BACKGROUND: On the advice of Dublin's Law Director, staff has systematically researched all Dublin zoning activity on all parcels annexed into Dublin. Through this investigation of written records, staff has found several areas where zoning was not established via a rezoning ordinance. The Planning Division is responsible for compiling and processing these "area rezoning" applications to formally establish Dublin zoning wherever there is a~ question about the zoning history. The subject sites in this case were annexed between 1881 and 2001; there is no history of a formal rezoning ordinance for these areas since that time. Ordinance #108-03 was introduced at City Council on September I5, 2003. It will establish Dublin R, Rural, R-1, Restricted Suburban Residential, or the R-2, Limited Suburban Residential Districts. An informational meeting was held on October 28, 2003 at the Dublin Recreation Center, and a few property owners from this area attended. After the Planning Commission makes its recommendation, the case will be forwarded to City Council for a public hearing and final vote. With a positive recommendation from the COmI111SS1011, a simple majority vote is required for passage- A negative Commission recommendation requires five votes for City Council passage. If the ordinance is approved, it wilt take effect in 30 days. Properties listed in this ordinance include the Junior Academy Day Care (which is located on the east side of Coffman Road), several "estate lots" along Indian Run Drive and Dublin Road, Sells Middle School, and one city-owned parcel just south of the I-270 bridge. Parcels range in size from roughly one-half to almost 12 acres. These properties are proposed to receive the R, R-1, or R-2 Districts. The proposed zoning classification selected indicates what has been shown on Dublin's zoning map for over 15 years. This rezoning includes the Indian Run Estates subdivision. The lots on the south side of Indian Run Drive have split annexation dates whereby the southern half of these lots were annexed in 1881, and the remainder of the subdivision was annexed in 2001. As a result, these properties have been carrying a split zoning of R-2, Limited Suburban and the Washington Township R-SR, Restricted Suburban District zonings for a number of years. This rezoning proposes to establish R-1 District- zoning for all lots within this subdivision. • One of the properties on Coffman Road has a conditional use permit for aday-care facility. This conditional use permit is in compliance with the Dublin Code and will be pernlitted to continue after this rezoling, subject to all applicable regulations. This rezoning proposes to establish t11e Dublin R, R-1, or R-2 Districts. All legally non- confornling uses and structures will be subject to the requirements of Section 153.004(C) of the Dublin Zoning Code. This rezoning proposes to reclassify all of the Indian Run estates properties to the R-1 District. A letter was mailed to the listed property owners and has been attached. Staff held an informational meeting for the property owners, and some attended. Staff has also talked with property owners by phone regarding this rezoning. Community Plan, Land Use and Zoning Issues: • On August 12, 2002, City Council amended the Future LaI1d Use map (Map 8) of the Community Plan. All of the properties in this application are shown on the Future Land Use Plan as having an existing land use as "Residential," "Non-Residential," or "Public/hlstitutional Buildings." This rezoning is a housekeeping issue and will have no immediate impact. Legally non- COilfonlling uses cannot be expanded, and they cannot be re-established after being discontinued for a period of two years. Most of Dublin's development standards will apply even if this rezoning is not adopted. A 1976 ordinance requires adherence to Dublin standards, wherever they are stricter, following annexation. However, the failure to establish Dublin zoning on the property will make administration and enforcement extremely difficult. The properties listed in this application were annexed from Washington Township and%or Franklin County between 1881 and 2001. Section 153.004(D) of the Code states that: "Territory annexed to the municipality after the effective date of the zoning ordinance shall continue to be governed by the zoning regulations which governed the telYitory annexed immediately prior to annexation." Relying on the prior township or county zoning district(s) is not precise or advisable. No development is proposed as part of this application, and it has no effect on utilities. Currently, municipal water and sanitary services reach some of these properties. The zoning does not affect utility status. • New development anywhere in Dublin, including on these parcels, must comply with adopted stormwater management regulations and other development standards for the City of Dublin. STAFF RECOMMENDATION Staff research indicates these properties were not placed in a Dublin zoning classification by , passage of a formal rezoning ordinance. They have been reflected as R, R-1, or R-2 on the zoning map for many years. This area rezoning is intended to avoid any future Code Enforcement problems arising from township or county classifications and inconsistencies within the Dublin zoning map. This action provides proper zoning and is primarily a housekeeping effort. Staff recommends approval of this rezoning. Bases: 1) This rezoning will provide an appropriate Dublin zoning classification for land within the City limits to provide for the effective administration of development standards, procedures, etc. 2) The rezoning will maintain the established development pattern that has been in place for many years and reflects land uses consistent with those listed in the Community Plan. It is comprised of 29 parcels totaling approximately 43 acres annexed into Dublin between 1881 and 2001. She showed a slide of the area proposed for this rezoning. One small parcel outside the main area is also included in this application. Most of the properties are located south of Brand Road to the northeast of Post Road and to the west of the Scioto River. Included are the Junior Academy Daycare, a number of large lot residences along Indian Run Drive, Dublin Road, and a portion of Sells Middle School. The school was initially thought to be LI, Limited Industrial District, but after further research staff believes the appropriate zoning is R-2. A property at 7060 Coffman Road is also proposed for the R, Rural District. It has a conditional use permit currently, and this rezoning will not create any non-compliance issues with the property. Along Indian Run, the southern properties were annexed in 1881, and the northern half of these properties were annexed in 2001. She said they had two different zonings: RSR (Township Zoning), and R-2. Ms. Wanner said these properties will be given a comprehensive zoning of R- 1. The elementary school will receive a R-2 zoning. Other parcels will receive either the R, Rural District, or R-1 District classification. Staff recommends approval of this area rezoning. Mr. Zimmerman made a motion to approve this area rezoning because it will provide an appropriate Dublin zoning classification for land within the City limits to provide for the effective administration of development standards, procedures, etc., and will maintain the established development pattern that has been in place for many years and establishes land uses consistent with those listed in the Community Plan. Ordinance #121-03 will establish the Dublin, PIP, Planned Industrial Park District for seven parcels along Corporate Center Drive (within Northwest Corporate Centre) and the RI, Restricted Industrial District zoning for five properties located south of Woerner- Temple Road, north of Rings Road, east of the Ballantrae development, and west of Avery Road. All of the properties included in this ordinance are commercial or industrial businesses. One of the properties, known as the Shamrock Lane Development, is under consideration for purchase by the City contingent upon EPA assessments.
