Resolution 075-17RECORD OF RESOLUTIONS Dayton Legal Blank, Inc., Form No. 30045 75-17 Resolution No. Passed , 20 A RESOLUTION WAIVING COMPETITIVE BIDDING AND AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH CAPITOL TUNNELING FOR THE EMERGENCY REPLACEMENT OF THE BRIDGE PARK EAST BLOCK A SANITARY SEWER LINE WHEREAS, Section 8.04 (c) ("'Waiver of Competitive Bidding' } of the Revised Dublin Charter authorizes Council, by a vote of no less than five (5) members, to waive competitive bidding requirements if it determines that such waiver is in the best interest of the City; and WHEREAS, on or about October 12, 2017, the Bridge Park East Block A Sanitary Sewer Line collapsed blocking the flow of sewage; and WHEREAS, Council has determined that there is a legitimate basis on which to justify such waiver for the procurement of non-professional services related to replacement of the Bridge Park East Block A Sanitary Sewer Line; and WHEREAS, Council has determined that such a waiver of competitive bidding is truly in the best interest of the City and to accept the proposal for an emergency replacement submitted by Capitol Tunneling, Inc. NO THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, of its elected members concurring, that: Section 1. Competitive bidding requirements are hereby waived for the procurement of services related to the replacement of the Bridge Park East Block A Sanitary Sewer Line. Section 2. The proposal submitted by Capitol Tunneling Inc. in the total amount of $303,521.00 is hereby accepted. Section 3. The City Manager is hereby authorized to enter into contracts with Capitol Tunneling Inc. for performance and completion of the Bridge Park East Block A Sanitary Sewer Line Replacement, pursuant to the Proposal and Contract Documents for said project on file in the office of the City Engineer. Section 4. This Council further hereby authorizes and directs the City Manager, the Director of Law, the Director of Finance, the Clerk of Council, or other appropriate officers of the City to prepare and sign all other agreements and instruments and to take any other actions as may be necessary to implement this Ordinance and complete the Replacement. Section 5. This Resolution shall take effect and be in force on the earliest date permitted by law. ATTEST: ?, Clerk of Council -1201-7.
