NOW, THE EFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. The City of Dublin desires to enter into a contract, attached hereto as an Exhibit, with the District Advisory Council of the Franklin County General Health District to provide health services to the residents of the City of Dublin. Section 2. The City Manager and Finance Director be, and hereby are, authorized and directed to execute said contract with the District Advisory Council of the Franklin County General Health District. Section 3. This Ordinance shall be effective at the earliest date permitted by law. Pad this / of (301;:r)b �� , 2016. ayor - P#Iesidiog Officer 'ATTEST: Clerk of Council Cty Office of the City Manager 5200 Emerald Parkway +Dublin, OH 430 i of Dublin 17 -1090 Phone: 614.410 -4400 o Fax; 614 -410 -4490 TO; Members of Dublin City Council FROM Dana L, McDaniel, Ciry ManaggrC DATE: September 22, 2016 RE; Ordinance No, 36 -16 — Franklin County Public Health 2017 Contract Summary Ordinance No, 36-16 authorizes the ON Manager to enter into a contract with the District Advisory Council of the Franklin Cauniy General Health District (Franklin County Public Health) for the provision of public health services and plumbing inspection services for 2017, Franklin County Public Health serves as the public health agency for the City, including the portions of the City in Delaware and Union Counties, On August 9, 2016, the Franklin County Board of Health approved a per capita rate of $7.89 for the public health services it provides to participating jurisdictions, This per capita rate reflects a 5,06 % increase over the 2016 per capita rate, Based on MORPC's estimated population for Dublin of 44,641, the City's cast for the 2017 contract is $352,217,49, As outlined in the attached correspondence, two years ago, Franklin County Public Health notified jurisdictions about the need to raise an additional annual investment of $957,500 to address core services and unfunded mandates, After input from jurisdictions and hearing their concerns, the Board of Health opted to phase in this increase over time, This will be the final year to phase in the additional investment funds generated by the per capita increase, The per capita rate of $7,89 actually generates less than their original request of $957,500, However, the additional funds successfully allowed Franklin County Public Health to assure core public health services and achieve pubiic heaith accreditation, A fuil report on the use of these funds and their accamplishmentswill besent later this fall. As Council is aware, the mosquito control and management program is handled under a separate, three -year (2014 -2016) contract between Vector Disease Contra) Inc, and Franklin County Public Health, The current contract will expire at the end of 2016. UDCI invoices the Ciry of Dublin for the work completed under the contract, FCPH is responsible for the contract administration and monitors UDCI's performance and compilance with the terms, conditions and specifications to the contract, The cost to the City of Dublin under the current contract is $39,71450 per year There is an option to extend the contract far two additional one -year periods. Dublin and FCPH staff have decided to enter into a one -year extension and make amendments to the existing contract to accommodate some changes and modifications to the mosquito management program in order to respond appropriately to emerging vector borne diseases and other defined short -term program needs. This extension period will allow FCPH and a warkgraup of jurisdictional representatives taproperly research and develop a comprehensive approach to the program outline. Franklin County Public Health shall, for the aonsiderafion hereinaffer stated, furnish to the City of Dublin, Ohio, and inhabitants thereof, all such public health services as are furnished to all villages and townships and the inhabitanfs thereof, of Franklin County, Ohio. Said services shall include the minimum standards and optimal achievable standards for boards of health and local health departments pursuant to Ohia Revised Code Section 3701.342. Said services shall include enforcement of all rules and regulations as allowed bylaw according to the most current version of fhe Ohia Administrative Code. And, the current version of the above - described regulations of Franklin County Public Health shall apply to and be enforceable within thejurisdictian of the Franklin County Board of Healthe including the Franklin County General Health District and the City of Dublin. Such services shall be rendered, if appropriate and necessary, when requested by the citizens of Dublin, Ohio, officials of city government, school authorities ar medical personnel practicing in or around the City of Dublin, Ohio or when required by state statute, The City Attorney of Dublin, Ohio shall be responsible for any litigation involving enforcement of Health Regulations within the corporate limits of said political subdivision. This Agreement and any claims arising in any way out of this ,Agreement shatl be governed by the laws of the State of Ohio. Any litigation arising out of or relating in any way to this Agreement or the performance hereunder shall be brought only in an Ohio court of competent jurisdiction in Franklin County, Ohio, and the City of Dublin hereby irrevocably consents to such jurisdiction. SECS Said public health services shall be furnished beginning January 1, 2017 and ending December 31, 2017 provided, however, that either party to this agreement shall have the right to cancel the same upon four (4j months written native and the parties hereto may, by mutual written agreement, modify the terms of this agreement. SEC�I�iN 3. Franklin County Public Health will provide ongoing communication with the Mayor/City Manager and his or her designees through a webinar or conference call at least quarterly. This communication will provide information an timely public health topics, upcoming events and featured services. Reports and other information about direct services that are being provided to the citizens of Dublin will be provided upon request. SECiIaN 4, The City of Dublin, Qhia shall pay to Franklin County Public Health for said public health services furnished to the City of Dublin, Qhio and the inhabitants thereof, such sum or sums of money based on a per capita rate as would be charged against municipal corporations composing the Franklin County General Health District at a per capita rate of $7.89, SECTIQN S, Said sum or sums of money shall be paid by the said City of Dublin, Ohio to said Franklin County Public Health upon receipt afsemi- annual invoices by the Franklin County Board of Health on the first day of January, and June, 2017, The sum far 2017 shall not exceed X352,217.49, notwithstanding any fee established pursuant to the sections set forth below, SECTION 6. In any instance where Franklin County Public Health expends funds to abate a nuisance pursuant to Section 1, above, within the City of Dublin, Ohio, Franklin County Public Healfih may invoice fihe Cifiy of Dublin, Ohio for the oasts of such nuisance abatement. Further, the City of Dublin, Ohio, shall pay, in addition to Chase sums set forth in Section 5, above, to Franklin County Public Health the cosfi to abate the nuisance Franklin County Public Health agrees to certify such nuisance abatement casts to the Franklin County Auditor to be recorded as a lien upon the property and shall reimburse all funds recovered under such a Tien to the City of Dublin, Ohio. PLUMBING INSPECTION SERVICES: SECTION 7. Franklin County Public Health shall, for the consideration hereinafter stated, furnish to the City of Dublin, Ohio, all plumbing inspections as are furnished to all inhabitants within the general health district of Franklin County. Inspectors are to be state certified by the Ohio Department of Commerce. SECTION 8. The City of Dublin, Ohio, through its Building Department, shall issue permits and collect fees for such plumbing inspections. The fee to be charged shall be the most current fee charged by the Franklin County General Health Disfiriat. The City of Dublin, Ohio, shall forward sixty �bOj percent of all plumbing inspection fees collected by them to the Franklin County General Health District after said Health District has submitted monfihly statements of the amount due. The City of Dublin, Ohia shall pay said amount, within thirty l�n� days after receipt of said statement. SECTION 4. phis contract is approved by a majority of the members of the {egisiafiive authority of the City of Dublin, pursuant to the �ravisians of Ordinance _ dated , SECTION 10. The City of Dublin, Ohia has determined that Franklin County Public Health is organised and equipped to adequately provide the service that is the subject of this contract.
