the Company, as described in the proposed Economic Development Agreement; and WHEREAS, this Council has determined to offer the economic development incentive, the terms of which are set forth in a substantially final form of Economic Development Agreement presently on file in the office of the Clerk of Council, to induce the Company to purchase a facility to retain and expand its corporate headquarters and its associated operations and workforce, all within the City, which will result in the retention of existing and creation of new jobs and employment opportunities, thereby improving the economic welfare of the people of the State of Ohio and the City, all as authorized in Article VIII, Section 13 of the Ohio Constitution; NOW, T EREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring, that: Section 1. The Economic Development ,Agreement by and between the City and the Company, in the form presently on file with the Clerk of Council, providing for, among other things, the provision of an economic development incentive in consideration for the Company's agreement to purchase a facility for the retention and expansion of its corporate headquarters and its associated operations and workforce, all within the City, which will result in the retention of e)�isting and creation of new jobs and employment opportunities, is hereby approved and authorized with changes therein not inconsistent with this Ordinance and not substantially adverse to this City and which shall be approved by the City Manager. The City Manager, for and in the name of this City, is hereby authorized to execute that Economic Development Agreement, provided further that the approval of changes thereto by that official, and their character as not being substantially adverse to the City, shall be evidenced conclusively by the execution thereof. This Council further authorizes the City Manager, for and in the name of the City, to execute any amendments to the Economic Development Agreement, which amendments are not inconsistent with this Ordinance and not substantially adverse to this City. Section 2. This Council further hereby authorizes and directs the City Manager, the Director of i-aw, the Director of Finance, the Clerk of Council, or other appropriate officers of the City to prepare and sign all agreements and instruments and to take any other actions as may be appropriate to implement this Ordinance. Background Resolution 62-19 authorizes the City Manager to execute a construction agreement with Ruscilli Construction Co., Inc., the Construction Manager at Risk, for the 5555 Perimeter Drive (Future City Hall) Renovation/Construction Project. This agreement establishes the first phase Guaranteed Maximum Price (GMP) in the amount of $329,854. This initial phase includes items such as selective interior demolition, flooring, LED light fixtures and lighting controls, HVAC equipment, and fire protection system upgrades. Ruscilli completed its competitive bidding process for these items in late October and work is planned to begin in early December. The renovation and construction process is designed to deliver the City Hall administrative offices in the existing 5555 Perimeter Drive building and the new Council Chambers Addition and supporting spaces in phases. Accordingly, an amendment to the GMP for the balance of the renovation work as well as equipment that has long lead times for the Council Chambers Addition will be presented to City Council in December 2019. City staff will begin occupying the new City Hall administrative building in April 2020. A third amendment to the GMP will encompass the majority of the Council Chambers Addition work and is planned to be presented to City Council for approval in May 2020. Construction of the new Council Chambers Addition is currently anticipated to be complete in the spring/summer 2021. Recommendation Staff has thoroughly reviewed the Guaranteed Maximum Price Amendment. O'Callaghan, PE, Director of Public Works Brian Ashford, Director of Facilities Management Re: New City Hall Council Chambers Addition Project Update Summary Memo At the upcoming City Council meeting, staff will be providing an overview of the current design status of the new City Hall Council Chambers addition, including the site plan, layout, and renderings of the exterior. The attached exhibits are being provided for reference and will be discussed as part of the staff presentation. (see attached) The Dublin -based firm of Horne & King was selected to provide professional design services for this project and design has been underway since April 2019. The Construction Manager at Risk (CMR) delivery method is being utilized and following a competitive selection process, Ruscilli Construction Co., Inc. (Ruscilli) was selected to serve as the CMR. Ruscilli is working closely with the design team (Horne & King) and City staff throughout the design development process. To ensure significant stakeholder engagement during the design phase we are utilizing steering committees. The Council Chambers Addition Design Steering Committee includes representatives from City Council (3), Planning & Zoning Commission (1), Legislative Affairs, Office of the City Manager, Planning, and Public Works. This committee is working with the Architect throughout the design phase on programming, layout, design elements, finishes, security, audio/visual technology, exterior features and landscaping for the building addition. The design and construction process will deliver the City Hall Administrative offices in the existing 5555 Perimeter Drive building and the new Council Chambers addition and supporting spaces in two phases. A resolution authorizing the City Manager to enter into the initial contract and execute a Guaranteed Maximum Price (GMP) with Ruscilli for a portion of the phase 1 renovations of the existing 5555 Perimeter Drive building is planned to be presented to City Council at the November 18, 2019 meeting. Staff is currently planning to present amendments to the GMP in early December 2019 for the balance of the renovations to the existing 5555 Perimeter Drive building and in May 2020 for the new Council Chambers addition and supporting spaces. City staff will begin occupying the new City Hall located at 5555 Perimeter Drive in April 2020. Construction of the new Council Chambers and supporting spaces is currently anticipated to be complete in the spring/summer 2021. Recommendation This memorandum is for informational purposes only. Staff requests direction from Council regarding whether they would like a more formal public engagement process for residents at any point during the design development. This site is located in a standard zoning district and the use is permitted, as such the project will not be reviewed by PZC. There will also be a formal public engagement process that will inform the design and provide opportunities for input to all stakeholders, including City Council, Boards and Commissions, and residents. This memorandum is for informational purposes only. Staff recommends and requests City Council select up to three of its members to serve on the Council Chambers Addition Design Steering Committee.
