Resolution 043-17RECORD OF RESOLUTIONS Dayton Legal Blank, Inc., Form No. 30045 Resolution No. __ 43-17 Passed _ , 20 A RESOLUTION ACCEPTING THE LOWEST AND BEST BID FOR THE 100 GIGABIT — DUBLINK IGNITE FIBER OPTIC PROJECT (Project No. 17.020.0- CIP -DCSD Fiber Build Phase 2) WHEREAS, House Bill 497 passed by the Ohio General Assembly in 2014 appropriated Three Hundred Thousand Dollars ($300,000) to the Chancellor of the Ohio Board of Regents to be used by the City of Dublin, Ohio ( "City ") for the construction of certain capital infrastructure to wit, a new fiber optic system; and WHEREAS, the City has initiated the first phase of construction to build the new fiber optic system for a subset of the Dublin City Schools utilizing the State appropriation within the Join Use Agreement previously entered into between the Chancellor of the Ohio Board of Regents, and The Ohio State University /Ohio Academic Resources Network ( "OARnet ") in accordance with the Ohio Administrative Code Section 3333 -1 -03 (E); and WHEREAS, the City has existing optical fiber systems throughout much of the City, and WHEREAS, on February 27, 2017 the City of Dublin and the Dublin City School District entered into a "Real Estate and Transfer of Property Agreement" which established the terms and conditions under which the Dublin City School District will transfer approximately 1.35 acres of real estate to the City of Dublin and release a recorded real estate right on the Columbus Metropolitan Library Property in exchange for certain specified rights to connect to the Dublin's fiber optic network; and WHEREAS, the new fiber optic facilities being installed pursuant to the construction work included within this bid are in fulfillment of the obligations of the City as set forth in the executed "Real Estate and Transfer of Property Agreement "; and WHEREAS, the City desires to interconnect the remaining K -12 and municipal facilities /optical fiber systems not connected through the first phase of construction in a second phase construction project; and WHEREAS, formal advertising and competitive bidding procedures have been conducted, pursuant to Section 8.04 of the Revised Charter and Chapter 37 of the Dublin Code, for the 100 Gigabit — Dublink Ignite Fiber Optic Project; and WHEREAS, Council has determined the bid submitted by Team Fishel constitutes the lowest and best bid. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dublin, State of Ohio, lo _of the elected members concurring, that: Section 1. The bid submitted by Fishel Company in the total amount of $964,851.79 is hereby accepted. Section 2. The City Manager is hereby authorized to enter into contracts with Fishel Company for performance and completion of the 100 Gigabit — Dublink Ignite Fiber Optic Project Phase 2, pursuant to the Advertisement, Proposal and Contract Documents for said project on file in the office of the Chief Information Officer. Section 3. This Council further hereby authorizes and directs the City Manager, the Director of Law, the Director of Finance, the Clerk of Council, or other appropriate officers of the City to prepare and sign all other agreements and instruments and to take any other actions as may be necessary to implement this Resolution and complete the project. Date: May 18, 2017 Re.* Resolution No,. 43-17 — Accepting the Lowest and Best Bid for the 100 Gigabit — Dublink Ignite Fiber Optic Project (Project No. 17,020.0-CIP-DCSD Fiber Build Phase 2) Fit* tilell-T-1., 4- A The City of Dublin successfully initiated Phase 1 of the Dublink Ignite Fiber Optic Project to interconnect a subset of Dublin City Schools in accordance with Resolution 02-17 with funding support from House Bill 497, passed by the Ohio General Assembly in 2014. The intent of the House Bill was to: Provide a fiber optic backbone that can operate at 100 gigabits per second (100gbps) of broadband speed and capacity in order to create, retain, expand and attract high-tech and broadband driven industry, businesses and jobs, while expanding the capabilities of primary ani secondary education. Through Resolution No. 02-17, Project No. 16-DCSD Fiber Build Phase 1 is underway, connecting the following schools to the existing fiber optic backbone: Resolution 43-17 seeks to extend the construction and build project to reach the remaining Dublin City Schools facilities that are not already interconnected to the backbone network. Project No. 17- 020.0-CIP-DCSD Fiber Build Phase 2 will interconnect the following schools: Bailey Elementary School Chapman Elementary School Davis Middle School & Olde Sawmill Elementary School Indian Run Elementary School Scottish Corners Elementary Schooi" Staff has thoroughly reviewed the bid from Fishel Company and determined it to be the lowest an best bid of $964,851.79. 1 4, Staff recommends adoption of Resolution 43-14,
