Fonn No. 30043 64-06 Ordinance No. Passed , 20 AN ORDINANCE AMENDING CHAPTER 35 OF THE CODIFIED ORDINANCES TO REVISE THE FEE AND SERVICE CHARGE REVENUE/COST COMPARISON SYSTEM AND ESTABLISHING A SCHEDULE OF FEES AND SERVICE CHARGES FOR CITY OF DUBLIN SERVICES WHEREAS, the City of Dublin, Ohio has conducted an analysis of its services, the full costs of providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for the services; and, WHEREAS, based on this analysis, a cost analysis document, dated October 2006, has been prepared; and, WHEREAS, the specific fees to be charged for City provided services must be adopted by the City Council. NHEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, members of the elected officials concurring: Section 1. Chapter 35 of the Codified Ordinance of Dublin, Ohio is hereby amended to read as follows: Chapter 35 FEE AND SERVICE CHARGE REVENUE/COST COMPARISON SYSTEM AND FEES Section 35.80 "Full Costs" Defined For the purpose of this subchapter, the following definition shall apply unless the context clearly indicates or requires a different meaning. "Full Costs" includes the following elements: (1) All applicable direct costs including, but not limited to salaries, wages, overtime, employee fringe benefits, services and supplies, maintenance and operating expenses, contracted services, special supplies, and any other direct expense incurred. (2) All applicable indirect costs including, but not restricted to, building maintenance and operations, equipment maintenance and operations, communications expenses, computer costs, printing and reproduction, vehicle expenses, insurance, debt service, and like expenses when distributed on an accounted and documented rational pro-ration system. (3) Fixed asset recovery expenses, consisting of depreciation of fixed assets, divided by the approximate life expectancy of the fixed asset. (4) General overhead, expressed as a percentage, distributing and charging the expenses of the City Council, including the Clerk of Council, Department of Law, City Manager, Accounting and Auditing, Taxation, Procurement, Information Technology, Economic Development, Human Resources and City promotional programs, and all other staff and support service provided to the entire City organization. Overhead shall be prorated between tax-financed services and fee- financedservices onthe basis of said percentage so that each tax-financed service and fee-financed service shall proportionately defray such overhead costs. (5) Departmental overhead, expressed as a percentage, distributing and charging the cost of each department head and his or her supporting expenses as identified in subsections 1, 2, 3, and 6 of this Section. (6) Debt sewice costs, including the payment of interest, and trustee fees and administrative expenses of all applicable bond, certificate, or securities issues or loans of whatever nature or kind. ~ (7) The "full costs," in most instances, will be rounded to the nearest ten dollars, with the actual fee established by the ordinance establishing a schedule of fees and charges for City services. Form No. 30043 64-06 Page 2 Ordinance No. Passed 20 Section 35.81 Findings and Intent (a) It is the intent of the City Council to ascertain and recover the specified percentages of full costs from fees, charges, and regulatory license fees levied in providing the regulation, products, or services set forth in this Chapter. (b) The fee and service charge revenue/cost comparison system set forth in this Chapter provides a mechanism for ensuring that fees adopted by the City for services rendered do not exceed the reasonable estimated cost for providing the services, unless otherwise noted. (c) It is the intent of the City Council to achieve a more equitable and fair mix for financing services set forth in this Chapter in order to reduce or eliminate subsidizing these services with general tax revenue; thereby, allowing those general tax revenues to be used for general services, including infrastructure maintenance and replacement. Section 35.82 Delegation of Authority and Direction to the City Manager (a) The City Manager is hereby delegated the authority and directed to provide documents to the City Council to implement its policy to adjust fees and charges to recover the percentage of full costs as established in this Chapter. (b) The City Manager is hereby delegated the authority to issue Orders defining terms, setting out administrative, fee collection, and financial procedures, definitions, and establishing effective dates of all fees set by the City Council by Ordinance. All Orders shall be signed by the affected department head, shall be signed by the Director of Finance certifying the financial requirements of this Chapter have been met, and shall be signed by the City Manager specifying the effective date of the Order. (c) "Full costs" shall be as defined in Section 35.80. In adjusting fees and charges, the City Manager shall act in an administrative and ministerial capacity and shall consider only the standards and criteria established by this Chapter and the applicable State laws. All Orders issued shall comply in all respects with this Chapter, and the schedule of fees and rates as set by the City Council. Section 35.83 Schedule of Fees and Service Charges (a) The City Manager, Director of Finance, and each City department head, under the direction of the City Manager, shall review annually the fees and service charges listed in Appendix A- Schedule of Fees and Service Charges, and provide an adjusted fee or charge schedule to the City Council for its consideration so as to recover the listed percentage of full costs necessary to provide the listed regulation, product or service as modified by the notes following the list of services. These fees, unless otherwise specified, are for City of Dublin services and are in addition to any ~ charges made by any other governmental agencies. i (b) The services as listed in this Section shall be as defined in the document entitled "Cost Study for the City of Dublin, Ohio" as produced by the City of Dublin. (c) All fees and charges set pursuant to this Chapter and Section shall take effect as specified in each Order. (d) The City Manager may vary the review schedule listed in the Section if, in the judgement ofthe City Manager and a directly affected and requesting department head, a gross inequity would be perpetrated by not revising a fee or charge prior to the next rate review. Any such special rate review shall be reported to the City Council at its next succeeding meeting where the City Council may revise the fee or charge by Ordinance. (e) If fees are not collected at the time that the service is provided, the City has the right to pursue collection of any of the fees listed in this Ordinance, including certification to the County Auditor, remittance to a collection service, or any other appropriate pursuit for payment. Form No. 30043 Ordinance No. 64-06 Passed Page 3 20 Section 35.83 Schedule of Fees and Service Charges (Continued) (f) Should it become necessary to establish a new service fee or charge during the year, the City Manager may set the fee administratively. Any such fees set by the City Manager shall be reported to the City Council at its next succeeding meeting where the City Council may revise the fee or charge by Ordinance. The new service will then be included and analyzed in the next rate review. Section 35.84 Fee Appeals and Waivers Irrespective of the percentage of recovery and the "notes" in Section 35.83 -Appendix A, the City Council reserves the right to waive any fee in order to encourage development projects that enhance the City's tax base as outlined in the City's Economic Development Strategy. The City Manager may recommend further waivers or fee adjustments, based on hardship, to be accepted or rejected by City Council at its next regularly scheduled meeting. Section 2. SEVERABILITY If any portion of this Chapter is found to be unconstitutional or invalid the City Council hereby declares that it would have enacted the remainder of this Chapter regardless of the absence of any such invalid part. Section 3. REPEALER All Ordinances, the Codified Ordinances of Dublin, Resolutions, City Council Motions, and all actions of all City Boards and Commissions in conflict here within are hereby repealed. The fees and charges established by this Chapter shall supersede all previously established fees or charges for the same regulation, product or service, and all such previous fees and charges are hereby repealed on the effective date of the Order of the City Manager. Section 4. EFFECTIVE DATE That this Ordinance shall take effect and be in force on January 1, 2007. This is the annual update to Chapter 35 of the City's Codified Ordinances. This Ordinance revises the "City's Schedule of Fees and Service Charges for City of Dublin Services." These fees will become effective on January 1, 2007. The following sections provide additional information in relation to the proposed fee changes that are most notable. Community Develoument Services Land Use & Long Range Planning_(LU&LRP) Staff is recommending various fee increases in Land Use & Long Range Planning (LU&LRP). Most are based on recovering routine increases in the cost of operations. En 'nig_ Bering Engineering is introducing two new fees for services (see page 7, appendix A of Ordinance 64-06). (5-189) Easement encroachment review fee - In June 2006, City Council approved Ordinance 32- 06 regarding encroachments on City-owned property and easements. Pursuant to passage of the Ordinance, Engineering staff requested a fee be established and placed in the City's fee schedule to be effective for calendar year 2007. These encroachments happen when a private property owner encroaches into easements that have been dedicated for City use by a final plat. These encroachments usually involve various structures such as decks, patios, fences, and landscaping. A copy of Ordinance 32-06 is attached. (S-191) Utility company easements on City property -This is an application made by a utility company for anon-exclusive easement to install their its equipment on City-owned property. An example of this is Resolution 68-06 approved by City Council in August 2006 which authorized the City Manager to execute an easement with the Ohio Bell Telephone Company (AT&T) for the installation of telecommunication equipment. This was done to provide service to a new subdivision called the Glade at Ballantrae after development in the area was akeady initiated. A copy of Resolution 68-06 is attached. Both of these services are rather time-intensive and can involve staff and services from Engineering, LU&LRP, as well as the City Attorney, and County Recorder's office. Staff is recommending a 50% cost recovery of administrative time for 5-189 as a courtesy to the residents, and a 100% cost recovery for 5- 191 when working with the utility companies. Memo to City Council Ordinance 64-06 Page 2 Community Development Services (continued) Building Standards Another modification to note is for (5-153) the home improvement fee (see page 6, appendix A of Ordinance 64-06). The Building Standards staff has had increasing complaints about the fee for basement finishes. The fee is a flat $50 up to 1,000 sq. ft., and then greatly increases above the 1,000 sq. ft. limit using the standard residential review and inspection fee schedule. More and more, residents are completing basement remodels for theater rooms and other recreation areas that exceed the 1,000 sq. ft. limit for the $50 flat fee. Staff is proposing a minor change to accommodate the residents with remodels and basement finishes up to 1,500 sq. ft. by proposing a $100 flat fee for those falling in the 1,001 to 1,500 sq. ft. range. Anything above 1,501 sq. ft. will follow the standard residential review and inspection schedule. Public Safety Services Police DeQartment Staff is recommending an increase for (5-067) Police False Alarm Response (see page 7, appendix A of Ordinance 64-06). As you are aware, each Dublin residence and Dublin business receives two non- chargeable false alarm responses in each six month period. This is done as a courtesy for the residents and businesses and the costs for those false alarm runs are subsidized by the City. It now costs approximately $70 for each police run. Therefore, staff is proposing an increase from $60 to $70 for the third and fourth false alarm runs. Fees for subsequent false alarm runs remain unchanged. Another notable change is that of the Police Department's fingerprinting service (see page 7, appendix A of Ordinance 64-06). Starting on January 1, 2007 the Police Department will not be able to submit the ink-rolled fingerprint cards to the State Bureau of Criminal Identification & Investigation (Ohio BCI & I). Instead, a computerized submission system will be required. The City will be charged $15 for each submission. Staff is recommending the submission fee charged by the Ohio BCI & I be recovered from each civilian printed. Therefore, each civilian printed will be charged the $15 State submission fee. For those civilians not living or working in the City of Dublin, and not working for a government agency will be charged a fee of $35 (the current $20 administration fee plus the $15 State submission fee.) The Police Department reported processing more than 800 units of fingerprint cards for calendar year 2005. Most of those units were non-chargeable. T'he City's Civilian Bureau Commander has prepared an informational memo with regard to this issue which is attached for your review. Leisure and Cultural Services Recreation Services There are no significant fee changes proposed for calendar year 2007 in the recreation services area. At January 1, 2006 a 5% fee increase went into effect for Dublin Community Recreation Center (DCRC) annual passes as well as a 5% increase in outdoor pool pass fees. Other modifications were made for community hall fees and theater fees that went into effect on April 1, 2006. As stated during last year's review of outdoor pool fees, eventually the discounted rate for residents holding a DCRC annual pass and also purchasing an outdoor season pool pass will be discontinued (see page 12, appendix A of Ordinance 64-06). At one time, the City encouraged the purchase of both passes by offering a discount option. Now that pool capacities are beginning to be reached, the need for the discount is minimized. As proposed by staff, the 2007 calendar year will be the final year for the phase-out of the discount (ranges from $5 to $10 as proposed). Memo to City Council Ordinance 64-06 Page 3 Leisure and Cultural Services Recreation Services (continued) During this year's cost study review, staff brought forward several issues that may need to be addressed at some point in the near future, outside of the fee schedule review process. Briefly, these issues are: • Discussion regarding modification to the fee schedule for School District DCRC fees that impact those Hilliard City School District residents similar to that given for Dublin City School District residents who reside in the City of Columbus. • With regard to ball field rental, the City currently has a flat $40 fee per day for un-groomed and unlit fields subject to availability. The fees are waived for Dublin Youth Athletics (DYA) and the Dublin Soccer League (DSL). Because of the usage these fields have been getting from outside teams, a more comprehensive fee schedule for ball field rental may need to be addressed. Utility and Enterprise Services Fee changes proposed for cemetery and maintenance services are few, and are those needed to recover standard increases in costs of operations (see page 8, appendix A of Ordinance 64-0~. Fees will increase for sanitary sewer taps at January 1, 2007 as previously approved by Ordinance 07-OS in February 2005. That Ordinance included a provision fora $200 increase to the sanitary sewer tap fee based on a 3/4" water tap. This increase was approved with the goal of maintaining adequate reserves and stability in the sewer fund. RECOMMENDATION: At present, the City Council Finance Committee has not scheduled to meet for review of the proposed fee changes for calendar year 2007. Staff requests the Finance Committee Chairperson advise as to the need of a Finance Committee meeting. A Finance Committee meeting will be scheduled if it is deemed necessary. Staff recommends approval of Ordinance 64-06 at second reading and public hearing. Past practice has been to review the drawing and determine if the encroachment would interfere in the City's use of the easement. If staff determined it did not, the resident requesting to install the encroachment was then asked to sign an Encroachment Form and received a permit to build. An example of this older form is attached. These signed documents were retained in files in Engineering. While the previous document put the resident at that time on notice as to the conditions of approval, staff has determined that this will be inadequate in the future. Given properly turnovers, it is highly unlikely that the same resident would reside in the home at a future date when the City needs to access the easement. Therefore, staff is requesting the ability to have a formal encroachment agreement signed by both the City and the resident, which is then recorded at the appropriate county offices. The advantage to this is that the Encroachment Agreement would be referenced any time a title search is done on the property. Staff worked with Schottenstein, Zox and Dunn to develop the proposed agreement. A copy is attached for your reference. Staff believes that regulating the use of the easements is necessary to protect the public infrastructure and the established drainage patterns. Staff will be requesting a new fee to cover the costs of review of these encroachments as well as recording fees in the Cost Study update this fall. Recommendation Staff recommends an introduction of Ordinance 32-06 at the May 15, 2006 Council meeting. Permission to Remain in City Easement Area. The City, its successors and assigns, agrees that the Deck shall be permitted to remain in City Easement Area provided that Property Owner, their successors and assigns, acknowledge that the City may utilize the City Easement Area consistent with the terms of the Easement and this Agreement In the event it is necessary to gain access to the City Easement Area (or use it in any other mamler contemplated by the terms of the Easement or this Agreement) at the location of the encroachment by the Deck, the Property Owner acknowledges that the City may take any and all necessary action (including, but not limited to, temporarily, permanently, or partially removing the Deck located within the City Easement Area) necessary for its use and enjoyment of its unfettered rights under said Easement. In such event, the City shall not be liable for any expenses, damages to, or reconstruction or replacement costs of the Deck, which encroaches upon the City Easement Area, regardless of what materials are used by Property Owner to construct the Deck. The City may restrict access to Deck, as long as deemed necessary by the City, in the event it is necessary to gain access to the City Easement Area pursuant to the terms of the Easement or this Agreement. 2. Extension. Property Owner, their successors and assigns, agree not to extend the Deck any further into the City Easement Area than is shown on the attached Exhibit "A." 3. Assumption of Liabilities. Property Owner, theirsuccessors and assigns, agree to be financially responsible to the City for any and all costs, expenses or liabilities (including reasonable fees of attorneys, paralegals, experts, court reporters and others) incurred to remove or bypass the Deck as directed by the City. 4. Indemnity. Property Owner shall indenutify, protect, defend, and hold harmless the City from and against all loss, liability, damage, actions, causes of action, or claims for injury, death, loss or damage of whatever nature to any person, property or business interest caused by or resulting from an act or omission of Property Owner or their agents, employees, customers, servants, licensees, tenants, subtenants, guests or invitees in respect to the matters set forth in this Agreement and their use of the City Easement Area, and from and against any and all costs, expenses or liabilities (including reasonable fees of attorneys, paralegals, experts, court reporters and others) (H05845922 ~ 1 incurred or anticipated by the City in comlection with any claim, action or proceeding in respect of any such loss, liability, damage, action, cause of action, or claim. 5. Termination. Property Owner will maintain standard homeowner's liability, property, and casualty insurance of appropriate value for property of similar nature and valuation. 7. Miscellaneous Provisions. (a) Successors and Assigns. This Agreement shall run with the land and be binding upon and inure to the benefit ofthe respective heirs, personal representatives, successors, transferees, and assigns of the parties hereto. (b) Counterparts. This Agreement may be executed in one or more counterparts, each of which shall be deemed to be a duplicate original, but all of which, taken together, shall constitute a single instrument. (c) Caetions. The captions contained in this Agreement are included only for convenience of reference and do not define, limit, explain or modify this Agreement or its interpretation, construction or meaning and are in no way to be construed as a part of this Agreement. (d) Severability. If any provision of this Agreement or the application of any provision or any circumstance shall be deterntined to be invalid or unenforceable, then such determination shall not affect any other provision of this .Agreement or the application of said provision to any other person or circumstance, all of which other provisions shall remain in full force and effect. (e) Amendments in 1~Vriting. No chance, amendment, termination or attempted waiver of any of the provisions of this Agreement shall be bindin;; upon any party unless in writing and signed by both of the parties hereto. (f) Covenants Run With the Land. It is intended that the covenants, easements, agreements, promises and duties set forth in this Agreement shall be construed as covenants which run with the land. (g) Termination of Liability Upon Transfer. If Property Owner should transfer their fee simple interest in and ownership of their Property, then the liability of the transferor for the breach of any covenant or provision contained in this Agreement, occurring after the date of such transfer, shall automatically be terminated only upon City's approved written notice. (h) Restoration. If, as a result of the exercise of any easement rights created under this Agreement, Property Owner shall damage or disturb the improvements of the City or City Easement Area, then Property Owner shall promptly repair or restore the property of the City to, as near as possible, the condition existing prior to such damage or disturbance. (i) Conformance with Dublin Right-of-ti~'av Code sections. PropertyOwner must be in full compliance with regulations pertaining to right-of-« ay as outlined in Dublin Code, including but not limited to, Chapter 98. (j) Venue. The parties hereto hereby consent to the exclusive jurisdiction of the courts of the State of Ohio in Franklin County, and the United States District Court for the Southern District of Ohio, and waive any contention that any such court is an improper venue for enforcement of this Agreement. The property is legally described as being: Situated in the State of Ohio, County of Franklin, City of Dublin, located in Virginia Military Survey No. 3453, containing 1.267 acres, more or less, being Reserve "N" of Ballantrae Section 3, as the same is numbered and delineated upon the recorded plat thereof in Plat Book 102, Pages, 47-50, being the property of the City of Dublin, Ohio, an Ohio municipal corporation, conveyed by Instrument No. 200312040385661, Franklin County Recorder's Office, Columbus, Ohio. The Grantor represents and warrants to the Grantee that Grantor is the true and lawful owner of the Property and has full right and power to grant and convey the rights conveyed herein. The Grantee hereby additionally agrees to relocate or remove its facilities as outlined above in the event Grantor determines the necessity to: (a) widen, modify and/or improve the intersection of Baronscourt Loop and Baronscourt Way; (b) conduct necessary public improvements on the Easement Area; or (c) require the relocation or removal of such facilities for the public health, safety or welfare. Any such relocation or removal shall be performed by Grantee: (a) within a reasonable amount of time; (b) at Grantee's sole cost and expense; (c) in a manner so as not to diminish the capacity or efficiency of operation of the facilities therein; and (d) in accordance with plans and specifications approved by all necessary governmental authorities. The only change recommendation we make is in service number S-070 -Fingerprinting. Starting January 1St, 2007, the Police Division will begin submitting civilian fingerprint/background checks electronically to the State of Ohio using the computerized WebCheck®system. The State of Ohio Bureau of Criminal Identification & Investigation will no longer accept rolled fingerprints on a print card for background checks, forcing agencies who wish to provide this service to use WebCheck®. Each WebCheck®fingerprint submission will now cost the division $15.00. It is recommended that we no longer waive the $20.00 charge forgovernments, government agencies, Dublin residents and Dublin businesses in orderto recoup the cost to the agency for submissions. As for the amount to be charged, we have no specific recommendation other than to, at minimum recoup the $15.00 per submission charge. The agreementwe have executed with Ohio BCI&1 is silent on the passing of costs on to the civilian being printed. The Division of Police has completed the purchase of the software and hardware for the WebCheck® system at a one time cost of $2900.00. For the 2007 operating budget, we have requested $27.300.00 in account 23-49 to cover WebCheck®system fees for the year, which will allow us to complete an average of 35 print submissions per week.
