AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
EXECUTE NECESSARY CONVEYANCE DOCUMENTS TO
ACQUIRE A 0.038 -ACRE, MORE OR LESS, PERMANENT
EASEMENT FROM ASHLAND LLC, FROM THE PROPERTY
LOCATED ON PAUL BLAZER PARKWAY FOR THE PUBLIC
PURPOSE OF CONSTRUCTING A SHARED -USE PATH.
WHEREAS, the City of Dublin (the "City'? is preparing to construct the Smiley Park
shared -use path project, which will include the construction of a shared -use path and
related public improvements connecting to Smiley Park (the "Project'; and
WHEREAS, the Project requires that the City obtain a permanent easement from
Franklin County Parcel No. 273- 012284 -00 owned by Ashland LLC (the "Grantor "),
said easement more fully described in the attached Exhibit A and depicted in the
attached Exhibit B; and
WHEREAS, the City and the Grantor participated in good faith discussions and have
come to mutually agreeable terms for the acquisition of the necessary easement for
the sum of $2,300.00, which is the appraised value of the easement; and
WHEREAS, the City desires to execute necessary conveyance documents to
complete the transaction between the City and the Grantor.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
Delaware, Franklin, and Union Counties, State of Ohio, of the elected
members concurring that:
Section I. The City Manager is hereby authorized to execute all necessary
conveyance documents to acquire a 0.038 -acre, more or less, permanent easement
from Ashland LLC, for the appraised value of $2,300.00, said easement located within
Franklin County Parcel No. 273 - 012284 -00, and more fully described and depicted in
the attached Exhibits A and B.
Section 2. Council further hereby authorizes and directs the City Manager, the
Director of Law, the Director of Finance, the Clerk of Council, or other appropriate
officers of the City to take any ether actions as may be appropriate to implement this
Ordinance.
Section 3. This Ordinance shall take effect in accordance with 4.04(b) of the
Dublin Revised Charter.

PURPOSE OF CONSTRUCTING A SHARED-USE PATH.
The City of Dublin (the "City'� is preparing to construct the Smiley Park shared-use path project,
which will include the construction of a shared-use path and related public improvements
connecting to Smiley Park (the "Project"). The City is obtaining easements from various
landowners to construct the Project.
This Project requires that the City acquire a permanent easement from Ashland LLC (the
"Grantor") from the property located on Paul Blazer Parkway, identified as Franklin County Parcel
Number 273-012284-00.
The City and the Grantor participated in good faith discussions and have come to mutually
agreeable terms for the acquisition of the necessary easement for the sum of $2,300.00, which is
the appraised value of the easement.
The appropriation consists of a 0.038-acre, more or less, permanent easement. The appraised faill
market value of the permanent easement was determined to be $2,300.00,
Ordinance 02-17 would authorize the City Manager to execute all necessary conveyance
documents to formally acquire the necessary easement described above. Staff recommends that
Council approve Ordinance 02-17 at the second reading/public hearing on January 23,, 2017.

Situated in the State of Ohio, County of Franklin, City of Dublin, and being a part of a 6.087 acre
tract conveyed to Ashland Inc. by Instrument #200811070163690, all records herein are from
the Recorder's Office, Franklin County, Ohio and being more particularly described as follows:
Beginning at the northeast corner of said 6.087 acre tract;
Thence, South 05008'53" West, a distance of 10.02 feet along the east line of said 6.087 acre
tract to a point;
1. Thence, North 81'4232" West, a distance of 164.18 feet to a point;
2. Thence, North 08018'14" East, a distance of 10.00 feet to diameter iron pin bent o
the north line of said 6.087 acre tract;
Thence, South 81 "42'32" East, a distance of 163.63 feet along the north line of said 6.087 ac
tract to the Point of Beginning containing 0.038 acres., more or less, subject to legal highway
easements, leases and restriction of record and of records in the respective utility offices.
The bearings described herein are based on the Ohio State Plane Coordinate System, Sout
Zone., NAD83 (2011). Said bearings originated from a field traverse which was referenced to sal
coordinate system by GPS observations and observations of selected stations in the ON
Department of Transportation Virtual Reference Station Network.
