Mr. Zimmerman seconded the motion, and the vote was as follows: Mr. Gerber abstai ecause his wife owned a property in this area for which he paid a mortgage; Ms. Boring, yes; Ms. no; Mr. Sprague, yes; Mr. Saneholtz, no; Mr. Zimmerman, yes; and Mr. Messineo, yes. (Approve - -1.) 3. Area Rezoning 03-0992 -Inner Circle I-270 Commercial Area Rezoning Anne Wanner said this area rezoning is comprised of 46 parcels totaling approximately 411 acres. Most of the parcels are located on the inside of I-270. Properties listed in this application include s everal c ommercial,retail, a nd o ffice e stablishments, i ncluding A shland Incorporated, Embassy Suites, and OCLC. She showed an aerial slide indicating the proposed zonings. The zones proposed for these properties are: OLR, Office Laboratory Research District; LI, Limited Industrial District; CC, Community Commercial District; and SO, Suburban Office and Institutional District. She said these parcels have been shown on the Dublin Zoning Map for the last 15 to 20 years and the parcels range in size from 0.5 acre to 40 acres. The Post Road properties that are being rezoning are located on the south side. She said the MAG Dealerships and the Field of Corn are also included in this application. These sites were annexed into Dublin between 1965 and 1969. Ms. Wanner said an informational meeting was held and several property owners attended. She had also spoken to property owners by phone. Ms. Wanner said staff is recommending approval of this application. Ms. Reiss asked why LI was wanted along the freeway. Mr. Gerber said for the same reason given for the previous case. She said if the Commission recommended this, someone could come in tomorrow and put light industrial there. Ms. Wanner said those two parcels were fully developed with LI development standards as the OCLC Campus. The sideyards and rear yards are dictated by the building height and depth. If something different was assigned to these parcels, it could potentially create non- conformities for OCLC that do not exist today. Mr. Gerber made the motion to approve this area rezoning because it will provide an appropriate Dublin zoning classification for land within the City limits to provide for the effective administration of development standards, procedures, etc., will maintain the established development pattern that has been in place for many years and establish land uses consistent with those listed in the Community Plan. Staff Contact: Anne Wanner, Planner BACKGROUND: On the advice of Dublin's Law Director, staff has systematically researched all Dublin zoning activity on all parcels annexed into Dublin. Through this investigation of written records, staff has found several areas where zoning was not established via a rezoning ordinance. The Planning Division is responsible for compiling and processing these "area rezoning" applications to formally establish Dublin zoning wherever there is a~ question about the zoning history. The subject sites in this case were annexed between 1965 and 1969; there is no history of a formal rezoning ordinance for these areas since that time. Ordinance # 108-03 was introduced at City Council on September 1 S, 2003. An informational meeting was held on October 28, 2003 at the Dublin Recreation Center, and a few property owners from this area attended. After the Plalllllllg COII11111SS1o11 illakGS lts recommendation, the case will be forwarded to City Council for a public hearing and final vote. With a positive recommendation from the Commission, a simple majority vote is required for passage. A negative Commission recommendation requires five votes for City Council passage. If the ordinance is approved, it will take effect in 30 days. CONSIDERATIONS: Site Characteristics: The subject area is comprised of 46 parcels, totaling approximately 411 acres. Most of the parcels are located inside the I-270 loop, north of Rings Road, west of the Scioto River Parkway. Properties listed ill this application include several commercial, retail, and office establishments, that include: Ashland Incorporated, Embassy Suites, and OCLC. Parcels range in size from roughly one-half to almost 40 acres. These properties are proposed to receive the CC, SO, OLR, or LI, Districts. The proposed zoning classification selected indicates what has been shown on Dublin's zoning map for over 15 years. • Staff had proposed that one of the properties originally listed in this application be zoned to the LI, Limited Industrial District. After further review of historic zoning maps and existing land uses, the R-2 District will be requested for Sells Middle School. This property was removed from this application and has been included in the Indian Run Et. Al. Area Rezoning application. (See Case #03-120Z). • This rezoning proposes to establish the Dublin CC, SO, OL,R, or LI Districts. All legally non-conforming uses and structures will be subject to the requirements of Section 153.004(C) of the Dublin Zoning Code. • A letter was mailed to the listed property owners has been attached. Staff held an infonmational meeting for the property owners, and some attended. Staff has also talked with property owners by phone regarding this rezoning. Staff is unaware of any opposition at this time. Community Plan, Land Use and Zoning Issues: • On August 12, 2002, City Council amended the Future band Use map (Map 8) of the Community Plan. All of the properties in this application are shown on the Future Land Use Plan as having an existing land use as "Non-Residential" or a future land use of "Office." This rezoning is a housekeeping issue and will have no immediate impact- Legally non- conforming uses cannot be expanded, and they cannot be re-established after being discontinued for a period of two years. • Most of Dublin's development standards will apply even i.f this rezoning is not adopted. A 1976 ordinance requires adherence to Dublin standards, wherever they are stricter, following annexation. However, the Cailure to establish Dublin zoning on the property will make administration and enforcement extremely difficult. The properties listed in this application were annexed front Washington Township and/or Franklin County between 1965 and 1969. Section 153.004(D) of the Code states that: ""l~erritory annexed to the municipality after the effective date of the zoning ordinance Dublin Planning and Toni .~onunission Staff Rcport January 8, 2004 Pagc 1 1 shall continue to be governcd by the zoning regulations which governed the territory annexed immediately prior to annexation." Relying on the prior township or county zoning district(s) is not precise or advisable. Utilities: • This is an action to establish Dublin zoning. No development is proposed as part of this application, and it has no effect on utilities. Currently, municipal water and sanitary services reach some of these properties. The zoning does not affect utility status. • New development anywhere in Dublin, including on these parcels, must comply with adopted stornlwater management regulations and other development standards for the City of Dublin. STAFF RECOMMENDATION Staff research indicates these properties were not placed in a Dublin zoning classification by passage of a formal rezoning ordinance. They have been reflected as CC, SO, LI, or OLR on the zoning map for many years. This area rezoning is intended to avoid any future Code Enforcement problems arising from township or county classifications and inconsistencies within the Dublin zoning map. This action provides proper zoning and is primarily a housekeeping effort. Staff recommends approval of this rezoning. Bases: I) This rezoning vt~ill provide an appropriate Dublin zoning classification for land within the City limits to provide for the effective administration of development standards, procedures, etc. 2) The rezoning will maintain the established development pattern that has been in place for many years and reflects land uses consistent with those listed in the Community Plan.
