County. Per the Ohio Revised Code process regarding annexations., the City of Dublin was required to provide a resolution stating what services the municii ity will ,pal* provide to the annexation area upon annexation. Accordingly, Resolution 27-1.7 was passed bv City Council on April 24, 201.7. Copies of that Resolution and- the cover memo are included in the transcript of the Commissioners" hearing and attached for reference. This Resolution was 'forwarded to the Union County Commissioners for their hearing on, the annexation on May '-)5, 2017, and the Commissioners approved the annexation by Kesolution. 17-194. A copy of that Resolution is attached as well. Per the Ohio Revised Code, the transcript of the County Commissioners' hearing is Iorwarded t the clerk of the municipal corporation to which annexation, is proposed. The clerk is required t hold the transcript for a period of 60 days. Following the expiration. of 60 days, at the next regula, Council meeting, an ordi*nancc accepting the annexation is introduced. That period was delaye due to an appeal filed by Jerome Township to the Union Countv Court of Common Pleas. Jerom r Fownship dismissed that appeal. on November 7. 2017. The next step is -for Council to accept or rqect the petition for annexation.. If approved at the second reading/public hearing, Ordinance 87-17 will be effective .30 days after passage, and the property will be incorporated into the City of Dublin. Once the property is annexed to Dublin, it will be automatically rezoned pursuant to Dublin Codil'ed Ordinances Section 153.004(D) to the R -Rural District. The property oNvner will need to seek a rezoning in order to engage in any use outside of those permitted in that District. After this,. the property owners may still appear to argue again the acceptance of the petition, but cannot deprive authority to act on the petition. lig q rill 1: The annexation statute has been amended since these two cases and provides further opportunitv 'to withdraw signatures', but even this does not extend beyond the county commisslonersapproval. of the annexation petition. Section 709.03(C) of the -Revised Code states that owners who have signed an, annexation petition may remove that signature by filing a written notice of withdrawal, within 21 days after the agent for the petitioners has sent notice of the county commissioners' hearing required by R.C. 709.03(B)(2). Due to the timelines specified by the statute, this mustbe before the countjcomnnssioners'hearing on the petition. Section 709.032 of the Revised Code also provides opportunity for a petitioner to appear at the hearing and orally testify that the petitioners signature was obtained "bv fraud, duress., misrepresent,ation, jmcluding any misrepresentation relating to the provision ofw i ipal service' CI I I MUnIc I s to the territory proposed to be annexed, or undue influence."' Consequently, the petitioners only have the right to withdraw belbre the hearing- after tha, withdrawal is permitted only in the limited circumstances that must be proven to the count commission under R.C. 709.032. There is no similar procedure tor the municipality to conside, requests to withdraw signatures from the petition,, nor an ability for the petitioners to withdraw th petition once it has been approved by the county commissioners anct iorwarded to the municipalit. for its approval or rejection. There is also no process for judicial appeal from the municipality' decision. Recommendation Annexation of this area would provide a clear line of demarcation for Dublin jurisdiction on th east side of Hyland -Croy Road. That on March 17, 2017, the Clerk of the Board of County Commissioners referred both the legal description and the map of the land to be annexed to the Union County Engineer for review; I. That the Clerk of the Board of County Commissioners notified the Petitioners' Agent Of the date, time, and place of the hearing on the Petition on March 17, 2017; J. That Jerome Township presented testimony regarding the Annexation Petition from 1. Brian Bemiller, Interim Chief, Jerome Township Fire Department; and 2 2. Ron Rhodes, .Jerome Township Trustee. Y. That no other party presented testimony; Z. That, based on the legal description and map of the territory to be annexed as approved by the Union County Engineer (See Exhibit 1 and Engineer's Report, Finding K), 1. The territory to be annexed, which is roughly rectangular shaped, has a common boundary with the existing municipal corporate limits of the City of Dublin on two of four sides and borders post Road right-of-way held by the City of Dublin in unincorporated Jerome Township on one side; and 2. The fourth side of the property to be annexed has frontage on County Road 2, also known as Hyland -Croy Road; and 3. Approximately 52.8% of the boundary line of the territory to be annexed is common with the existing municipal corporate limits of the City of Dublin; 4. Each of the owners' signatures is dated within i 8o days of the date of filing the Petition AA. That the persons who signed the Petition are the owners of the territory to be annexed and that those signatures constitute more than a majority of the owners of real estate in the territory to be annexed as of the date of filing the Petition (See Exhibit i and Engineer's Report, Finding K); BB. That the City of Dublin's Statement of Services represents it will provide to the territory to be annexed police services, fire and EMS services, and solid waste collection services immediately upon annexation and that, subject to the continued ability of the City of Columbus to provide water supply and to provide sufficient sanitary sewerage disposal capacity, sufficient public water distribution and sanitary sewer collection systems presently exist in the area to serve the territory to be annexed (See Exhibit 4); CC. That the territory to be annexed is not unreasonably large based on the following considerations: 1. The geographic character, shape, and size of the territory to be annexed in relation to the territory of the City of Dublin and in relation to the territory remaining in Jerome Township after any annexation is completed is proportionate and reasonable; 2. The City of Dublin has the current ability to provide municipal services in the territory to be annexed to future users of the land; DD. That, on balance, the general good of the territory to be annexed will be served, and the benefits to the territory- proposed to be annexed and the surrounding area will outweigh the detriments to the territory proposed to be annexed and the surrounding area if the annexation petition is granted based on the following considerations: 1. All of the owners of the property to be annexed wish to have their property annexed into the City of Dublin; 2. There was no evidence as to any loss of services if the property is annexed to the City of Dublin; 91 3. There were some comments that any loss in current tax revenue to Jerome Township would be based on current agriculture use valuation for the property to be annexed; EE. That no street or highway will be divided or segmented by the boundary line between a township and the municipal corporation.
