AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
EXECUTE AND ACCEPT NECESSARY CONVEYANCE DOCUMENTS
AND CONTRACTS TO ACQUIRE A 0.018 -ACRE TEMPORARY
CONSTRUCTION EASEMENT FROM MANIJEH FIROUZIAN,
TRUSTEE OF THE MANIJEH FIROUZIAN REVOCABLE TRUST
AGREEMENT, LOCATED AT 5400 WILCOX ROAD, FOR THE
PUBLIC PURPOSE OF CONSTRUCTING A NEW ROADWAY
WHICH SHALL BE OPEN TO THE PUBLIC WITHOUT CHARGE.
WHEREAS, the City of Dublin (the "City's is preparing to construct the Tuttle Crossing
Boulevard Extension and Avery Road Improvements project (the "Project'; and
WHEREAS, the Project requires that the City obtain a temporary construction
easement from the parcel identified as Franklin County parcel number 273-008180,
owned by Manijeh Firouzian, Trustee of the Manijeh Firouzian Revocable Trust
Agreement (the "Grantors', as described in the attached Exhibits A and depicted in
the attached Exhibits B; and
WHEREAS, the City, through its acquisition agent for the Project, and the Grantors
participated in good faith discussions and have come to mutually agreeable terms for
the acquisition of the necessary property interest for the sum of $1,010.00, which is
the appraised value of the property interest; and,
WHEREAS, the City desires to execute and accept necessary documents to complete
the transaction between the City and the Grantors.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
Delaware, Franklin, and Union Counties, State of Ohio, 7 of the elected members
concurring that:
Section 1. The City Manager is hereby authorized to execute and accept all
necessary documents to acquire a 0.071. -acre temporary construction easement, from
Manijeh Firouzian, Trustee of the Manijeh Firouzian Revocable Trust Agreement, for
the appraised value of $1,010.00, said property interest located within the parcel
identified as Franklin County parcel number 273-008180, and more fully described and
depicted in the attached Exhibits A and B.
Section 2. Council further hereby authorizes and directs the City Manager, the
Director of Law, the Director of Finance, the Clerk of Council, or other appropriate
officers of the City to take any other actions as may be appropriate to implement this
Ordinance without further legislation being required.

The Project requires the acquisition of property interests from multiple property owners on Tuttl
Crossing Boulevard, Avery Road, Wilcox Road, Rings Road, Cara Road, and Cara Court. I
The City, through its acquisition agent, has come to mutually .r: terms with multiple
property owners in connection with the Project. The property acquisitions from these owners
consists of the following property interests from the named property owners, as depicted in the
map attached hereto:

Mollie Sin-Khay and Khoun Khay and Teav Sinn: The property is located on the north side o
Rings Road, west of Avery Road, at 6236 Rings Road, Dublin, Ohio 43016. The City participated 1
good faith discussions with Mollie Sin-Khay and Khoun Khay and Teav Sinn resulting in mutually
agreeable terms for the acquisition of the property interest for the appraised value, which was
$22f 316. 1
These Ordinances authorize the City Manager to execute all necessary conveyance documents t*
formally acquire the necessary property 'Interests from each property owner.
Staff recommends adoption of Ordinances Nos. 56-18, 57-18, and 58-18 at the second reading/public
hearing on September 10, 2018, as these ordinances authorize the City Manager to execute all
necessary conveyance and contract documents to formally accept the necessary property interests

Military Survey Number 3004, and being part of that 2.201 acre tract described in a deed to
Manijeh Firouzian, Trustee of the Manijeh Firouzian Revocable Trust Agreement dated
July 5, 2013, of record in Instrument Number 201309130156302, all records referenced herein
we on file at the Office of the Recorder for Franklin County, Ohio, being a parcel on the right
side of the proposed centerline of construction for Wilcox Road, as delineated on the centerline
plat for Tuttle Crossing Boulevard and Avery Road Improvements, of record in Plat Book
Page . said parcel being more particularly bounded and described as follows:
BEGINNING at a point on the existing east right-of-way line for Wilcox Road, as established
by that 0.071 acre right-of-way parcel described in a deed to City of Dublin, Ohio, of record in
Instrument Number 199710240126643, said point being the southwest corner of said 2.201 acre
tract, said point being on the north line of that 2.160 acre tract described in a deed to United
Dairy Farmers, Inc., of record in Instrument Number 200002110029232, and said point being
35.00 feet right of Wilcox Road proposed centerline of construction Station 27+29.29;
Thence along the arc of a curve to the right, along the existing east -right-of-way line for said
Wilcox Road, along the west line of said 2.201 acre tract and along the east line of said 0.071
acre right-of-way parcel, said curve having a radius of 846.53 feet, a central angle of 06 degrees
28 minutes 44 seconds, and an arc length of 95.72 feet to a point, said point being 35.00 feet
right of Wilcox Road proposed centerline of construction Station 28+28.97, said curve being
subtended by a long chord having a bearing of North 15 degrees 24 minutes 31 seconds East
and a length of 95.67 feet;
Thence South 06 degrees 03 minutes 17 seconds West, across said 2.201 acre tract, a distance
of 91.20 feet to a point on the south line of said 2.201 acre tract, being on the north line of said

The bearings described herein are based on Grid North as referenced to the Ohio State Plane

established utilizing a GPS survey and an NGS OPUS solution.
