An Ordinance Authorizing The Purchase Of Land At 6580 David Road For
The Future Construction Of Banker Drive Extension, And Declaring An
Emergency
WHEREAS, a proposed Lowe's store will be constructed at 6555 Dublin Center
Drive; and
WHEREAS, Lowe's Companies, Inc. is required to extend Banker Drive from
Dublin Center Drive to the western boundary of their proposed store site; and
WHEREAS, the City desires to acquire 6580 David Road for an amount not to
exceed $200,000 for the extension of Banker Drive from the western boundary of the
proposed Lowe's store at 6555 Dublin Center Drive to David Road; and
WHEREAS, sufficient funds have been appropriated in the 1999 Operating Budget
for land acquisition in the Capital Improvements Tax Fund.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Dublin,
State of Ohio, ~ of the elected members concurring that:
Section l . The City Manager is hereby authorized to execute a Real Estate Purchase
Agreement, or the necessary documents to accept an assignment of apre-existing
Real Estate Purchase Agreement. Further to execute any necessary closing
documents related to the acquisition of 6580 David Road for the future construction
of Banker Drive extension.
Section 2. This Ordinance is declared to be an emergency measure necessary for the
immediate preservation of the public safety and welfare of this City and for the
further reason that this Ordinance is required to be immediately effective for the
timely execution of the Real Estate Purchase Agreement and the subsequent
construction of Banker Drive extension; therefore, this Ordinance shall take effect
and be in force immediately upon its passage.
