WHEREAS, the City of Dublin (the "City'? is preparing to construct the Hyland -Croy Road and Riviera Connector Project (the Troject'�; and WHEREAS, the Project requires that the City obtain a fee simple warranty deed, without limitation of existing access rights, a permanent utility and grading easement, and a temporary easement from the parcel identified as Union County Parcel No. 3900290011000, owned by The Board of Education of the Dublin City School District (the "Grantor"), said property interests being more fully described in the attached Exhibits A and depicted in the attached Exhibits B; and WHEREAS, the City and the Grantor participated in good faith discussions and have come to mutually agreeable terms forthe, acquisition of the necessary property interests for the sum of $21,000.00, which is the appraised value of the property interests. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Delaware, Franklin, and Union Counties, State of Ohio, #� of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documents to acquire a 0.027 -acre fee simple warranty deed for right-of- way, without limitation of existing access rights; a 0.581 -acre permanent utility and grading easement; and a temporary easement from The Board of Education of the Dublin City School District, for the appraised value of $21,000.00, said property interests located within the parcel identified as Union County Parcel No. 3900290011000, and more fully described and depicted in the attached Exhibits A and B. Sweder, P,E., Civil Engineer II Re: Ordinance No, 40.18 Acquisition of Right -of -Way and Easements — Hyland -Croy Road/Riviera Connector (17-018-CIP) - Dublin City School District - Tree Impacts At the June 11, 2018 City Council meeting, Council inquired if the Hyland -Croy Road j Riviera Connector roadway extension project area was looked at for any Landmark trees and what the tree impact is associated with the project. Landmark Trees in the Project Area The City defines a Landmark tree as a tree with a diameter equal to or greater than twenty-four (24) inches. Tree Impact Associated with the Project The project requires the removal of several trees rated in good, fair or poor condition located within the project limits as well as many dead trees, A tabulation including the trees to be removed and identified by property is included on the attached plan sheets, To mitigate the tree removal associated with this project, landscaping is included along the entire length of Cacchio Lane from Hyland -Croy Road to Timble Falls Drive within the Riviera development, Ordinance No, 40-18 - Acquisition of Right -of -Way and Easements — Hyland -Croy Road/Riviera Connector (17.016-CIP) - Dublin City School District - Tree Impacts June 21, 2018 Page 2 of 2 Tree Replacement Comparison Table 2 below provides a comparison of tree -for -tree and caliper inch replacements for the project. The comparison shows that while initially there is a reduction in the number of overall caliper inches, the number of trees to be installed far exceeds the number of trees being removed. The installation of a significant number of shrubs is also noteworthy, Table 2 _ Tree Replacement Comparison The City of Dublin is dedicated to conserving and protecting the City's existing trees, wooded areas and fence rows to the greatest extent possible. The removal of the Landmark trees is unavoidable due to their proximity to the proposed roadway, While not every tree would be located within the proposed pavement or pedestrian facilities, the grading necessary to provide proper drainage would have significant impacts on the trees eventually killing them, The initial installation of trees will result in fewer total caliper inches compared to the number of caliper inches being removed. However, since the number of trees to be installed far exceeds the number of trees being removed, it is reasonable that eventually the total number of caliper inches provided will exceed the number of caliper inches removed, Additionally, over the past several years the City has planted an average over 800 trees Citywide annually. Hartmann, Assistant Law Director Re: Ordinance No, 40.18 Acquisition of Right -of -Way and Easements - Hyland -Croy Road/ Riviera Connector (17.016-CIP) - Dublin City School District Background The City of Dublin ("City") intends to construct the Hyland -Croy Road / Riviera Connector (the "Project"), which is a new public roadway connecting the Riviera neighborhood with Hyland -Croy Road. In the 2018-2022 Capital Improvements Program (CIP), site acquisition was programmed in 2017 and utility relocation, construction and landscape is programmed in 2018, This need for the connector was identified in the Traffic Impact Study and is a condition of zoning approval for the Riviera development, The street section will be two lanes with a center median and separated bike/pedestrian facilities similar to Churchman Road, The addition of turn lanes on Hyland - Croy Road are also included with the project, Funding for this project will be from an advance from the General Fund to be repaid by anticipated service payment revenue from the Riviera Tax Increment Financing (TIF) District. The Project requires the acquisition of property interests from eight (8) property owners, seven (7) of which are along Hyland -Croy Road plus the developer of Riviera, The City participated in good faith discussions with each property owner and to date has come to mutually agreeable terms with three (3) owners in addition to the developer of Riviera who is donating the necessary rights, The remaining (4) properties involved with the project, with which staff have been unable to negotiate with successfully, have separate legislation to appropriate the necessary property rights.
